It is intimated that, previously the industry was operated by Shri Shiv Raj Chaurasiya under the name "Shivraj Chaurasiya Processor". The date of commissioning of the industry is 01.07.2017, as per the electricity bill submitted. The industry was operating without obtaining Consent to Establish (CTE) and Consent to Operate (CTO) under the Water (Prevention and Control of Pollution) Act, 1974 and Air (Prevention and Control of Pollution) Act, 1981. The industry had earlier applied for CTO water New under Water and CTO Air new Air Acts vide application nos. 12347651 and 12347569 dated 04.03.2020. Both applications were returned after raising clarification regarding submission of the area classification certificate from the concerned departments.
Subsequently, on 02.09.2024, the industry was inspected by an officer of this office after receiving a complaint. During inspection, it was observed that the industry was engaged in cloth washing activity and was discharging untreated effluent from the washing process directly into the sewer without any treatment facility. As per the classification of industries, the said activity falls under the orange category.
Accordingly, directions u/s 33-A of Water Act, 1974 was issued to disconnect the electric connection of the unit vide Boards letter no. 5750-51 Dated: 25.09.2024. In compliance of the above said directions, electric connection of the unit was disconnected by the PSPCL authorities vide TDCO no. 77/274 Dated: 08.10.2024.
Further, the industry has submitted a request letter stating that the industry has removed entire washing machinery from the premises and it shall carry out only garment stitching work at site. To verify the request, the site was visited by the officer of this office on 02.09.2024 & it was observed that, no washing was installed inside the premises and only garment manufacturing process was going on.
Considering the request of the industry, directions u/s 33-A of Water (Prevention and Control of Pollution) Act, 1974 was issued to PSPCL authority vide PPCB/SEE/AO-2/LDH/2024/5748-51 dated 25.09.2024 to restore the electric connection of the industry permanently.
Thereafter, the premises have been rented out to Shri Om Prakash by Shri Shiv Raj Chaurasiya as per the rent agreement dated 13.05.2025. The industry will be operated by Shri Om Prakash under the name "M/s Shree Khatu Shyam Enterprises". Thereafter, Sh. Om Prakash, Proprietor has applied for fresh CTO case under the Water (Prevention and Control of Pollution) Act, 1974 and Air (Prevention and Control of Pollution) Act, 1981 under the small scale green category i.e. 178.3 - Garment and apparel manufacturing industry including Doubling / Reeling / TFO-Two for one unit (dry process)-with boiler. Both applications were returned after raising clarification regarding the industry has not deposit the remaining applicable fee under the Water (Prevention and Control of Pollution) Act, 1974 and Air (Prevention and Control of Pollution) Act, 1981.
Now, the industry has again applied for obtaining new "Consent to Operate" under the Water Act, 1974 and Air Act, 1981 for Steam Press of Fabric @ 1500 Nos./Day by using Fabric @ 1500 Nos./Day as raw material under the small scale green category i.e. (178.3 - Garment and apparel manufacturing industry including Doubling / Reeling / TFO-Two for one unit (dry process)-with boiler).
The industry has earlier deposited Rs. 11,200/- vide UTR no. P20022675776120 dated 26.02.2020, Rs. 11,900/- vide UTR no. CNRBN52025070859770876 dated 08.07.2025 & Rs. 4990/- vide online R/No. 205383609 dated 18.03.2026 under Water Act, 1974 and Rs. 10,300/- vide UTR no. P20022675808705 Dated 26.02.2020, Rs. 11,900/- vide UTR no. CNRBN52025070859803937 dated 08.07.2025 & Rs. 5890/- vide online R/No. 892758981 dated 18.03.2026 under Air Act, 1981.
The industry has submitted CA certificate dated 11.06.2025, as per which, the value of gross fixed assets of the industry is Rs. 17.50 Lac.
Accordingly, the deposited fee is adequate upto 31.12.2026 under both acts (after deducting penalty fee under the both acts and NOC fee).
The industry falls in industrial zone as per area classification certificate issued by the Assistant Town Planner, Zone-B, Municipal Corporation, Ludhiana vide letter vide No. 5597/ATP/B/D dated 30.10.2024. The industry has submitted the rent deed between Shri Om Prakash and Shri Shiv Raj Chaurasiya dated 13.05.2025.
The industry has submitted sewer connection receipt issued by Municipal Corporation, Ludhiana vide dated 07.01.2025.
To verify the facts, the site of the industry was visited by the undersigned on 29.04.2026 and it was observed as under:-
1. The industry was found in operation during visit.
2. The industry was engaged in the process of steam press of fabric.
3. The industry has installed 01 no. wood fired baby boiler of capacity 0.5 TPH with stack of adequate height.
4. Domestic effluent @ 0.2 KLD is being discharged into MC sewer.
5. The industry is not using water into its process. Hence, no trade effluent is being generated.
From above, it is evident that the site is suitable for operation of this unit.
Keeping in view of above, it is recommended that the industry may be granted fresh "Consent to Operate" under Water (Prevention and Control of Pollution) Act, 1974 and Air (Prevention and Control of Pollution) Act, 1981 upto 31.12.2026 with suitable conditions as per Policy of the Board.
