It is intimated that the industry was earlier granted consent under Water (Prevention and Control of Pollution) Act, 1974 & Air (Prevention & Control of Pollution) Act, 1981 vide no. ZO-1/LDH/RO-2/WPC/2011/F-3636 dt 26.5.2011 valid upto 31.10.2012 & no ZO-1/LDH/RO-2/APC/2011/F-2636 dt 26.5.2011 valid upto 31.10.2012.
The industry was issued violation notice for renewal of consents vide this office letter no. 2548 dated 19.9.2013, no. 2717 dated 11.10.2014, 1254 dated 17.6.2015 and no. 2048 dated 12.8.2015. The industry was visited by AEE of this office on 24.11.2015 and some violations were observed. The industry has applied for renewal of consents under Water Act, 1974 and Air Act, 1981 and processed through OCMMS for refusal of consents. Accordingly, the industry was issued show cause notice for refusal of consent under Water Act, 1974 and Air Act, 1981 alongwith hearing before the SEE, Z.O-1, Ludhiana on 11.4.2016. The industry has failed to attend the hearing. The competent authority was decided one more opportunity of personal hearing given to the industry dated 29.04.2016, wherein it was decided that:-
1. Consent to operate under Water (Prevention & Control of Pollution) Act, 1974 & Air (Prevention & Control of Pollution) Act, 1981 be refused and recommended action u/s 33-A of Water (Prevention & Control of Pollution) Act, 1974 & u/s 31-A of Air (Prevention & Control of Pollution) Act, 1981
Thereafter, the consent under Water Act, 1974 and Air Act,1981 have been refused through online and the industry was issued notice to issue directions u/s 33-A of the Water Act,1974 and u/s 31-A of the Air Act, 1981 alongwith hearing before the Chief Environmental Engineer of the Board on 11.7.2016. The industry has failed to attend the hearing, wherein it was decided that:-
1. Directions u/s 33-A of Water Act, 1974 and u/s 31-A of the Air Act,1981 be confirmed for closure of the industry.
2. PSPCL be directed to disconnect the electric connection of the industry with immediate effect.
As per decision of the hearing the PSPCL authorities were directed to disconnect the electric connection available with the industry vide Board’s letter no. 6141-42 dated 26.7.2016.
Now, the industry has again applied for renewal of consent under Water (Prevention and Control of Pollution) Act, 1974 & Air (Prevention & Control of Pollution) Act, 1981 alongwith documents through OCMMS. The consent fee deposited by the industry is adequate upto 31.3.2020. The detail regarding calculation of consent fee mentioned in the agenda note.
Accordingly, the industry was visited by AEE of this office on 8.8.2016 & it was observed that:-
1. The industry was in operation during the visit & the electric connection of the industry has not been disconnected by the PSPCL Authorities.
2. The industry has installed one oil fired furnace which was in operation at the time of visit. The industry earlier had 1 coal fired furnace which has now been dismantled and lies in abandoned condition.
3. The industry has provided water scrubber as APCD which was in operation at the time of visit..
4. The industry has provided paint spray system inside shed which was not in operation at the time of visit. The paint spray system has been provided with water tank to capture spray paint.
5. The industry has provided cooling tower to cool its oil quenching pit. The oil bearing cooling water is being recycled and the borehole has been filled up.
6. The domestic effluent is discharged onto land for plantation through septic tank.
In view of the above, it is recommended that the consent under Air Act, 1981 may be granted to the industry upto 30.6.2019 with appropriate conditions & with special condition that the industry will submit DTP certificate regarding classification of the area as per Master Plan of Khanna within one month and the PSPCL Authorities may be directed to not to disconnect the electric connection of the industry.
