The report/ recommendation of RO has been examined and it was noted as under:
# The project proponent was earlier granted consent to establish (NOC) from pollution angle under the provisions of the Water Act, 1974 and the Air Act, 1981 dated 13.07.2021 valid upto 12.07.2022, further extended upto 31.03.2024 for development of Residential Plots @ 119 Number EWS Plots @ 30 Number Shop @ 01 Number Community Centre @ 01 Number, subject to certain terms and conditions mentioned therein.
# Now, the project proponent has applied for obtaining consent to establish (NOC) for expansion under the provisions of provisions of Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 for Residential Plots @ 220, EWS Plots @ 30, Shops @ 20 & Community Centre @ 1, alongwith requisite documents
# The project proponent had applied for expansion with addition of Residential Plots (2.995 acres) @ 101 Nmber/Year, Commercial area (0.164 acres) (Shops)@ 19 Nmber/Year) in its existing project and after expansion, the project comprises of Residential Plots @ 220, EWS Plots @ 30, Shops @ 20 & Community Centre @ 1.
# Regarding applicability of EIA notification dated 14.09.2006 to the project and requirement to obtain EC; the RO has commented that the total area is less than 50 hectares, as such, the project is not covered under schedule 8 (b) of the EIA notification dated 2006. Further, as per the layout plan, the permissible built-up area is well below 1,50,000 sqm. As such, the project is exempted from EIA Notification 2006.
# The project proponent has submitted a site plan of the project duly approved by enior Town Planner, Distt. SAS Nagar vide letter no. 158/STP(S)/SS-11/(GR) dated 22.12.2023
# As per the proposal of the project; the total water requirement will be 474 KLD; out of which fresh water demand will be 313 KLD. About 379 KLD sewage will be generated from the project after full occupancy which will be treated in proposed STP of capacity 460 KLD based on MBBR technology (250 KLD existing + 210 KLD proposed with expansion project). Further after treatment through STP, the treated wastewater of 161 KLD will be utilized for flushing purpose, 2 KLD will be utilized in green area 4162.016 sqm and excess will be discharged onto 2.80 (Park-1+GB-i + GB-iii + GBv+ GB-vi) land area reserved under Karnal Technology within project premises.
# The site of the project was visited by officer of RO on 19.02.2026 and during visit, it was observed that
MK Residency:
1. The project proponent has completed the laying of the sewer at site. STP construction is at initial stages i.e. start of civil work.
2. The construction of 2 houses has been initiated at site.
3. No DG set installed at the site.
4. No occupancy of residents has yet been started in the project.
5. The representative of the project proponent informed that it may take around 1 more year to complete the project.
MK Residency Ext. 1
1. No building construction has yet been started at the site and the site is empty plot.
2. As per the site limits shown by the representative during visit there is no air polluting industry within a radius of 100 mtr. from the proposed site of the project and there is no MAH industry within a radius of 250 mtr. from the proposed site of the project. Thus, the site is suitable as per notification dated 25.07.2008 as amended on 30.10.2009.
# The RO has concluded that the project proponent is found complying with the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981; and recommended that the consent to establish granted to the project under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 may be granted for one year.
In consideration of the report/ recommendations of RO; if approved, the competent authority be recommended that the consent to establish expansion under the provision of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 may be granted to the project for one year, subject to general and additional conditions that:
1. This NOC is valid for establishment of Residential Plots @ 220, EWS Plots @ 30, Shops @ 20 & Community Centre @ 1.
2. The project proponent shall ensure to install an STP of capacity of 210 KLD for project M/s MK Residency Extension-I by M/s Mahakali Developers & Resorts Pvt. Ltd., in addition to the already approved STP of 250 KLD for project (M/s MK Residency by M/s Mahakali Developers & Resorts Pvt. Ltd.).
3. The project will dispose the treated wastewater into the disposal area of 1.8952 acres and 0.92 acres, as mentioned in the earlier ‘consent to establish’ (NOC) of MK Residency by M/s Mahakali Developers & Resorts Pvt. Ltd., and MK Residency Extension-I by M/s Mahakali Developers & Resorts Pvt. Ltd., earmarked as green buffer around the drain.
4. The project shall provide a walking path of atleast 1 karam on the banks of the drain on both sides to asses the condition of the drain as well as to prevent unauthorized discharged into the drain.
5. The project proponent shall reuse treated wastewater for flushing purpose by providing dual plumbing system in the project and shall use only treated wastewater for the said purpose. The project proponent shall impose a condition in this regard in all the allotment letters/registries to be done in the project.
6. The project proponent shall not carry out construction activity by its self and shall only sell plots to respective owners.
7. The project proponent shall not carry out any activity which is covered under the ambit of EIA notification dated 2006.
8. The project proponent shall comply with the guidelines issued by PWRDA and shall obtain permission from PWRDA for abstraction of ground water.
9. The project proponent shall not allow any occupancy at its project, without obtaining prior ‘consent to operate’ under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981.
10. The project proponent shall be granted ‘consent to operate’ under the Water (Prevention & Control of Pollution) Act, 1974, only after accessing the arrangements for disposal of treated effluent at that point of time. PPCB shall not be responsible for any loss (including financial) to the project proponent in this regard, howsoever.
11. The project proponent shall provide separate water meter and energy meter for the STP and maintain record of the same on daily basis.
12. The project proponent shall submit the complete drawing and design of the STP and its component at the time of obtaining consent to operate.
13. The promoter shall provide a buffer zone of green belt (dense populated trees with pleasant fragrance) around the sewage treatment plant, so as to reduce the effect of odour problem on the nearby residential area.
14. The project proponent shall place adequate no. of bins outside its premises from where the Municipal Solid Waste shall be got lifted.
15. The project proponent shall properly handle and manage the solid waste as per the provisions of the Municipal Solid Waste Management Rules, 2016 and ensure that the solid waste is segregated into biodegradable and non-biodegradable components. The biodegradable component shall be treated by providing mechanical composter to produce compost, which will be disposed of/reused in an environmentally sound manner and the non-biodegradable solid waste shall also be disposed of in an environmentally sound manner.
16. The project proponent shall also ensure that the hazardous waste and e-waste components of the solid waste shall also be segregated and the same shall be channelized to the authorized facility for such type of waste.
17. The project proponent shall comply with the provisions of the Construction and Demolition Management Rules, 2016.
18. The project proponent shall take adequate steps to the effect that the construction material of any kind that is stored at site shall be fully covered in all respects so that it does not disperse in the air in any form.
19. The project proponent shall ensure that all the construction material and debris shall be carried out in trucks or other vehicles which are fully covered and protected so as to ensure that the construction debris or the construction material does not get disburse into the air or atmosphere in any form. 20. The project proponent shall take all necessary steps to control the dust emissions to be generated from the construction activities of the project.
20. The project proponent shall ensure that the vehicles carrying construction material and construction debris of any kind shall be cleaned before it is permitted to ply on the road after unloading of such material.
21. The project proponent shall provide mask to every worker working on the construction site and involved in loading/ unloading and carrying of construction material and construction debris.
22. The project proponent shall provide all medical help, investigation and treatment of workers involved in construction of building and carrying out construction material and debris related to dust emissions.
23. The project proponent has been approved by the Board from pollution angle and the industry shall obtain the statutory clearances / permissions from all other concerned departments.
24. The adequacy/ efficacy of the pollution control arrangements and disposal arrangements shall be the sole responsibility of the industry and the industry shall be bound to implement/ upgrade its pollution control arrangements as per the discretion of the Board to achieve the prescribed emission/ effluent standards, as amended from time to time.
25. The project proponent shall ensure the compliance of provisions of the Water (Prevention & Control of Pollution) Act, 1974, Air (Prevention & Control of Pollution) Act, 1981, Environment (Protection) Act, 1986 and/or any other environmental law applicable to him and Rules, Circulars & Directions issued by the Board from time to time.
26. The NOC is being issued to the project proponent based upon the documents/ information submitted by it alongwith the online application form. The Board would be at liberty to take penal action against the industry/project proponent and its responsible/ concerned person(s) in case information/document is detected as incorrect/false/misleading at any point of time, without any opportunity of Personal Hearing.
27. In case the project proponent fails to comply with the provisions of the Water (Prevention & Control of Pollution) Act, 1974, Air (Prevention & Control of Pollution) Act, 1981, Environment (Protection) Act, 1986 and/or any other environmental law applicable to the project and Rules, Circulars & Directions issued by the Board from time to time, action as deemed fit shall be taken against the project proponent.
