File Note: It is submitted that the industry was granted consent to establish by PBIP vide no. PBIP/PPCB/2014 /CTE-8 dated 08/07/2014 (valid upto 07.07.2015)to manufacture Parboiled Rice @ 2 TPH & Steamed Rice @ 2 TPH by using Paddy @ 6 TPH as raw material with certain conditions. The industry was visited on 28/08/2015 and 01/12/2015 and found that the industry was violating the provisions of Water Act, 1974 and Air Act, 1981. The industry was issued directions u/s 33-A of Water (Prevention & Control of Pollution) Act, 1974as amended in 1988 and u/s 31-A of Air ((Prevention & Control of Pollution) Act, 1981 vide letter no. 4291 dated 18.02.2015 for violation of the provisions of Water Act, 1974 and Air Act, 1981. Later on, the industry took adequate water & air pollution control measures and applied for consents under the both acts. Accordingly, the industry was granted consent to operate under the Water Act, 1974 vide no. R16SGRCTOW3538090 dated 07/01/2016 & the Air Act, 1981 vide no. R16SGRCTOA3537951 dated 07/01/2016 both valid upto 30/06/2016 with temporary restoration of power supply for six months. Now, the industry has applied for renewal / extension of consent to operate Water Act, 1974 & Air Act, 1981 online along with request to restore the power supply permanently. The industry has deposited Rs. 900/- vide R. No. 88/4306 dated 29/06/2016 as NOC fee corresponding to increase in fixed assets less than Rs. 5.0 lacs. The industry has deposited Rs. 90,000/- each in addition to Rs. 90,000/- each already deposited as water & air consent fee, which is now adequate upto 06/07/2021. The industry has submitted the compliance report of previous consents granted to it. The trade effluent and stack emission sampling of the industry was carried out by AEE & ASO on 20/01/2016, 09/03/2016, 04/05/2016 & 01/06/2016 and details of the sampling are mentioned in column B(x) & C (i) respectively. During visit, it was observed that: 1. The ETP as well as APCD were in operation. 2. The industry has developed plantation in an area of 1.5 acres to utilize its treated trade effluent and domestic effluent onto land for plantation. 3. The industry has installed boiler of capacity 8 TPH equipped with FBC furnace using rice husk as fuel and has installed twin cyclone as APCD provided with adequate stack height to control the flue gas emissions. 4. The analysis results reveal that the concentration of various parameters in the effluent/emission sample was within the permissible limits as prescribed by the Board. The industry is complying with the conditions imposed in the previous consents granted to it. However, in regard to condition no. 3, the industry has not submitted approval from Central Ground Water Authority in this office, so far. The representative of the industry present during visit stated that the land for setting up of the unit was purchased on 04/05/2011 along with existing borewell. They have not installed any additional tubewell. At that time, guidelines of CGWA were not applicable. In this regard, they have already submitted an undertaking dated 06/01/2016. As such, he requested that they may be exempted from obtaining permission from CGWA for operating its existing submersible pump. It is submitted that as per decision taken by the core committee of the Board in its meeting held on 25/02/2016, it was decided that the water intensive industries may not be granted NOC, till such time the project proponent obtain permission to extract the ground water from the CGWA or any other competent authority designated for this purpose. As, the industry in question is not a water intensive unit, is having existing submersible pump and has not installed any new tubewell/energized source of supply In view of above, it is recommended that the case of industry may be considered for extension in validity of the consent to operate granted under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 for manufacturing of Parboiled Rice @ 2 TPH & Steamed Rice @ 2 TPH upto 30/06/2021 with suitable conditions and following specific conditions:- i) The industry shall not install any additional tubewell / energized source for abstraction of ground water and the entire requirement of fresh water will be met with the existing source of water supply (Submersible pump) already installed in the premises. ii) The industry shall obtain permission from CGWA for abstraction of ground water within period of six months. iii) The electric connection of the industry may be restored permanently.
