It is intimated that the project proponent was earlier granted Consent to Establish (NOC) by the Board for setting up of residential project with flats (in 1.21 hectares area) vide no. 8309 dated 12.12.2013 valid upto 10.12.2014.
The project proponent was given personal hearing before the Hon'ble Chairman of the Board on 25.02.2016 and wherein it was decided as under:-
1. The Regional office shall conduct re-sampling and submit report alongwith recommendations within 10-days.
2. The project proponent shall operate sewage treatment plant regularly and at all time the effluent standard must comply with the prescribed norms.
3. The consent to operate of the Board under the Air (Prevention & Control of Pollution) Act, 1981 as amended in 1987 be processed on merit.
4. Regional office shall process the consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 as amended in 1988 after conducting re-sampling of the sewage treatment plant alongwith recommendations within 15-days.
In compliance of the decisions of the personal hearing the effluent sample were collected by the Er. Jaspal Singh, AEE of this office on 11.04.2016 and as per the analysis report all the parameter are within the permissible limits of the Board.
The project proponent has applied for consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 as amended in 1988 and Air (Prevention & Control of Pollution) Act, 1981 as amended in 1987.
The site was visited by the AEE of this office on 26.07.2016 and it was observed as under;-
1. The project is a residential colony and there are total 168 flats and project proponent informed that out of these 80 flats are occupied. However, the project proponent has applied for 185 flats.
2. The project has been granted Environmental Clearance vide letter no. 21-43/2010 I.A.111 dated 20.04.2011 for built up are of 24236 sq. mtrs.
3. The project proponent has installed STP for the treatment of its domestic effluent and same was operation in during the visit.
4. The treated effluent is being discharged into MC sewer after STP for which approval from MC Jalandhar has been obtained by the project proponent vide letter no. 421 dated 30.3.2009 for discharge of domestic effluent into sewer and Municipal Solid Waste.
5. The project proponent has submitted the new bank guarantee of Rs. 03.00 Lacs bearing no. 18910100000001 dated 23.02.2016 valid upto 22.02.2018 in lieu of its expired bank guarantee.
6. The project proponent has submitted approved building plan from Director of Factories, Punjab.
The industry has deposited the consents fee under both the Acts which is adequate upto 31.03.2017. The project proponent has requested to grant the consent upto 31.03.2017.
i. I had checked the documents uploaded by industry personally and verified the same.
ii. I had personally checked the industry registration details and found correct.
iii. This industry is listed at Sr. No. 1573 of inventory prepared by R.O. Jalandhar.
iv. I had personally verified the online submission of consent fee and linking with online portal of the Board.
v. The industry is in category and the competency with of case lies with CEE, Jalandhar in Air application competency was in inadvertently was mentioned as Worthy Chairman of the Board.
Keeping in view of above, It is recommended that consent to operate under Water (Prevention & Control of Pollution) Act 1974 may be granted upto 31.03.2017 for 168 flats with suitable conditions as per policy of the Board.
