File Note: It is submitted that earlier the poultry farm was granted a personal hearing before chief environmental engineer of the board on 02.04.2026, in reference to notice to issue directions u/s 33-A of Water (Prevention & Control of Pollution) Act, 1974 and u/s 31-A of Air (Prevention & Control of Pollution) Act, 1981, wherein following decisions were made: 1. The poultry farm owner shall submit a certificate from Department of Animal Husbandry, Dairy Development & Fisheries, Govt. of Punjab regarding its capacity in terms of birds to be handled along with permission if any accorded by the Department. 2. The poultry farm shall submit a concrete proof regarding its date of commissioning, within 15 days. 3. The poultry farm shall submit an area classification certificate from the District Town Planner, Amritsar along with permissibility confirmation for the establishment & operation of poultry farm in the said area, within 15-days. 4. The poultry farm owner shall submit certificate from the concerned authority (Circle Revenue Office – CRO) with respect to siting criteria as prescribed in the CPCB guidelines issued from time to time, within 15 days. 5. The poultry farm shall comply with the guidelines issued by the Central Pollution Control Board in 2022 and shall submit the compliance report in annotated form, within 15- days. 6. The poultry farm shall apply for obtaining consent to operate of the Board under the Water Act, 1974 and the Air Act, 1981, within 15 days. 7. The Department of Animal Husbandry, Dairy Development & Fisheries Govt. of Punjab shall assist the poultry farm for implementation of guidelines issued by CPCB for poultry farm. 8. Environmental Engineer, Regional Office, Amritsar shall submit the compliance of above decisions along with the point wise compliance of CPCB guidelines in annotated form along with further report / recommendations, immediate after 15 days. The poultry farm has applied for obtaining fresh consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and under the Air (Prevention & Control of Pollution) Act, 1981, for Poultry Farm (Chicks) @ 25000 Number/Year under Green Category [Code 133.0 – Poultry, piggery and hatchery] as per CPCB classification through OCMMS on 03/04/2026. Details of the case are as under: 1. The unit has submitted latest CA certificate showing gross block value of fixed assets of Rs. 124.35 Crores, accordingly, the unit has deposited 32,500/- vide UTR No. 184231615 dated 12/10/2025, as consent fee under Air Act, 1981 (including Rs. 500/- as application form fee), Rs. 32,000/- vide UTR No. 175044578 dated 12/10/2025, Rs. 500/- vide UTR No. 387846806 dated 23/02/2026 as consent fee Water Act, 1974, Rs. 6400/- vide UTR No. 666792517 dated 23/02/2026 as NOC regularization fee. Additionally, the unit has deposited Rs. 320/- vide R. No. 912803499 dated 01/04/2026, Rs. 19,200/- vide R. No. 225240483 dated 16/04/2026 as penalty under Air Act, 1981 and Rs. 18,880/- vide R. No. 31638668 dated 16/04/2026, Rs. 320/- vide R. No. 310730039 dated 01/04/2026 as penalty under Water Act, 1974 to make the consent fee adequate up to 31/12/2030. 2. The unit has submitted land documents showing the ownership proof, partnership deed showing list of partners. 3. The unit has submitted location plan and site plan. 4. The unit has submitted a PSPCL electricity bill indicating operation since 2012, i.e., prior to issuance of CPCB poultry farm siting guidelines (2015). Accordingly, earlier general siting norms are applicable. The unit has also furnished a Patwari report duly signed by naib tehsildar confirming that the site is about 500 meters away from the ‘Lal Lakir’ of Village Jagdev Kalan. 5. Further, the project proponent has undertaken that the unit shall comply with all prescribed siting criteria, environmental norms, and applicable statutory provisions laid down by the concerned authorities. The unit was visited by officer of this office on 09/04/2026 and observed as under: 1. The unit is a poultry farm (Layer and Breeding) engaged in layering operations and was found operational at the time of inspection. 2. The poultry farm is located at a distance of more than 500 metres from the lal lakir village Jagdev Kalan. 3. The unit is located on agricultural land and as per Notification issued by Directorate of Town & Country Planning, Punjab vide no. 5780-5816 dated 24/09/2021, green category industry is permissible in agriculture zone. 4. The unit has installed a total of 06 sheds, out of which 03 are designated for layering, while the remaining sheds are being utilized for breeding purposes. The unit has also installed 18 incubators and 08 hatchers. 5. During the inspection, only 02 layering sheds were found operational, with approximately 15,000 birds present at the site. 6. The unit has provided covered arrangements beneath the sheds for collection of litter and waste. As informed by the representative of the unit, the collected litter is lifted by farmers for use as manure in agricultural fields. 7. The unit has provided exhaust fans for the ventilation of foul smell arising from the process. 8. The unit has provided a concrete burial pit for the disposal of dead birds generated during operations. 9. The unit has constructed a septic tank for treatment of domestic wastewater, and the treated effluent is being utilized for plantation purposes within the premises. Further, it is intimated that the poultry farm has submitted a PSPCL electricity bill confirming the date of commissioning of the unit as 2012, which indicates that the unit was established prior to the issuance of CPCB poultry farm siting guidelines, 2015; therefore, the said guidelines are not applicable to the unit. Accordingly, earlier general siting norms are applicable. The unit has also furnished a Patwari report, duly signed by the Naib Tehsildar, confirming that the site is 500 meters away from the ‘Lal Lakir’ of Village Jagdev Kalan. Further, the unit has submitted an undertaking stating as under: ‘’The unit has submitted an undertaking stating that the proposed poultry farm is suitably located as per siting criteria, i.e., beyond 500 m from residential areas, beyond 100 m from water bodies and National Highways, beyond 50 m from State Highways, and at adequate distance from rural roads, with sheds not located within 10 m of the boundary. Further, it has been undertaken that the project site falls within a permissible zone as per the notified/draft Master Plan, supported by relevant revenue records (Khasra no. details). The land is agricultural in nature and suitable for poultry farming. The unit has also undertaken to comply with all applicable environmental norms and guidelines, and to bear full responsibility in case of any false or incorrect information.’’ The unit falls under Green Category (Small Scale Sector) and competency to decide the case lies with the Environmental Engineer (after concurrence of Chief Environmental Engineer). The unit is complying with environmental guidelines made for poultry farms. In view of the above, may if approved, the consent to operate under the Air (Prevention & Control of Pollution) Act, 1981 and the Water (Prevention & Control of Pollution) Act, 1974 be granted to the unit under Green Category up to 31/12/2030 with usual terms and conditions.
