File Note:  Application applied for obtaining consent to establish/NOC for establishment of a Residential Colony under the name & style of 'Amoha Roots' at ring road-2, Patti Jhutti, opp. Amoha leaf colony, Bathinda in an area of 21.80 acres for constructing 360 number residential plots, 40 number EWS plots, 1 number Community Center and 5 no. of Booths through OCMMS on 11.04.2026……………….  The PP has submitted copy of the approved layout plan for development of residential colony in an area of 21.80 acres by MTP, Municipal Corporation, Bathinda …….  As per the approved layout plan, total built-up area considering FAR 2.1 is less than 1,50,000 sq.m.………..  MoEF, Northern Regional Office, Chandigarh vide its letter no. 205 dated 15/4/2019 has clarified that the projects with a land area of less than 50 ha but a built-up area of more than 20,000 Sqm may be appraised as per provisions of Schedule 8(a) of the ElA Notification, 2006 as amended from time to time, however the Board is of the view that:- 1. For totally plotted projects, the threshold limit for the built-up area (FAR basis) is 150000 Sqm as per clause 8(b)……... 2. In case, there is plotted project and if the built up area of individual plot in the project is less than 20,000 sqm and the total built-up area of that project is also less than 1,50,000 Sqm then, the project is not covered under EIA notification dated 14/9/2006. But, if the individual plot area is more than 20,000 Sqm in that plotted project, then the project proponent is bound to obtain environmental clearance under ElA notification dated 14/9/2006…………... The Board vide its letter no. PPCB/HO/No. 10949 dated 09.05.2023 (copy attached) has requested to the MoEF&CC, Integrated Regional Office, Chandigarh to clarify the letter no. 205 dated 15/4/2019 w.r.t EIA notification dated 14/9/2006 and point no. 2 of the Board view explained above. Till then, the Board may continue to deal the consent cases as per ElA notification dated 14/9/2006 and the Board view explained at point no. 2 above………...  The PP has Submitted License to develop the colony in area of 21.80 acres from Municipal Corporation Bathinda vide no. 01/2026 dt. 19.02.2026………..  The PP has submitted feasibility report mentioning generation of domestic effluent @ 652 KLD by considering 15 persons per plot in the residential plots and 100 persons in the community center and has proposed to install STP of capacity 660 KLD based on MBBR technology for treatment of domestic effluent. The disposal of the treated effluent is proposed @ 271.65 KLD for flushing by providing dual plumbing, 85 KLD in Parks & green area along the road side; 10 KLD for road washing and excess effluent @ 285 KLD into MC sewer after treatment in STP for which NOC obtained from Corporation Engineer, MC, Bathinda vide no. 75/08M dated 27.03.2026.……………………  The project proponent has proposed to install aerobic compost pits / vermi compost pits for the bio-degradable solid waste and has proposed to lift dry waste to MC…………….  The site of the project was visited by Er. Bhisam, AEE on 14.04.2026 and it was observed that: - 1. PP has made boundary wall and secured the land of the colony……….. 2. The distance of the proposed site from the various approved existing operational industries / units (for which specific siting guidelines have been issued by the Board for time to time), is more than the required distance as per the siting criteria given as under: Sr. No. Type of Industrial unit Required distance as per siting criteria 1. Further, there is no air pollution industry within the 100 mtrs radius and no MAH within 250 meter radius of the proposed colony.……………. 4. The site is complying with general siting criteria as per policy dated 30.04.2013 and specific sitting guidelines as per the Department of Science, Technology, Environment, Government of Punjab notification no. 3/6/07/STE(4)/2274 dated 25.07.2008. Hence, site of the colony is suitable for establishment of the colony and the proposal submitted by the PP is adequate as per Water Act, 1974 & Air Act, 1981………….. In view of above, if approved, consent to establish/NOC may be granted for one year for establishment of a Residential Colony under the name & style of 'Amoha Roots’ at Ring Road-2, Patti Jhutti, Opp. Amoha Leaf colony, Bathinda in an area of 21.80 acres having 360 number residential plots, 40 number EWS plots, 1 number Community Center and 5 no. of Booths, subject to following special conditions: - 1. The Consent to Establish (NOC) is being granted for development of the Residential Colony in an area of 21.80 acres at Ring Road-2, Patti Jhutti, Opp. Amoha Leaf colony, Bathinda for constructing 360 number residential plots, 40 number EWS plots, 1 number Community Centre and 5 no. of Booths and in case any document submitted by the project proponent is found to be forged / incorrect, the consent to establish granted by the Board shall be deemed cancelled and the Board shall not be responsible for any cost incurred in the matter by the project proponent………... 2. The project proponent shall ensure that the total built-up area (FAR basis) of the colony remains below 1,50,000 sqm and in case, the built-up area of the colony exceeds 1,50,000 sqm or built up area of any individual plot exceeds 20,000 sqm, the project proponent shall be bound to obtain environmental clearance as required under ElA notification dated 14/9/2006 before undertaking any further construction activity……….. 3. The project proponent shall not use fresh water for green belt or plantation within the project premises and shall make adequate arrangements for reuse of treated effluent through dual plumbing for flushing and irrigation of green areas within the premises and only the surplus treated effluent shall be discharged into the Municipal Corporation sewer strictly as per permission granted by MC, Bathinda vide letter no. 75/08M dated 27.03.2026………... 4. The project proponent shall not abstract or utilize groundwater for any purpose without obtaining prior permission/NOC from the Central Ground Water Authority (CGWA), Punjab Water Regulation Authority or any other competent authority, as applicable from time to time………….. 5. The project proponent shall install and commission the Sewage Treatment Plant (STP) of adequate capacity as proposed prior to occupation/commissioning of the colony or any part thereof and shall ensure its proper operation at all times……… 6. The project proponent shall obtain Consent to Operate under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 from the Punjab Pollution Control Board prior to occupation or operation of the colony or any part thereof………….. 7. The project proponent shall provide necessary monitoring arrangements including online monitoring systems, wherever applicable as per directions/guidelines issued by CPCB/PPCB from time to time, for monitoring the performance of the Sewage Treatment Plant and compliance of discharge standards…………. 8. The project proponent shall provide in-house management of the bio-degradable solid waste being a bulk solid waste generator, in compliance to the Solid Waste Management Rules, 2026……………… 9. The Project Proponent shall comply with all applicable provisions of the Solid Waste Management Rules, 2026 and shall fulfill all obligations applicable to a Bulk Waste Generator (BWG), including registration on the prescribed portal, submission of returns, and compliance with directions of Local Body/CPCB/PPCB……….. 10. The project proponent shall ensure strict prohibition on use of single-use plastic and thermocol disposable items such as water bottles, pouches, cups, plates, forks, spoons, straws and decorative materials made of plastic, thermocol or any other non-biodegradable material within the project premises………... 11. This Consent to Establish is issued from the pollution control angle only. The project proponent shall obtain all other statutory clearances and permissions from the other concerned departments, as required under applicable laws………….. Competency : CEE (B) (Total project cost 24.98 Cr).
