File Note: It is intimated that the project is orange category residential colony and was earlier granted Consent to Establish (NOC) vide no. SEE(ZP-II)/SNG/NOC/2012/Colony/302 dated 12.04.2012 in an area of 5.24 Acres for development of residential colony having residential plots @ 77 Nos and Commercial Shops @ 06 Nos., which was valid upto 11.04.2013. Thereafter, the project proponent has failed to obtained extension in the validity of Consent to Establish or Consent to Operate from the Board. Now, the Project Proponent has applied for obtaining Consents to Operate under the Water Act, 1974 & Air Act, 1981 of the Board from pollution angle for 46 nos. houses and 06 nos. commercial shops for discharge of treated domestic effluent @ 94.98 KLD (6.11 KLD into green area/parks, 46.14 KLD in dual plumbing system and 22.73 KLD onto land for plantation in an area according to karnal technology), detail of the case is as under:-……………….. • The Project Proponent has submitted copy of CA certificate, showing the value of fixed asset is Rs. 381.20 Lakhs lacs. Accordingly, the Project Proponent had already deposited Rs. 57600/- vide receipt/UTR no. 922249373 dated 27.07.2025 under the Air Act, 1981 and Rs 60000/- vide receipt/UTR no. 619633794 dated 06.07.2025, which is adequate upto 30.09.2027……………………………… • The project proponent has approved drawing of the residential colony from the M.C, Barnala. The project proponent has also submitted the gazette notification 9802 dated. 04/02/2007 that the said site is under T.P scheme under the M.C Barnala. The detail of the plan proposed by the project proponent for the residential scheme as per the drawing is as under :- • Total area under residential plot : 12487.46 Sq. yard. • Total area under commercial plots 446.32 Sq. yard. • Area reserved for the EWS Housing 1312.11 Sq.yard. • Area under Sewerage Treatment plant 83 Sq. yard. • Area under roads, parks, parking, water works pavement and open spaces etc =11050.86 Sq.yard. • Total Scheme area is 5.24 acres…………………… • The project proponent has submitted a copy of letter no. 1147/B dated 25.07.2025 issued by Executive Officer, Municipal Council, Barnala regarding detail of built-up area of the project. As per which the total built-up area of the project is 22238.862 Sq. yard (residential area = 21569.382 sq. yard +commercial area 669.48 Sq. Yard) or (18594.52 sq. mtr.) which is below 1,50,000 sq meter, hence project does not cover in the EIA notification. • The project proponent has submitted a copy of registry of land measuring 5.24 Acres to the name of M/s JMD Associates, with the application. …………………… • The project proponent has submitted a request letter with the application in which he states that the STP of capacity @ 125 KLD has been installed for treatment of domestic effluent generated from the project. • The project proponent has submitted a copy of completion certificate of STP from Laj Engineering Corporation. The site of the project proponent was visited by the AEE of this office on 05.04.2026 and it was observed that: …………………… • The residential colony located on Handiaya road, Barnala. • The PP has developed roads / parks in the premises. There is 06 house which are occupied. • The project proponent has installed STP of capacity @ 125 kLD for the treatment of domestic effluent generated from the colony. • The colony has made provision to discharge the treated effluent onto land for plantation within the premises into green area and buffer zone. • The colony has developed buffer zone/green belt towards the industry i.e. M/s Standard Corporation India Limited, Barnala. • The treated effluent samples was collected on 04.06.2025 from the outlet of STP and as per analysis reports the results of the all parameters are within the permissible limits prescribed by the Board. • The PP has to construct compost pits for management of wet waste to be generated from the premises. …………………… • The total built up area comes out to be 18594.52 sq. mtr. As the total area is less than 50 hectare and built-up area is less than 1,50,000 sq meter, hence project does not cover in the EIA notification. …………….. From the above, it is clear that the project is complying with the provisions of Water Act, 1974 and Air Act, 1981. Keeping in view of above, it is recommended that partial Consent to Operate under the Water Act, 1974 and under the Air Act, 1981 may be granted to the Project Proponent for residential project for Residential Plots @ 46 nos. and commercial shops @ 06 nos. for discharge of treated domestic effluent @ 94.98 KLD upto 30.09.2027 with suitable conditions along with specific conditions as under: …………………… 1. The project proponent shall be bound to obtain environmental clearance under EIA notification dated 14.09.2006. …………………… 2. The project proponent shall utilize effluent inside its premises after treatment in STP. …………………… 3. The Project Proponent shall obtain other statutory approvals required from other departments, if any. …………………… 4. The project proponent will handle its solid waste as per the provisions of the Solid Waste Management Rules, 2016 and make adequate arrangements/compost pits for treatment of wet waste and source of generation. …………………… Total Project Cost- 381.20 lacs.
