File Note: It is submitted that the project proponent was earlier granted Consent to Operate (CTO) under the Water (Prevention & Control of Pollution) Act, 1974 vide no. CTOW/Varied/SAS/2023/20465193 dated 16/02/2023 and the Air (Prevention & Control of Pollution) Act, 1981 vide no. CTOA/Varied/SAS/2023/20465191 dated 09/02/2023 both were expired on 31/03/2024 for Residential Flats @ 732 Numbers named as “Silver City Themes, subject to certain conditions and special conditions mentioned therein. Further, after the handover of existing project to RWA, the RWA has obtained the valid consent to operate from the board vide no. CTOW/Varied/PBIP/SAS/2025/2503237366 under Water (Prevention & Control of Pollution) Act, 1974 and CTOA/Varied/PBIP/SAS/2025/2503922565 under Air (Prevention & Control of Pollution) Act, 1981, both having validity upto 31.03.2026. Earlier, the project proponent was applied for the consent to establish (NOC) expansion under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981, which was returned because the project had not provided any green area under karnal technology for disposal of additional treated wastewater in case of absence of connection of municipal sewer and the already provided area of 4180 sqm of green area and 3822 sqm of Green Area as per Karnal Technology is insufficient for disposal of increased discharge. Now, the project proponent has applied for consent to establish (NOC) under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 for expansion for Residential Flats @ 1030 Numbers, with requisite documents and fees. As per the record, the project proponent had deposited Rs. 113300/- vide Transaction No. S53112151 for UTR No. UTIBN62026021109450022 dated 11/02/2026 including application form fee, against the cost of the project of Rs. 44.04 Cr. (as per application form). The NOC fees deposited by the project proponent is adequate for 03 year (50 percent for subsequent extension years). The project was granted building plan approval and building permit by Executive Officer, Derabassi vide Building Permit no. 1156 dated 12.05.2023. Further, the site is falling in residential zone as per Master Plan of Derabassi. Thus, the site is suitable for expansion. The total green area as per the approved layout plan is 8672 sqmtr, out of which 3822 sqmtr has been developed as per karnal technology. (copy of approved layout plan enclosed). Further, the project proponent has proposed to develop green belt in berm area in an area around 3806 sqmtr. and also developed green area along the boundary walls and open spaces in an area of around 5000 sqmtr. However, even after the addition of proposed green area, the total green area is not adequate to handle the hydraulic load of waste water generated. The project has been granted Environmental Clearance vide no. EC23C3801PB5735784N dated 01.02.2024 for construction of 1030 flats with total built-up area of 1,27,395.86 sqm. For this increase, the freshwater demand and subsequent wastewater arrangement is as under: Sr. No. Description Total 1. Total Water Demand 672 KLD 2. Fresh Water Demand 448 KLD 3. Rainy 224 7 307 The project has proposed 4 x 250 KVA and 6 x 600 DG sets to be installed equipped with canopy and adequate stack height. 2240 Kg/day of solid waste will be generated from the entire project. Biodegradable waste will be composted by use of 1 Mechanical Composter of capacity 1150 Kg/day, non-biodegradable waste (recyclable waste) will be disposed off through authorized recycler vendors and Inert waste will be dumped at authorized dumping site. The project proponent has submitted NOC for disposal of treated waste water in MC Sewer, Derabassi vide letter no. 1282 dated 26.05.2023, (copy enclosed) Accordingly, the proposed site of the project was visited by AEE of this office on 11.03.2026 and it was observed as under: 1. The proposed site of the project is located on Mubarakpur Road in front of Focal Point, Derabassi. 2. The Existing Green buffer towards air polluting industries, parallel to road is in place at site. 3. The Existing project consisting of 732 flats is already complete and fully occupied. Existing wastewater of the project is being treated onto STP which was operational during visit. The project is maintaining the record of operation for the same. 4. The development work of infrastructure is completed in all aspects. 5. As per Layout plan, Towers of Block D are partially constructed. However, the partial construction is not habitable. 6. No construction has been initiated at Block E and Block C (EWS). 7. No upgradation of STP has been initiated at site yet. It is pertinent to mention here that the green area developed by the project proponent is not adequate to handle the hydraulic load of total 1030 flats and further no sewer connection has been granted to the project proponent till date. As such, the proposal of the project proponent is not feasible at this stage. In view of the above, it is recommended that ‘consent to Establish’ for expansion under the provisions of Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 may be refused. *Competency- Worthy Chairperson of the Board, (Total Project Cost above 50 Cr.)
