The industry was given personal hearing before Chief Environmental Engineer, Ludhiana on 02.05.2016 wherein it was decided as under :
1. Directions u/s 33-A of Water (Prevention & Control of Pollution) Act, 1974 & Air (Prevention & Control of Pollution) Act, 1981 be confirmed for closure of the industry.
2. PSPCLtd. Be directed to disconnect the electric connection of the industry with immediate effect.
The directions were issued to PSPCL authorities vide no. 3597-98 dated 18.08.2016 & vide no. 3603-04 dated 18.05.2016 for disconnection of the electric connection available to the industry.
In compliance of the decisions of the personal hearing a letter was received vide memo no. 973 dated 22.08.2016 from Asst. Executive Engineer, Sub Div. Sahnewal, PSPCL, Ludhiana As per which electric connection of the industry ws disconnected vide TDCO no. 2/86548 dated 11.08.2016 & TDCO no. 3/86548 dated 11.08.2016.
Now the industry has applied for obtaining fresh ‘Consent to Operate’ under Water Act, 1974 & Air Act, 1981. The industry was visited by officer of this office on 05.09.2016 and the following observations were made-
1. The industry was not in operation during visit as the electric connection of the industry is disconnected.
2. The industry has now installed 02 coal fired manual bhathi’s with common wet scrubber as APCD along with adequate stack height.
3. The industry has not installed any DG set.
4. The industry has also provided a underground plastic tank of capacity 2000 ltr for collection of trade effluent.
5. The industry has now made an agreement for lifting of its trade effluent @ 2000 Ltr/month with M/s JBR Tech. Pvt. Ltd. & domestic effluent of the industry is discharged onto land for plantation after septic tank.
6. The industry has submitted DTP certificate vide no. 1823 dated 03.08.2016 as per which the site of the industry falls under the industrial zone.
7. The industry has submitted approved building plan prepared by the competent person under Factory Act, 1948
8. The industry is mentioned at Sr. no. R.O-I/LDH/WA/1123 in the inventory maintained by Regional Office-1, Ludhiana.
9. The industry is now complying with various provisions of Water Act, 1974 & Air Act, 1981.
10. The competency the grant the consent lies with Sr. Environmental Engineer, Zonal Office, Ludhiana.
In view of above, it is recommended that:
1. ‘Consent to Operate’ under the Water Act 1974 & Air Act, 1981 may be granted to the industry upto 30.06.2021 with suitable conditions as per policy of the Board.
2. The electric connection of the industry may be restored temporarily for 06 months.
