File Note: It is submitted that the directions u/s 33-A of Water (Prevention & Control of Pollution) Act, 1974 & 31-A of Air (Prevention & Control of Pollution) Act, 1981 were issued to the Auto Service Station to seal the wet section of the industry and to seal the D.G. set of the industry immediately vide ZO letter endst. nos. 4085 & 4083 dtd 9/8/2013. The Auto Service Station was granted consent to operate under Water (Prevention & Control of Pollution) Act, 1974 & Air (Prevention & Control of Pollution) Act, 1981, which were valid up to 31/03/2014. The directions u/s 33-A of Water (Prevention & Control of Pollution) Act, 1974 were also issued vide ZO letter no. 5131 dtd 4/10/2013 in which it was decided by the competent authority to de-seal the wet section of the unit for 06 months. The workshop was issued violation notices under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 & Air (Prevention & Control of Pollution) Act, 1981 to apply for renewal of consents vide this office letter no. 1861 & 1860 dtd 22/5/2014 respectively. The Auto Service Station has got analyzed its trade effluent sample on dtd 1/1/2014, 4/3/2014 & 2/12/2014. The reports issued by ZO Lab, Jalandhar of the above said collected samples, reveal that the analyzed parameters are within limits as prescribed by the Board. The effluent sample was again collected on 30/3/2016 and the report issued by ZO Lab, Jalandhar reveals that the analyzed parameter of BOD=38 mg/l is beyond the permissible limit as prescribed by the Board. Now, the Auto Service Station has applied for obtaining extension in validity of consent to operate under Water (Prevention & Control of Pollution) Act, 1974 & Air (Prevention & Control of Pollution) Act, 1981 through OCMMS. The Auto Service Station has deposited Rs. 9,000/- vide R.No. 40/4521 dtd 16/8/2016 under Water Act, 1974 and Rs. 9,000/- vide R.No. 39/4521 dtd 16/8/2016 Air Act, 1981, which is adequate up to 31/3/2020 under both Acts. The Auto Service Station has also deposited Rs. 900/- vide R.No. 95/4521 dtd 24/8/2016 as NOC regularization fee & Rs. 500/- vide R.No. 41/4521 dtd 16/8/2016 as an application form fee. The Auto Service Station was visited by officer of this office on 22/08/2016 and observed as under:- 1. The Auto Service Station is engaged in the sale & service of two wheelers. 2. The washing of the vehicle was not in progress at the time of visit. 3. The Auto Service Station has installed an ETP for treatment of effluent generated from the washing process and discharge from outlet of ETP is into sewer. 4. The Auto Service Station has installed one D.G. set of 25 KVA which is fitted with canopy. 5. The directions u/s 33-A of Water (Prevention & Control of Pollution) Act, 1974 were issued for the de-sealing of wet section for six months period only and the same has been sealed again at the time of visit. It is further submitted that the Auto Service Station has submitted a representation in this office in which it describes that the filter of the Effluent Treatment Plant was due for replacement that’s why the effluent sample collected by the Board on 30/3/2016 is beyond the permissible limit of the Board in terms of BOD=38 mg/l. Now, the filter has been replaced and the Auto Service Station has got analyzed its trade effluent sample from M/s SIMA Labs (P) Ltd, New Delhi on 8/8/2016 & the report reveals that the analyzed parameters are within limits as prescribed by the Board. The Auto Service Station has also submitted a Bank Guarantee of Rs. 2.00 lacs which is valid up to 22/8/2017. Keeping in view of the above, may if approved, the application of the auto service station may be send to Zonal Office, Amritsar with recommendations that:- 1. The validity of consent to operate under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 may be extended up to 30/9/2019. 2. The directions u/s 33-A of Water (Prevention & Control of Pollution) Act, 1974 may be issued for the de-sealing of wet section as the washing effluent sample collected thrice as per policy of the Board and the same were found within limits as prescribed by the Board. 3. The extended bank guarantee may be returned back to the Auto Service Station.
