File Note: The copy of the proceedings of the personal hearing given before the Chairperson of the Board on 10.04.2026 is attached herewith for ready reference. Vide e-office file No. 358047, the Competent Authority has decided that :- 1. A reasonable time period up to 30.06.2026 shall be granted to the industry for completion of the ZLD system or shifting of the unit to other areas. 2. The units that complete the ZLD or shifting process by 30.06.2026 shall not be levied environmental compensation. 3. The units that fail to complete the ZLD plants or other alternative measures to stop their trade effluent discharges into the sewerage system network by 30.06.2026 shall have to pay environmental compensation. 4. But, this compensation shall be payable w.e.f. 1.05.2026 (not from 01.07. 2026) till the date of completion. The imposition date of EC (01.05.2026) is kept different from completion timelines of ZLD or shifting (30.06.2026) to push the industries to complete work by deadline. 5. In the event of no progress or insignificant progress, the Board may take regulatory and coercive action against these units. 6. Rest of the proposal given by SLO and mentioned in the note # 7 of EE ZO Ludhiana are accepted as follows: a) The adoption of ZLD system will be considered to be complete when the ZLD system is commissioned and put into operation by the industry. b) A Reasonable period of time will be granted to the industry towards stabilization of the system. c) In case, the ZLD system and or shifting of the unit is not completed by the industry by 30.06.2026 then Environmental Compensation of reasonable amount on best assessment judgment shall be imposed upon the industry with effect from 01.05.2026, considering the quantity of discharge of effluent as under: S No. Quantity of discharge (in KLD) Amount of Environmental Compensation (in Rupees) i 0-50 Rs. 50,000/- ii 51-200 Rs. 1,00,000/- iii 201 to 300 Rs. 2,00,000/- iv 301 to 500 Rs. 3,00,000/- v 501 to 1000 Rs. 5,00,000/- vi 1001 and above Rs. 7,50,000/- d). The industry has to inform in writing to the concerned Regional Office of the Board about the completion of the process of ZLD system and or shifting of the unit. e). In case, the information about the completion of the ZLD system and or shifting of the unit is given by the industry on any day of the ongoing month (for example 4, 7, 12,18 etc.), then proportionate amount of Environmental Compensation shall be imposed upon the industry. f). In case any industry fails to deposit the requisite amount of Environmental Compensation or fails to adopt Zero Liquid Discharge (ZLD) or to shift as directed, appropriate action shall be initiated against the industry in accordance with the law." g) As already decided, Member Secretary will hear the small and medium scale units to review their progress and to confirm their willingness to complete the work of ZLD or shifting of units as per above time lines. The industry has to submit a written undertaking to complete the ZLD or shifting process by 30.06.2026, failing which the appropriate action as deemed fit is to be taken. Large scale units will be heard by the Chairperson of Board In view of decision no. g) above, may if approved, notice to issue directions u/s 33-A of the Water (Prevention & Control of Pollution) Act, 1974 as well as notice for imposition of EC may be issued to the industry with hearing before worthy Chairperson of Board being a large scale unit, please.
