File Note: RO has reported that the Consent to operate was issued to the industry from the Board vide no. CTOW/Fresh/GRP/2022/20685333 & CTOA/Fresh/GRP/2022/20685329 dated 30/12/2022 for the production of Premix @ 500 MTD from Bitumen @ 18 MTD & Crusher @ 12000 MTD which are valid upto 30/09/2027 under the name & style of Bajwa Builders (previously Name Shree Krishna Constructions), Village-Bidhipur, Near-New Bye Pass, Sidwan Road, Tehsil & District-Gurdaspur under Orange category. Now, the industry has been purchased by its new owners and has applied for obtaining fresh consent to operate under Air (Prevention & Control of Pollution) Act, 1981 & Water (Prevention & Control of Pollution) Act, 1974 under new Name & Style M/s Navdeep Infrastructure (Bajwa Builders), Village-Bidhipur, Near-New Bye Pass, Sidwan Road, Tehsil & District-Gurdaspur for same production capacity i.e. Hot Mix @ 500 MTD from Bitumen @ 18 MTD & Crusher @ 12000 MTD under Orange category as per latest policy of the Board. The industry has submitted copy of bills of the machinery as proof of purchase of the unit and also submitted copy of affidavit signed by its previous owners regarding handing over the unit to M/s Navdeep Infrastructure, Village-Bidhipur, Near-New Bye Pass, Sidwan Road, Tehsil & District-Gurdaspur through its new owners Sh. Navdeep Dhawan (Proprietor). The industry has also submitted copy of registration under MSME and also copy of the farad of the land record. The industry has deposited Rs. 20300/- vide online UTR No. 49987562 dated 01/04/2026 & Rs. 18000/- vide online UTR No. 460718907 dated 01/04/2026 under Water (Prevention & Control of Pollution) Act, 1974 & Air (Prevention & Control of Pollution) Act, 1981 including Rs. 1800/- as NOC regularization fee and Rs. 500/- application fee same are adequate for a period upto 30/09/2030 under both acts. The Hot Mix Plant has also submitted a copy of revenue report issued from SDM, Gurdaspur issued vide No. 126 dated 06/02/2014, wherein it has mentioned that the site of the Hot Mix Plant is situated outside Municipal Committee/Corporation and there is no class-A Town situated near the site. Distance from the Lal Lakir of the nearest village is approx. 1 KM. National Highway/State Highway is situated at 1.5 KM from the site. There is no any residential area/school/college/gurudwara/mandir/historical place etc. near the site. The industry has also submitted the copy of CLU obtained from DTP, Gurdaspur issued vide letter no. 133 dated 16/02/2014. As per said letter issued from DTP, Gurdaspur, the site is fall under mixed land use beyond and the said activity is allowed at the site. The site is not situated within the Municipal Corporation/Council and there is no any village Abadi within 500 meter from the site. Distance from the National Highway/Schedule Road/Bye Pass Road is more than 500 meter from the site. The Hot Mix Plant was visited by Er. Vinod Kumar, AEE of this office on 13/04/2026 and observed as under:- 1. The HMP was not in operation during visit. 2. The HMP has installed 01 no. rotary drum for production of hot mix. 3. The HMP has installed dust settling chamber followed by wet scrubber as APCD. 4. The HMP has provided sampling arrangements with stack of APCD. 5. The HMP has developed plantation around the boundary of the unit. The representative has advised to plant more trees. 6. The industry has complying with the code of practice for hot mix plant as per policy of the Board. It is pertinent to mention here that the Hot Mix Plant is complying with the guidelines issued by MoEF & CC vide notification no. 376 dated 18/05/2023 (Agenda Note is also attached herewith). EE, ZO has observed as under: 1. The industry has not submitted the detail increase in the CA certificate from 50.18 lac to 68.40 lac. 2. The industry has not submitted CLU certificate issued by DTP as well as the revenue report issued by SDM Gurdaspur. 3. The detail of APCD installed to the drum type or batch type. RO has filed the reply as under:- 1. The HMP has purchased by a new owner and they have applied for obtaining fresh CTOs from the Board and has deposited requisite fee along with NOC regularization fee, therefore, difference in the total fixed assets is not considerable. 2. The copy of CLU issued by the DTP, Gurdaspur vide letter no. 133 dated 16/02/2014 and the revenue report issued by the SDM, Gurdaspur vide letter no. 126 dated 06/02/2014 have already submitted by the industry vide note dated 06/04/2026. 3. The HMP has installed dust collector/settling chamber followed by wet scrubber as APCD with the rotary drum type HMP. RO has recommended that Consent to operate under Water (Prevention & Control of Pollution) Act, 1974 & Air (Prevention & Control of Pollution) Act, 1981 may be granted to the HMP for the operation of Hot Mix @ 500 MTD from Bitumen @ 18 MTD & Crusher @ 12000 MTD upto 30/09/2030 under Orange Category with the suitable conditions and with the special condition as under:- 1. The HMP shall inform in writing about the operation of the unit and get its emission samples analyzed from the Board’s Lab. 2. The HMP shall obtain statutory clearances from the other departments applicable. 3. The HMP shall install energy meter for APCD and will maintain record of the same. 4. The HMP shall obtain authorization under Hazardous Waste Management Rules, 2016. In view of the above, it is recommended that the consent to operate under the Water (Prevention & Control of Pollution) Act 1974 and Air (Prevention & Control of Pollution) Act, 1981 may be issued up to 30/09/2030 with usual conditions along with special conditions as under:- 1. The HMP shall inform in writing about the operation of the unit and get its emission samples analyzed from the Board’s Lab. 2. The HMP shall obtain statutory clearances from the other departments applicable. 3. The HMP shall install energy meter for APCD and will maintain record of the same. 4. The HMP shall obtain authorization under Hazardous Waste Management Rules, 2016. Competency lies with the Senior Environmental Engineer.
