It is submitted that the subject cited industry is a small scale green category broiler type poultry farm and was granted ‘consent to establish'/ (NOC) under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 vide no. CTE/Fresh/LDH2/2024/25906029 dated 26/06/2024 valid upto 25/06/2025 for production of Eggs @ 8000 No./day.
Now, the has applied for obtaining fresh consent to operate under the Water Act, 1974 & Air Act, 1981 with requisite documents through OCMMS. The industry has deposited consent fee under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 against the un-depreciated fixed assets of Rs. 179.32 Lacs as on 31.01.2026 as per CA certificate dated 31.01.2026, which is adequate upto 31/03/2031 under both acts, as per Board's Office Order dated 29/10/2018 after deducting penalty charges 50 % and NOC regularization fee.
It has taken the land the land measuring 23 Kanal 19 Marlas bearing ¼ share of total land measuring 95 Kanal 16 Marlas, Khewat No. 166, Khatoni No. 180,181, Mustil No. 99//21, 10//16/1, 16/2, 17/1, 17/2, 18, 19/1, 22/3, 23,24,25, 12//3,4,5,6/1, 7/1, 8/1, 13// 1, 10/1, 9// 20/2 vide jamabandi year 2018-19 situated at village Kakrala Khurd Tehsil Samrala Distt. Ludhiana on lease from Sh. Jatinder Singh, Bhuprinder Singh Sons of S. Paramjit Singh # 1465, Sector 40-B, Chandigarh @ 1,20,000/- P.A. for the period 07.03.2024 to 06.03.2034 vide Registered lease deed No. 2023-24/108/1/2209 dated 12.03.2024 by Sub Registrar/Joint Sub Registrar, SRO-Samrala.
As per CPCB Environmental guidelines for poultry farms dated August, 2021, Siting Criteria for New Poultry Farms (Set up after issuance of Guidelines) should preferably be established as under:
• 500 m from residential zone in order to avoid nuisance caused due to odour & flies.
• 100 m from major water course like River, Lakes, canals and drinking water source like wells, summer storage tanks, in order to avoid contamination due to leakages/spillages, if any.
• 100 m from national Highway (NH) and 50 m from State Highway (SH) in order to avoid nuisance caused due to odour & flies.
• 10-15 m from rural roads/internal roads/village pagdandis.
• The Poultry sheds should not be located within 10 m from farm boundary for cross ventilation and odour dispersion.
With reference to the subject cited matter, the siting criteria for New Poultry Farms is as under:
1. The poultry farm should not be located within 500 m from residential zone
2. 200 m from major water course like River, Lake and Canals
3. 500 m from any major drinking water reservoir on catchment side.
4. 100 m from any drinking water source like wells, summer storage tanks, other tanks
5. 500 m from nearby poultry, dairy or another livestock enterprises or Industry
6. 150-200 m from National Highway (NH)
7. 100 m from State Highway (SH)
8. 10-15 m from rural roads/Internal roads/village pagdandis
9. The poultry sheds should not be located within 10 m from farm boundary
• The poultry sheds should be positioned on East to West direction
• at least 2 m above the water table
• at least 0.5 m above ground level
The report from SDM, Samrala was requested vide this office letter No. 751 dated 15.04.2024 to mention the clear-cut distances from the major water course like river, Lake and canals and drinking water source like wells, summer storage tanks and Distance from rural roads/internals roads/village Pagdanis from the poultry farm.
As per Central Pollution Control Board Environmental Guidelines for Poultry Farms (August,2021) conveyed vide letter no. CPCB/IPC-V/NGT/Poultry/2022/10270 dated 10.01.2022, the poultry farm meeting the sitting guidelines as under:
(i) Distance from residential Zone: Required: 500 meters
As per Revenue Report: 1.5 KM
(ii) Distance from major water course like River, Lake and Canals and drinking water source like wells, summer storage tanks. Required: 100 meters
As per Revenue Report: 106 meters
(iii) Distance from National Highway Required: 100 meters
As per Revenue Report: 4 KM
(iv) Distance from state Highway Required: 50 meters
As per Revenue Report: 1.5 to 2 KM
(v) Distance from rural Roads/internal Roads/village pagdandis Required: 10-15 meters
As per Revenue Report: Appox. 150 Meters (Barma to Kakrala Road)
The report received from SDM, Samrala vide his office letter No. 1520/FK dated 11.06.2024 was still incomplete, hence he was again requested vide this office letter No. 1382 dated 18.06.2024 to mention the clear-cut distances. Further, report of SDM, Samrala received vide his office letter No. 1689/FK dated 21.06.2024. As per report, the poultry farm is to be established in Khasra Nos. 10//18-17/1-17/2, 23,24.
1. Distance from major water course like river, lake and canals and drinking water source like well, summer storage tanks. ਲਗਭਗ 106 ਮੀਟਰ
2. Distance from rural roads/internals roads/village pagdandis. ਲਗਭਗ 150 ਮੀਟਰ (ਬਰਮਾ ਤੋਂ ਕਕਰਾਲਾ ਰੇਡ)
In light of above, the poultry farm is meeting the sitting guidelines prescribed by the Board.
The poultry farm has submitted a letter from DTP, Ludhiana vide no. 1654 dated 03.07.2024, which is reproduced as under:
ਉਪਰੋਕਤ ਵਿਸ਼ੇ ਸਬੰਧੀ ਹਵਾਲੇ ਤਹਿਤ ਪ੍ਰਤੀ ਬੇਨਤੀ ਨਾਲ ਪ੍ਰਾਪਤ ਦਸਤਾਵੇਜਾਂ ਨੂੰ ਇਸ ਦਫਤਰ ਵਿਖੇ ਘੋਖਿਆ ਗਿਆ ਅਤੇ ਸਾਈਟ ਦੀ ਮੌਕਾ ਰਿਪੋਰਟ ਕਰਵਾਈ ਗਈ, ਜਿਸ ਅਨੁਸਾਰ ਸਾਈਟ ਮੌਕੇ ਤੇ ਖਾਲੀ ਹੈ। ਪ੍ਰਵਾਨਤ ਮਾਸਟਰ ਪਲੈਨ ਸਮਰਾਲਾ (2012-31) ਦੀਆਂ ਤਜਵੀਜਾਂ ਅਨੁਸਾਰ ਖੇਤੀਬਾੜੀ ਜੋਨ ਵਿਚ ਪੈਂਦੀ ਹੈ। ਇਸ ਜੋਨ ਵਿਚ ਪੋਲਟਰੀ ਫਾਰਮ ਆਗਿਆ ਯੋਗ ਹੈ। ਆਪ ਦੀ ਸਾਈਟ ਨੂੰ ਪਹੁੰਚ 2 ਕਰਮ (11 ਫੁੱਟ 0 ਇੰਚ) ਲੱਗਦੀ ਹੈ, ਪੰਜਾਬ ਸਰਕਾਰ ਦੀ ਨੇਟੀਫਿਕੇਸ਼ਨ ਅਨੁਸਾਰ ਇੰਡਸਟਰੀ ਲਈ ਘੱਟੋ-ਘੱਟ 4 ਕਰਮ (22 ਫੁੱਟ) ਰੈਵੀਨਿਊ ਰਸਤਾ ਲੋੜੀਂਦਾ ਹੈ।
To verify the compliance, the site of unit was visited by the undersigned on 06/05/2026 and it was observed as under:
1. The poultry farm was open at the time of the visit.
2. The farm is a layer type farm with around 7000 birds.
3. There are four sheds however only two were having birds. The other two would be developed by the Project Proponent to accommodate a total of 12000 birds.
4. Each shed has a cooling pad and 8 exhaust fans for ventilation.
5. The farm has two pits for collection of litter.
6. There was one well properly concreted for burial of dead birds.
7. Feed is stored under a separate shed.
8. It has installed 02 no. D.G. Sets of capacities 25 KVA and 65 KVA with canopies and adequate stack heights.
9. It has provided a septic tank to treat the domestic effluent @ 0.2 KLD and treated domestic effluent is being discharged onto land for plantation.
10. The owner of the unit lifts the waste as manure to the local farmers.
11. The industry has submitted building plan approved under Factories Act, 1948.
Keeping in view of the above, it is recommended that 'Consent to Operate' under Water (Prevention and Control of Pollution) Act, 1974 & Air (Prevention & Control of Pollution) Act, 1981 may be granted upto 31/12/2030 to the poultry farms with usual conditions and with the special conditions that: -
1) This 'Consent to Operate' is granted for establishment of poultry farm in Khasra Nos. 10//18-17/1-17/2, 23,24 in the revenue estate of Village Kakrala Khurd Tehsil Samrala Distt. Ludhiana as per report received from SDM, Samrala vide his office letter No. 1689/FK dated 21.06.2024.
2) The poultry farm shall comply with the guidelines prescribed for poultry farms, issued by the Central Pollution Control Board vide its letter no. CPCB/IPC-V/NGT/Poultry/2022/10270 dated 10.01.2022
3) The permission is granted from pollution angle and shall obtain all clearances from other Departments.
4) The poultry farm shall not increase its bird capacity without obtaining prior NOC for expansion from the Board as well as without providing adequate pollution control measures.
5) The poultry farm will not generate and discharge any trade effluent without obtaining prior written permission of the Board.
6) The poultry farm shall ensure that there is no nuisance / pollution created from the operation of the poultry farm in the vicinity at any time.
7) The poultry farm shall plant trees wherever space is available inside and outside the unit.
8) The poultry farm shall not create any nuisance and shall abide by all laws and regulations framed by the Government.
9) The poultry farm shall comply with all provisions and conditions issued by the District Town Planner.
10) The poultry farm shall comply with the guidelines issued by PWRDA.
11) The poultry farm shall obtain the necessary permissions from other Govt. departments, if any.
12) The poultry farm shall not throw burn or burry any solid wastes in open outside premises or in drain / water bodies.
13) The poultry farm shall promote use of alternatives of single use plastics (SUP) and awareness to discourage use of plastic, through their Corporate Environment Responsibility (CER) activities.
14) The poultry farm shall ensure that there will be no usages of single use plastic- thermocol disposable items such as water bottles / water pouches/water cups, plates, forks, spoons, straw etc. and single use decorating material made of plastic thermocol or any other non-biodegradable material in the premises.
15) The poultry farm shall properly handle and manage the solid wastages as per the provisions of the Municipal Solid Waste Rules 2016 and ensure that the solid waste is segregated & disposed of in an environmentally sound manner.
16) The poultry farm shall strictly comply with the SOPs/ environmental guidelines /code of practice prescribed by the MoEF&CC/CPCB/Govt./Board for poultry farm on regular basis.
