The reply of query raised by CEE submitted by RO the industry was established in year 2012. The industry has not obtained CLU from the concerned Authority. The industry is located in the revenue estate of Village-Kiri Afgana, Block-Qadian, Tehsil-Batala, District-Gurdaspur and the Master Plan of the Qadian has not yet formed. The Board has framed policy for issuance of NOC to the industries wherein, it has mentioned that:- ”The Punjab Pollution Control Board will decide the applications for consent to establish (NOC) of all industries to be set up in designated/ approved areas such as Industrial Area/ Industrial Estate/ Industrial Focal Point/ approved Industrial Park/ Industrial Zone of the Master Plan. However, the site clearance u/s 41 (A) of the Factories Act, 1948 will not be necessary for grant of consent to establish/ operate/ authorization by the Board. For industries to be set up in areas other than the area such as designated / approved areas such as Industrial Area / Industrial Estate/ Industrial Focal Point / approved Industrial Park / Industrial Zone of the Master Plan, site clearance u/s 41 of the Factories Act, 1948 will be necessary before grant of consent to establish/ authorization by the Board.” In this regard, the industry has obtained Site Clearance from Environmental Angle under site clearance u/s 41 of the Factories Act, 1948 from the State Competent Authority vide endst. No. 1109-15 dated 06/11/2012. It is further, intimated that the industry was established after obtaining Consent to Establish from the Board under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 vide letter no. 1144-45 dated 21/02/2012 and while obtaining said CTE (NOC) the industry submitted report from Nagar Council, Qadian issued vide letter no. 1184 dated 29/04/2010 wherein it has mentioned that the site of the industry falls outside from the Nagar Council, Qadian. The industry has also submitted report issued from Naib-Tehsildar, Qadian dated 27/01/2006 wherein, it has mentioned that the site is situated outside 500 meters from the Lal Lakir of Village-Kiri Afgana.
In view of the above, it is recommended that the renewal of the consent to operate under Water (Prevention & control of Pollution) Act, 1974 may be granted to the industry for a period upto 31/03/2031 for the production of Salable Beer @ 360 KLPD by using Barley Malt @ 106 MTD, Rice Flakes @ 24 MTD, Sugar @ 13 MTD, Hops @ 0.42 MTD as raw material with the usual terms and conditions along with special conditions as under:- 1. The industry shall analyse its trade effluent samples from the Board’s Lab/Authorised Lab as per protocol framed by the Board. 2. The industry shall ensure that no water pollution problem is created in the area due to discharge of effluent from the industrial premises.
