After perusal the report given by the RO, it was observed that Rice sheller was earlier granted CTO of Board without dryer, under both Acts with validity upto 30.9.2025. Thereafter, the unit was visited on 27.5.2025 and observed that the unit has installed dryer without NOC expansion of Board. Accordingly , the industry was issued SCN along with opportunity of hearing RO level and decision taken during hearing was mentioned above in the note.The industry has obtained renewal of CTO under both Acts under auto renewal mode with validity upto 11.7.2035 without obtaining NOC expansion of the Board. The RO has revoked their consents vide 17.11.2025 and recommendation sent to Zonal office. Further, the industry was given numerous opportunity of hearing at Zonal office, but no one appeared in the hearing. Now the RO was asked to revisit the site and send the present status of the site. Mean while the industry has applied for renewal of CTO of the Board without dryer. The industry ahs given undertaking that unit will not operate the dryer. Hence,site is complying with consent conditions granted to it .
If approved, it is recommended that:
1.Directions u/s 33-A of the Water Act, 1974 and u/s 31-A of the Air Act, 1981 may be issued to the rice sheller unit to not operate its dryer under any circumstances without obtaining prior permission/consent to establish from the Board.
2. RO may be allowed to grant consents to operate under the Water Act, 1974 and the Air Act, 1981 to the rice sheller unit for manufacturing of Sorted Raw Rice (without Dryer) @ 1.0 TPH by using Paddy @ 1.5 TPH as raw material .
3. EE RO may be directed to seal the dryer machinery with immediate effect,so as to prevent the operation of dryer.
Competency: EE( RO),but the direction notice will be issued after approval of the competent authority.
