It is submitted that Regional Office has forwarded the case for grant of consents to operate under the Water Act, 1974 & Air Act, 1981 to the industry as per the details mentioned in the office note. The office note has been examined & observed as under:-
1. The industry was granted consents to operate under the Water Act, 1974 & Air Act, 1981 vide letter nos. BTI/W-2/199/F-418 & BTI/A-2/232/F-631 dt 21.12.2009, respectively for operation of rice sheller unit to manufacture raw rice @ 2 TPH without dryer, subject to the conditions mentioned therein, valid upto 28.02.2015. However, the industry has failed to apply for renewal of consents to operate thereafter.
2. Notice for violation of the provisions of the Water Act, 1974 & Air Act, 1981 was issued to the industry vide Regional Office letter no. 454 dt 05.02.2016 to explain its position in writing, within 10 days with respect to the aforesaid violations. However, the industry failed to submit any reply in this regard within time schedule.
3. The industry was visited by officers of the Board on 14.03.2016 to collect emission sample and it was observed as under :-
a) The industry has installed sortex machine in its existing processing shed without obtaining consent to establish (NOC)/consent to operate of the Board, which was in operation for sorting of rice. However, shelling section was not in operation as per its requirement.
b) The industry has not made adequate plantation along its boundary wall.
4. Show cause notice for violations of the provisions of the Water Act, 1974 & Air Act, 1981 was issued to the industry vide Regional Office regd. letter no. 1346 dt 29.03.2016 with an opportunity of personal hearing before the Environmental Engineer, Regional office, Bathinda on 12.04.2016. However, the industry has failed to attend the said hearing and also not submit any written reply, accordingly the report was sent to Zonal office vide Regional Office letter no. 1602 dt 15.04.2016.
5. Notice for violation of the provisions of the Water Act, 1974 & Air Act, 1981 was issued to the industry vide zonal office letter no. 1882 dt. 02.05.2016 to explain its position in writing, within 15 days with respect to the aforesaid violations.
6. Now, the industry has applied for consents to operate under the Water Act, 1974 and Air Act, 1981 through OCMMS on 13.06.2016 for operation of rice sheller unit to manufacture raw rice /sorted rice @ 2 TPH without dryer alongwith reply of show cause notice. The details of the case are as under:-
a) The industry has submitted C.A certificate regarding its gross fixed assets as Rs. 74.25 lacs as on 31.03.2016 alongwith compliance reports of consents conditions and has deposited consent fee of Rs. 11,625/- each vide R. no. 95/4301 & 96/4301 dt 15.06.2016 in addition to already deposited consent fee under the Water Act, 1974 & Air Act, 1981, respectively, which is adequate for a period upto 30.06.2017 under each Act.
b) The industry has also deposited of Rs. 1800/- vide R no. 97/4301 dt 15.06.2016 as NOC regularization fee for sortex machine installed by it, which is adequate.
7. The application of the industry has been scrutinized and found that the industry has not deposited adequate consent fee for a period of five years i.e. upto 30.06.2020, accordingly the application of the industry was returned online on 22.06.2016 with request to resubmit the application with adequate consent fee for a period of five years.
8. The industry has re-submitted the application for consents to operate under the Water Act, 1974 and Air Act, 1981 through OCMMS on 07.07.2016 for operation of rice sheller unit to manufacture raw rice /sorted rice @ 2 TPH without dryer alongwith undertaking that the rice sheller unit was going on loss and requested to grant the consents to operate for the period of one year/consent fee deposited by it.
9. The industry was visited by officer of Regional Office on 14.07.2016 and it was observed as under –
a) The industry was not in operation due to paddy off-season.
b) The industry has installed cyclone as APCD with shelling section to contain the process emissions and the same was in line with dust emitting points connected to the APCD.
c) The industry has provided stack of adequate height with the APCD and provision to facilitate emission sampling.
d) The industry has provided brick paving at movement area of vehicles, within its premises to prevent the generation of dust emissions
e) The industry has provided brick wall of adequate length with 10' height around husk discharge / storage area and further wind screen of MS of 5’ height has now been provided above the said wall.
f) The industry has not constructed toilet / kitchen so far within its premises so thus septic tank.
g) The industry has made plantation along its boundary wall.
10. The industry is complying with the provisions of the Water Act, 1974 & Air Act, 1981 as well as code of practice prescribed by the Govt. vide order dt. 15.10.2013.
Regional Office has recommended that consents to operate under the Water Act, 1974 & Air Act, 1981 may be granted to the industry for operation of rice sheller to manufacture raw rice / sorted rice @ 2 TPH without dryer for a period upto 30.06.2017, subject to the suitable conditions alonwith the following specific conditions as under:-
- The industry will get emission sample analyzed within two months during its re-commissioning for the paddy season 2016-17 and submit analysis report to the Board.
If approved, action as proposed by EE, Regional Office may be taken please.
