In this it is submitted that earlier the direction u/s 33-A of the Water (Prevention & Control of Pollution) Act, 1974 was issued vide no. 1423 dated 10.03.2025 that the industry shall close its wet process/ machinery form where the trade effluent is being generated/ discharged, with immediate effect. In compliance to above 09 cabinet machines of the industry had been sealed on 24.04.2025.
Thereafter, industry was granted ‘Consent to Operate’ under the Water (Prevention & Control of Pollution) Act, 1974 & the Air (Prevention & Control of Pollution) Act, 1981 vide no. CTOW/Varied/LDH3/2025/28520125 dated 16.06.2025 & CTOA/Varied/LDH3/2025/28520131 dated 13.06.2025, which were valid upto 15.09.2025 & 12.09.2025 respectively for dyeing of Acrylic Yarn @ 2340 Kgs/day along with discharge of trade effluent @ 126.7 KLD & domestic effluent @ 2.8 KLD into conveyance system of CETP 50 MLD along with operation of one boiler of capacity 1.5 TPH with cyclone separator as APCD subject to conditions mentioned therein.
At the time of consent granted, the industry had installed 09 cabinet machines (5 X 30 kg, 2 X 90 Kg, 2 X 60 Kg) in its premises. As per GNE calculation estimated discharge of the industry will be 195 KLD. However, during visit on 05.05.2025, it has been observed that the industry uses 01 cabinet machine of 30 kg as sample machine. The industry had submitted share DEMAT certificate issued by Company Secretary and as per this certificate, 129.5 KLD shares were done DEMAT.
Accordingly, direction u/s 33-A of the Water (Prevention & Control of Pollution) Act, 1974 was issued vide no. 3957-58 dated 16.06.2025 that cabinet machines 04 x 30 Kg and 2 x 60 Kg earlier sealed by the Board be de-sealed.
Accordingly, the industry had obtained for varied consents to operate under the Water Act, 1974 vide no. CTOW/Varied/LDH3/2025/29830360 dated 13.10.2025 valid upto 12.01.2026 for Dyeing of Acrylic Yarn @ 2340 Kgs/day by using Acrylic Yarn @ 2340 Kgs/day, Dyes @ 24 Kgs/day & Acetic Acid @ 15 Kgs/day along with disposal of Trade Effluent @ 126.7 KLD & Domestic Effluent @ 2.8 KLD : Into conveyance system of CETP of capacity 50 MLD.
However, consent to operate under the Air Act, 1981 was refused vide no. CTOA/Varied/LDH3/2025/29830362 dated 19.12.2025 due to the reason that the unit had not provided adequate sampling arrangement with the stack, the industry has not provided CCTV cameras towards the chimney, fuel feeding points and fuel storage area. Also, no document for adopted mode of disposal for the fuel ash was provided by the unit and the DG set installed by the unit was without canopy.
Now, the industry has applied for varied ‘Consents to Operate’ under the Water (Prevention & Control of Pollution) Act 1974 and under the Air (Prevention & Control of Pollution) Act, 1981 through OCMMS for same production capacity & discharge i.e. Dyeing of Acrylic Yarn @ 2340 Kgs/day along with discharge of trade effluent @ 187.2 KLD & domestic effluent @ 2.8 KLD into conveyance system of CETP 50 MLD along with operation of one boiler of capacity 1.5 TPH with cyclone separator and wet Scrubber as APCD.
The details of the case are as under:
1) The industry had already deposited consent fee of Rs. 11,000/- vide online receipt No. 638141160 dated 02.11.2023 under Water Act, 1974 and Rs. 11,000/- vide online receipt No. 865674042 dated 02.11.2023 under Air Act, 1981, which was adequate upto 31.03.2030 under Water Act, 1974 after deducting Rs. 550/- as penalty and upto 30.06.2030 under the Air Act, 1981.
Now, the industry has not deposited any fresh fee under this application. Accordingly, the fee under the Water Act, 1974 is still adequate upto 31.03.2030 and the under the Air Act, 1981 is adequate upto 31.03.2030 after deducting penalty fee amounting to Rs. 550/- (25% of one year).
2) The industry has submitted latest CA certificate dated 11.04.2025 mentioning the total value of fixed assets as Rs. 20,36,034/- and plant and machinery as Rs. 13,65,090/-.
3) The industry has submitted classification of area certificate issued by DTP, Ludhiana vide memo no. 1622 DTP(L)/M2A dated 13.05.2011. As per this certificate, the industry falls in 'Industrial Zone' as per Master Plan, Ludhiana (2007-21).
4) The industry has submitted DEMAT certificate dated 13.08.2025, as per which, the industry holds 1,90,000 shares of M/s Punjab Dyers Association (50 MLD CETP).
5) The industry has also submitted share certificate issued by M/s Punjab Dyers Association (50 MLD CETP) dated 15.11.2022, as per which, the industry has been allowed to discharge effluent equivalent to 190 KL/ Per day into the СЕТР.
6) The industry has submitted completion of wet scrubber issued by M/s Ramesh Engineers, Tajpur Road, Bhamian Khurd, Ludhiana, as per which the industry has got wet scrubber installed with boiler of capacity 1.5 TPH.
The site of the industry was visited by the undersigned on 29.04.2026 and it was observed as under:
1. The industry was in operation and engaged in process of dyeing of acrylic yarn.
2. The industry has installed 09 cabinet machines (5 X 30 kg, 2 X 90 Kg, 2 X 60 Kg) in its premises. Out of which 1 x 30 Kg & 2 x 90 Kg was found sealed during visit.
3. The industry has submitted share DEMAT certificate dated 25.07.2025 issued by Company Secretary and as per this certificate, 190 KLD shares have been done DEMAT.
4. The industry has also submitted permission obtained by it from PDA regarding discharging 190 KLD effluent into its sewer line.
5. The industry has installed boiler of capacity 1.5 TPH based on agro waste. The industry has installed cyclone separator followed by bottle wet scrubber as APCD with boiler along with stack of adequate height with sampling arrangements.
6. The industry has also installed one DG set of capacity @ 45 KVA, which is equipped with canopy and stack of adequate height.
7. The industry is connected with the conveyance system of CETP 50 MLD, Tajpur Road, Ludhiana for discharge its effluent. The industry has provided flow meter at its final outlet leading to CETP and is connected with SCADA system.
8. The industry has installed 01 submersible and has installed EMF with the same.
It is pertinent to mention here that as per legal opinion of the Senior Law officer the consent application of the industry can be processed inspite of the standing directions to the CETP (copy enclosed). The above said legal opinion has been approved by the Competent Authority of the Board.
In the view above, it is recommended as under:
1) Varied ‘Consents to Operate’ under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 may be granted to the industry upto 30.09.2026 for dyeing of Acrylic Yarn @ 2340 Kgs/day along with discharge of trade effluent @ 126.7 KLD & domestic effluent @ 2.8 KLD into conveyance system of CETP 50 MLD along with operation of the boiler of capacity 1.5 TPH with cyclone separator and wet scrubber as APCD, subject to the decision of the Hon'ble National Green Tribunal in the appeal case 40 of 2024 filed by the CETP of 50 MLD subject to suitable conditions alongwith special conditions that:
a) The industry shall not discharge more than 190 KLD i.e. DEMAT shares in any case and shall use 7th machine as sample machine only.
b) The industry will obtain the permission for the use/abstraction of ground water as per the requirements of Central Ground Water Authority (CGWA). In absence of obtaining of permission, the operation of the industry is entirely at its risk and cost and the Board will not be responsible for any loss, in case the CGWA will prohibit the abstraction/use of water on account of non-obtaining of such permission.
c) The industry shall comply with the manufacture, storage and import of Hazardous Chemical Rules, 1989 (as amended) and submit the details on onside emergency plan, safety reports and safety audit reports in accordance with the manufacture, storage and import of hazardous chemical rules, 1989, in case the industry or installation handling hazardous chemicals quantity equal to or more than the threshold quantity specified in the said rules.
d) The industry shall provide adequate arrangement for fire-fighting and against any accidental leakage/discharge of any air pollutant/gas/ liquids from the vessels, mechanical equipment's etc, which are likely to cause environmental pollution. The industry to obtain necessary permissions from the concerned authorities like Municipal Corporation, Ludhiana and Deptt. of Labour/Director of Factories, Punjab with respect to the above safety measures.
e) The industry shall comply with the directions for which notice has been issued by the Board vide letter no. PPCB/2018/445 dated 08-06-2018 for waste water minimization in fixed time schedule that is to be allowed by the Board including replacement of high liquor machines with low liquor ratio machines.
f) The industry shall adopt a complete waste water minimization mechanism that includes the re-circulation of cooling water, recovery and re-use of steam condensate, non-installation of winch dyeing/drum dyeing machines, use of low liquor ratio dyeing machines, adoption of minimum baths for dyeing, re-use of treated trade effluent wherever possible and any other measure which may result in the water conservation and waste water minimization.
g) The industry shall comply with the directions for which notice has been issued by the Board vide letter no. PPCB/CEE/HO/PS/2018/440 dated 07-06-2018 regarding not to use of inorganic colours, dyes and pigments for dyeing, printing and allied processes in the textile industry.
