File Note: Sub:- Application for obtaining Fresh of Consent to Operate under Water (Prevention & Control of Pollution) Act, 1974 & Air (Prevention & Control of Pollution) Act, 1981- M/s Goraya agro foods, Rudiana Road, VPO-Kalanaur, District Gurdaspur It is intimated that earlier the consent to establish (NOC) from pollution angle under the provisions of Water (Prevention & control of Pollution) Act, 1974 & Air (Prevention& control of Pollution) Act, 1981 granted vide online reference no. CTE/Fresh/GRP/2025/29832275 dated 17/09/2025 to the industry, which is valid upto 16/09/2026 for the production of Raw Rice @ 3 TPH & Rice Husk @ 0.15 TPH by using Paddy @ 3.5 TPH under Orange Category. Now, the industry has applied for obtaining fresh consent to operate under Air (Prevention & Control of Pollution) Act, 1981 & Water (Prevention & Control of Pollution) Act, 1974 for the production of Raw Rice @ 3 TPH & Rice Husk @ 0.15 TPH by using Paddy @ 3.5 TPH under orange category along with requisite documents. The industry has deposited Rs. 54000/- vide UTR No. 186971366 dated 14/05/2026 & Rs. 54500/- vide UTR No. 897227022 dated 14/05/2026 (as consents fee under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 including Rs. 500 as application fee against the total gross value of its fixed assets of Rs. 2,74,30,822.00 as on 06/02/2026 as per value of C.A. certificate submitted by the industry). The consents fee of the same are adequate upto 30/09/2030 under both Acts. The industry has submitted detail of the machinery installed by it i.e. Furnace/Bathi 01 no., Paddy Dryers 02 nos., De-Husker 02 nos., Rice Polisher 04 nos., Sortex machie 01 no., Rice Sifter 01 no., Blending Machine 01 no., Paddy separator 01 no., Silky Polisher 01 no. & Paddy Pre-Cleaner 03 nos. The industry has already submitted report issued by Tehsildar, Kalanaur vide dated 12/08/2025, which may kindly be perused and operative part is reproduced as under :- a) ਪਿੰਡ ਦੀ ਲਾਲ ਲਕੀਰ, ਫਿਰਨੀ, ਵਾਈਲਫ ਲਾਇਫ ਸੈਚਰੀ, ਚਿੜਿਆ ਘਰ, ਰਿਹਾਇਸ਼ੀ ਖੇਤਰ (15 ਪੱਕੇ ਮਕਾਨ), ਵਿਦਿੱਅਕ ਅਦਾਰਾ, ਇਤਹਾਸਿਕ ਧਾਰਮਿਕ ਸਥਾਨ ਅਤੇ ਸੁਰੱਖਿਅਤ ਸਮਾਰਕ ਤੋ 500 ਮੀਟਰ ਤੋ ਜਿਆਦਾ ਹੈ। 3. The industry has submitted report issued by the District Town Planner, Gurdaspur vide his office letter no. 444 dated 24/04/2025, which may kindly be perused and operative part is reproduced as under:- ਸਾਈਟ ਪਿੰਡ ਸਹੇਲ ਚੱਕ ਨੂੰ ਜਾਂਦੀ ਸੜਕ ਤੋ ਤਕਰੀਬਨ 1.90 ਕਿਲੋਮੀਟਰ ਦੀ ਦੂਰੀ ਤੇ ਖੱਬੇ ਪਾਸੇ ਪਿੰਡ ਨਾਹਰਪੁਰ ਨੂੰ ਲਿੰਕ ਕਰਦੇ 22 ਫੁੱਟ ਚੌੜੇ ਰੈਵਿਨਿਊ ਰਸਤੇ ਤੇ ਤਕਰੀਬਨ 96 ਮੀਟਰ ਦੀ ਦੂਰੀ ਤੇ ਖੱਬੇ ਪਾਸੇ ਪਿੰਡ ਕਲਾਨੌਰ (ਹਦਸਬਤ ਨੰ: 103), ਤਹਿਸੀਲ ਕਲਾਨੌਰ, ਜ਼ਿਲ੍ਹਾ ਗੁਰਦਾਸਪੁਰ ਦੀ ਰੈਵੀਨਿਊ ਅਸਟੇਟ ਵਿੱਚ ਪੈਦੀ ਹੈ। ਸਾਈਟ ਨੋਟੀਫਾਈਡ ਲੋਕਲ ਪਲੈਨਿੰਗ ਏਰੀਆ, ਕਲਾਨੌਰ ਵਿੱਚ ਪੈਦੀ ਹੈ। ਪੋਰਟਲ ਤੇ ਅੱਪਲੋਡ ਕੀਤੇ ਗਏ ਅਨੁਸਾਰ ਰਾਈਸ ਸ਼ੈਲਰ (Orange Category) ਦੀ ਸਥਾਪਨਾ ਕੀਤੀ ਜਾਣੀ ਹੈ ਜੋ ਕਿ ਡਾਈਰੈਕਟੋਰੇਟ ਆਫ ਟਾਊਨ ਐਂਡ ਕੰਟਰੀ ਪਲੈਨਿੰਗ ਪੰਜਾਬ ਦੀ ਦੇ ਪੱਤਰ ਨੰ: 2180-2283 CTP (PB)/SP-432(Gen) dated 14/06/2023 ਅਨੁਸਾਰ ਆਗਿਆਯੋਗ ਹੈ। ਪੰਜਾਬ ਪ੍ਰਦੂਸ਼ਣ ਕੰਟਰੋਲ ਬੋਰਡ ਦੇ Order No. 10/48/2004-STE(4)/932 ਮਿਤੀ 15.10.2013 ਰਾਹੀ ਰਾਈਸ ਸ਼ੈਲਰ ਦੀ ਸਥਾਪਨਾ ਲਈ ਜਾਰੀ ਹਦਾਇਤਾਂ ਦੇ ਸਨਮੁੱਖ ਨੁੱਕਤਾਵਾਈਜ ਰਿਪੋਰਟ ਹੇਠ ਲਿਖੇ ਅਨੁਸਾਰ ਹੈ। 1) ਉਕਤ ਸਾਈਟ ਕਿਸੇ ਫੋਕਲ ਪੁਆਇੰਟ ਅਤੇ ਕਿਸੇ ਡੈਜੀਗਨੇਟਡ ਇੰਡਸਟਰੀਅਲ ਲੈਂਡ ਯੂਜ ਜੋਨ ਵਿੱਚ ਨਹੀਂ ਪੈਂਦੀ ਹੈ। 2) ਉਕਤ ਸਾਈਟ ਕਿਸੇ ਨੋਟੀਫਾਈ ਲੋਕਲ ਪਲੈਨਿੰਗ ਏਰੀਆ/ਮਾਸਟਰ ਪਲੇਨ ਵਿੱਚ ਨਹੀ ਪੈਂਦੀ ਹੈ। ਕਲਾਨੌਰ ਨਗਰ ਪੰਚਾਇਤ/ਨਗਰ ਕੋਂਸਲ ਨਹੀਂ ਹੈ ਅਤੇ ਸਾਈਟ ਦੇ 500 ਮੀਟਰ ਦੇ ਘੇਰੇ ਵਿੱਚ ਕੋਈ Urbansiable limit ਅਤੇ 2 ਕਿਲੋਮੀਟਰ ਦੇ ਘੇਰੇ ਵਿੱਚ ਕੋਈ ਨਗਰ ਕੌਂਸਲ ਲਿਮਟ ਨਹੀਂ ਪੈਂਦੀ ਹੈ। 3) ਸਾਈਟ ਦੇ 500 ਮੀਟਰ ਦੇ ਘੇਰੇ ਵਿੱਚ ਕੋਈ ਬਾਈ-ਪਾਸ, ਨੈਸ਼ਨਲ ਹਾਈਵੇ, ਸਟੇਟ ਹਾਈਵੇ ਅਤੇ ਸ਼ਡਿਊਲ ਰੋਡ ਨਹੀਂ ਪੈਂਦੀ ਹੈ। 4) ਸਾਈਟ ਦੇ 500 ਮੀਟਰ ਦੇ ਘੇਰੇ ਵਿੱਚ ਕਿਸੇ ਪਿੰਡ ਦੀ ਆਬਾਦੀ ਨਹੀ ਪੈਂਦੀ ਹੈ। 5) ਭਵਿੱਖ ਵਿੱਚ ਕਲਾਨੌਰ ਦੇ ਮਾਸਟਰ ਪਲਾਨ ਬਣਨ ਉਪਰੰਤ ਪ੍ਰਾਰਥੀ ਇਸ ਦੀਆਂ ਬਣੀਆਂ ਤਜਵੀਜਾਂ ਨੂੰ ਮੰਨਣ ਲਈ ਪਾਬੰਧ ਹੋਵੇਗਾ। The project proponent has also submitted copy of certificate issued from Deputy Commissioner, Gurdaspur vide no. 1713/GM/DIC/Batala dated 19/06/2025 regarding In-principle Approvals issued u/s 10(1) and 2 of the Punjab Right to Business Act, 2020 to setup a manufacturing enterprises. Wherein, the industry has obtained exemption for obtaining building plan under Factory Act, 1948 for 03 years. The industry was visited by the AEE of this office on 18/05/2026 and observed as under:- 1. The industry was not in operation during visit. 2. The industry has installed Furnace/Bathi 01 no., Paddy Dryers 02 nos., De-Husker 02 nos., Rice Polisher 04 nos., Silky Polisher 01 no. & Paddy Pre-Cleaner 03 nos., Sortex machie 01 no., in its premises. 3. The industry has provided cyclones as APCDs with its paddy pre-cleaner and shelling section separately. The industry has also provided adequate sample collection facility with its APCDs. 4. The industry has planted fresh saplings around the boundary wall. 5. The industry has provided adequate enclosure around husk storage area. 6. The industry has provided pucca road for movement of vehicles. As the industry comply with the code of practice as per order no. 932 dated 15.10.2013. Keeping in view of above, it is recommended that Consent to operate under Water (Prevention & Control of Pollution) Act, 1974 & Air (Prevention & Control of Pollution) Act, 1981 may be granted to the industry for a period upto 30/09/2030 for the production of Raw Rice @ 3 TPH & Rice Husk @ 0.15 TPH by using Paddy @ 3.5 TPH with suitable conditions along with suitable conditions along with special condition that:- 1. The industry shall get its air emission samples from the Board for upcoming paddy processing season. 2. The industry shall submit approved building plan under Factory Act, 1948 after expiry of validity of In-principle Approvals obtained u/s 10(1) and 2 of the Punjab Right to Business Act, 2020. 3. The consent to operate under the Water Act, 1974 and Air Act, 1981 has been granted to industry for same production capacity and plant and machinery as in previous consent, if there is any change in production capacity or any addition of any new plant and machinery, the industry shall obtain NOC expansion and revised consents accordingly with relevant documents from the Board under the said acts. 4. The consent to operate has been granted based on the documents submitted by the industry, if at any later stage the document submitted is found falls/misleading than the industry may be liable for necessary action as per Board’s policy. 5. The industry will be bound to comply with the zoning regulation of the master plan in force and the grant of consent by the Board will not vest any right on the industry w.r.t. other stipulations by any authority or the zoning regulations of the master plan. 6. The industry will continue to comply with the new code of practice prescribed by Punjab Govt. Department of Science, Technology and Environment vide order no. 932 dated 15.10.2013. 7. The industry shall upgrade or install adequate air pollution control device to achieve the amended emission standard, if any amendment made. 8. The industry shall not make any expansion inside the present premises without obtaining prior permission from the Board.
