File Note: It is submitted that previously, the project proponent had obtained Consent to Establish (CTE) under the provisions of Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 for establishment of commercial plots @ 40 Nos under Green category, having validity 22.05.2026. Now, the project proponent has submitted application for obtaining Consent to operate under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 for establishment of commercial plots @ 40 Nos under Green category along with requisite documents. Fee: Further, the total cost of proposed project will be Rs. 1493.1118 lakhs as per the CA certificate submitted by the PP. Accordingly, the project proponent has deposited fee amounting to Rs. 72,500/- vide online R. No. 562213512 dated 24.04.2026 as water consent fee and Rs. 72,000/- vide online R. No. 132054935 dated 24.04.2026 as air consent fee. As such, the fee deposited by the PP is adequate for 05 years under green category as per the Board's office order dated 29.10.2018. Effluent and Disposal Details The total domestic water consumption of the project is 36 KLD, with generation of waste water @ 29 KLD. The generated waste water will be treated through Sewage Treatment Plant, out of which 22 KLD will be reuse in flushing and remaining 7 KLD will be discharged in the sewer line. The project proponent has obtained the permission for m.c. sewer discharge vide letter no:335 dated 28.04.2025. PWRDA The project has mentioned ground water extraction @ 36 KLD, considering 25 working days in a month, the ground water extraction becomes 900 KL/month. However, the industry has not submitted the permission for abstraction from PWRDA. Further, it is pertinent to mention that, no bank guarantee has been imposed and no show cause notice has been issued to the project proponent for any violation under the provisions of Water Act, 1974 and Air Act, 1981. Visit: To verify the contents of the application, the site was visited by undersigned on 05.05.2026 and Mr. Roshan Singh, project Manager was contacted for the visit. During visit, it was observed as under: 1. The Project Proponent has constructed and installed the Sewage Treatment Plant (STP); however, the same has not been commissioned yet. 2. The shopping outlet namely “Zudio” has already been constructed and is operational. 3. Two additional commercial units, namely “Gopal Sweets” and “Subway”, are presently under construction. 4. The project proponent has not started the plantation. 5. Howvere, the representative of the project inofmred that the plantation will be made along side the boundary wall of the project. As such, the industry is complying with the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981. It is pertinent to mention here that, online agenda could not be generated due to technical glitch. Recommendations: In view of the facts mentioned above, if approved, it is recommended that the Consent to Operate under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 for establishment of commercial plots @ 40 Nos, may be granted to the project proponent for 05 years under Green category up to 31.03.2031 with suitable conditions and following special conditions: 1. The promoter company shall ensure that the total built up area of all individual projects/plots combined together is not more than 1,50,000 sqm, otherwise the project as such is covered under category 8(b) of the schedule appended to the EIA notification and project proponent of the area development project is required to obtain the environmental clearance, failure which, the promoter company shall be liable for action for the violation of EIA notification dated 14/09/2006. 2. The project proponent shall develop its project strictly in accordance with the layout/ building plan approved by the competent authority and shall also comply with the conditions imposed in the approval of layout plan letter. In case, there is variation in built-up area/green area/ any other details in layout plan approved by the Competent Authority (if at any stage), then the project proponent shall obtain fresh Consent to Establish from the Board. 3. If it is proven at any stage that the project is cover under the ambit of EIA notification 2006, then this CTE granted from the pollution angle shall be deemed cancelled and Board shall not be responsible for any financial liability arising due to cancellation of this CTE. Further, the promoter company shall be liable for action for the violation of EIA notification dated 14/09/2006. 4. The project proponent shall obtain authorization for extraction of groundwater from the concerned authority under the provisions of the Punjab Water Regulation and Development Authority (PWRDA). 5. The project proponent shall ensure efficient operation and maintenance of the Sewage Treatment Plant (STP), and the treated wastewater shall be utilized/discharged into the plantation area developed by the project proponent through an underground pipeline network. 6. There shall be no discharge of untreated or treated wastewater through any unauthorized means or outside the designated disposal/utilization system. 7. The project proponent shall comply with the provisions of the Construction and Demolition Management Rules, 2016. 8. The project proponent shall take adequate steps to the effect that the construction material of any kind that is stored at site shall be fully covered in all respects so that it does not disburse in the air in any form. 9. The project proponent shall ensure that all the construction material and debris shall be carried out in trucks or other vehicles which are fully covered and protected so as to ensure that the construction debris or the construction material does not get disburse into the air or atmosphere in any form. 10. The project proponent shall take all necessary steps to control the dust emissions to be generated from the construction activities of the project. 11. The PP shall ensure that there are no usages of single use plastic- thermocol disposable items such as water bottles / water pouches/water cups, plates, forks, spoons, straw etc. and single use decorating material made of plastic-thermocol or any other non-biodegradable material in the premises. 12. The PP shall properly handle and manage the solid wastages as per the provisions of the Municipal Solid Waste Rules 2016 and ensure that the solid waste is segregated & disposed of in an environmentally sound manner. 13. This NOC is being granted on the basis of the documents/ submissions made by the project proponent and in any case, such documents/ submissions found to be false or incorrect, this NOC shall be cancelled without any prior notice and the project proponent shall be liable for any loss due to such cancellation.
