File Note: It is intimated that earlier consent to operate under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 were granted to the subject cited industry vide no. ZO-J/SC/CTO/WPC/2008/F-167 & ZO-J/SC/CTO/WPC/2008/F-180 dated 28/07/2008 valid upto 27/07/2009 and further extended upto 29/08/2015. “SDM vide its letter no. 4867 dated 18.06.2014 has forwarded the report of Executive Engineer, Drainage Division, Irrigation Department, Gurdaspur and Revenue Department, Pathankot. As per this report the subject cited stone crusher / screen cum washing plant is listed at Sr.No. 19 of the list of Mirthal Site cluster. It has been certified by the Drainage Division, Irrigation Department, Gurdaspur & Revenue Department that it is located outside the River Bed and more than 50 meters away from the Flood Protection Embankment on the outer side of the river OR 25 meters from the Flood Protection Embankment on outer side of rivulet / stream / choe & where there is no Flood Protection Embankment, the stone crusher / screening–cum-washing plant at a distance of more than 50 meters from the outer edge of the Gair-Mumkin land as per revenue record, recorded as Gair-Mumkinnadi, choe or similar nomenclature identifying a water body on the outer side of the choe/river. Thus, it is not required to be shifted in compliance of orders dated 13.08.2013 passed by Hon'ble Punjab & Haryana High Court in case of CWP no. 21899 titled as Surmukh Singh & Others V/s State of Punjab”. Now the industry has applied for obtaining further extension in validity of consent to operate under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981. The industry was visited by Environmental Engineer alongwith AEE of this office on 13/07/2016 and compliance of code of practice was observed as under:- 1. The stone crusher was not in operation during the visit. The representative informed that the stone crusher is lying closed since long time due to non-availability of raw material. 2. The stone crusher has fully covered the dust emitting points like Jaws/rotopactor. 3. The stone crusher has provided conveyor belts of good quality and are durable. 4. The stone crusher has provided chutes to the end of the conveyor belts. 5. Regular water spray arrangement at dust emitting points/transfer points has been provided through flexible pipe. 6. The stone crusher has provided water sprinklers along the boundary of the industry. 7. The stone crusher has stabilized the approach road with river bed material within the premises and on the ramp. 8. The stone crusher has provided sufficient trees along the boundary. 9. The stone crusher has provided sedimentation/settling tank with motor & pump for re-circulation of wash water and was requested to maintain the same. 10. The stone crusher has provided water meter at the tubewell for fresh water. In view of above, it is recommended that the consent to operate under Water (Prevention& control of Pollution) Act, 1974 may be granted to the industry upto 30/06/2021 with the special condition that the stone crusher shall comply as advised during the visit.
