It is submitted that Regional Office has forwarded the case for grant of consents to operate under the Water Act, 1974 & Air Act, 1981 to the industry as per the details mentioned in the office note. The office note has been examined & observed as under:-
1. The industry was granted consents to operate under the Water Act, 1974 & Air Act, 1981 vide letter nos. ZO/BTI/WPC/2011/F-58 & ZO/BTI/APC/2011/F-51 dt. 04.11.2011 for manufacturing of plastic carry bags/packaging material @ 200 kg/day using virgin granules as raw material, valid upto 31.03.2015, subject to the conditions mentioned therein and extended upto 31.12.2023, subject to the conditions of original consents to operate.
2. The Govt. of Punjab, Department of Local Government vide notification no. 5/18/2016-41g4/692717/1 dated 18.02.2016 & Notification no. S.O.438/P.A.9/1994/S30/2016 dated 29.03.2016 issued by Department of Rural Development & Panchyats has completely prohibited the manufacture, stock, distribute, recycle, sell or use of plastic carry bags in State of Punjab w.e.f 01.04.2016 under sub-section (2) of section 7 of the Punjab Plastic Carry Bags (Manufacture, Usage & Disposal) Control Act, 2005 [Punjab Act No. 17 of 2007], so consents to operate under Water Act, 1974 & Air Act, 1981 of the industry were revoked vide this office letter no. 2083 dt. 17.05.2016 and following directions u/s 33-A of Water Act, 1974 & 31-A of Air Act, 1981 were issued to the industry :-
a) The industry will stop manufacturing, stocking, distribution, recycling and selling the plastic carry bags with immediate effect.
b) The industry will comply with the provisions of Notification no. 5/18/2016-4Ig4/692717/1 dtd. 18.02.2016 issued by the Department of Local Government, Govt. Of Punjab and Notification no. S.O. 438/P.A.9/1994/S30/2016 dtd. 29.03.2016 issued by Department of Rural Development and Panchayats, Govt. of Punjab in letter & spirit.
3. Now, the industry has applied for consents to operate under the Water Act, 1974 and Air Act, 1981 through OCMMS on 11.07.2016 under green category for manufacturing of only plastic packaging material @ 200 kg/day using virgin granules as raw material. The details of the case are as under:-
a) The industry has submitted C.A certificate dt 24.05.2016 regarding its gross fixed assets as Rs. 9.40 lacs and has deposited consent fee under the Water Act, 1974 & Air Act, 1981 of Rs. 2250/- each vide R.no. 20/4631 & 21/4631 dt. 12.07.2016, respectively, which is adequate for a period upto 31.03.2027 under each Act.
b) The industry has submitted undertaking dt. 30.05.2016 that the industry will manufacture only plastic packaging material.
4. The industry was visited by officer of Regional Office on 16.07.2016 and it was observed as under –
a) The industry was in operation and engaged in manufacturing of plastic packaging material only.
b) The industry is using only virgin granules for manufacturing of plastic packaging material.
c) The industry is marking a lable on each plastic packaging material as per Plastic Waste Management Rules, 2016
d) The industry is not using/reprocessing any waste plastic for manufacture of plastic packaging material.
e) The industry has multi-functioning machines, but has removed its dies, which were earlier used in manufacturing plastic carry bags.
f) The industry has no source of trade effluent and only domestic effluent is discharged into M.C sewer.
g) The industry has no source of air emission.
The industry is complying with the provisions of the Water Act, 1974 & Air Act, 1981.
Regional Office has ecommended that consents to operate under the Water Act, 1974 & Air Act, 1981 may be granted to the industry for manufacturing only plastic packaging material @ 200 kg/day using virgin granules for a period upto 31.12.2025, subject to the suitable conditions alongwith the following specific conditions as under:-
a. These consents has been granted in supersession to the consents granted to the industry on 22.05.2015 for manufacture Carry bags/Packaging Material @ 200 kg/day using virgin granules for a period upto 31.12.2023.
b. The industry will obtain registration under Plastic Waste Management Rules, 2016 and comply with the provisions of Plastic Waste Management Rules, 2016.
If approved, action as proposed by EE, Regional Office may be taken please.
