It is submitted that the industry is a screening-cum-washing plant and the consents to operate under Water Act, 1974 and Air Act, 1981 has already been revoked/ cancelled by the Board vide letter 3189 and 3186 dated 30/05/2016, due to the violations observed on dated 24/05/2016 and notice u/s 33-A of the Water Act, 1974 and u/s 31-A of the Air Act, 1981 was also served vide no. 3479 dated 16/06/2016 with an opportunity of personal hearing on 21/06/2016, wherein it was decided that:
i) Environmental Engineer, Regional Office, SAS Nagar shall visit the site of the industry immediately to verify to submissions made by the industry and process the consent cases on merits.
ii) Further action in the matter will be taken after receipt of the report from the Regional Office, SAS Nagar.
Thereafter, the industry was applied for CTOs under orange category under Water Act, 1974 & the Air Act, 1981 and the Environmental Engineer, Regional Office, SAS Nagar was asked online to direct the industry to apply for CTO under red category alongwith adequate consent fee, report about the cancellation of registration by the GMDIC and process the case accordingly.
Now, Regional Office has send the cases under Water Act, 1974 and Air Act, 1981 for grant of consents and dropping action u/s 33-A of the Water Act, 1974 and u/s 31-A of the Air Act, 1981 as the industry has make the compliances of the code of practice. The details of the case has been mentioned in the note of AEE, which may kindly be perused.
The registration granted by the Deptt. of industry has not been cancelled by GMDIC, but the same had expired on 30/06/2016. The representative of the industry informed that the industry continued its operation till the registration was valid and due to this fact ambient air monitoring was got carried out on 23/06/2016 from NABL approved lab. The industry is generating Domestic Effluent and the same is discharged onto land for plantation/irrigation after passing through septic tank.
In view of the above, May, if approved, Environmental Engineer, Regional Office, SAS Nagar be allowed to grant the consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 to the industry upto 30/09/2020 subject to suitable conditions and an additional condition that industry shall inform Board, as & when it re-commissions its unit, so as to enable the Board to carry out its ambient air monitoring. Action initiated u/s 33-A of the Water (Prevention & Control of Pollution) Act, 1974 & 31-A of the Air (Prevention & Control of Pollution) Act, 1981 please be dropped as the industry has made the compliance of the code of practice.
