1....CEE, Jalandhar is neither the competent authority for grant of Consent to Establish/ Operate to a brick kiln nor for waiving the Environmental Compensation imposed, if any. Such matters are to be decided as per delegation of powers notified by the Board.
2..The BKO has applied for a new NOC/CTE for a brick kiln proposed to be established in August 2026. However, the present application and RO report do not reflect critical details such as previous noting, compliance with siting guidelines, status of previous consents, outstanding fee/arrears, or linkage with any old/existing brick kiln. Thus, the RO report is deficient in material facts required to establish the case history and decide the matter on merits.
3....The Consent to Establish/Operate for brick kilns is to be decided at the appropriate level as per delegation of powers of the Board. In the present case, the Regional Office is the competent authority to decide the CTE application and has to take decisions as per the rule/ regulation of the Board.
4... For waiver/remission of Environmental Compensation, if imposed earlier, the BKO may approach the appropriate competent authority through a separate representation. Seeking waiver of Environmental Compensation as the CTE/CTO application is not the correct platform and cannot be entertained in the present proceedings.
5.....Accordingly, the Regional Office shall take suitable decision w.r.t decide the CTE application after duly examining and considering all the aspects mentioned above. If some financial due like EC, previous consent fee etc are due, then same are to be settled first.
6.....After in principal approval by RO and settling financial dues, then he may place the matter for restoration of directions. |
