Subject: Renewal of consent to operate an industrial plant u/s 21 of the Air (Prevention & Control of Pollution) Act, 1981 of M/s Ram Prashad BKO, Mehlan Road, Sibian, Sangrur.
It is submitted that the subject cited industry is a BKO and engaged in the manufacturing of bricks @ 8 lacs/round. The industry was earlier granted consent to operate under the Air Act, 1981 by the Board vide No. SGR/APC/2001/F-303 dated 24/08/2001 valid upto 31/03/2016 for the manufacturing of Bricks @ 8 lacs/round subject to the certain conditions mentioned therein. The industry has now applied for renewal of consent to operate under the Air Act, 1981 through OCMMS on 30/08/2016. To verify the facts, the site was visited by undersigned on 12/09/2016 and it was observed as under:-
1. The industry was not in operation during visit due to off season.
2. The brick kiln has installed gravity chamber as per design of PSCST as APCD to control the flue gas emissions arising due to burning of coal in the brick kiln. A fixed masonry stack of 30 meter height has been constructed to disperse the flue gas emissions at desired level. The brick kiln has provided adequate sample collection facilities with the stack.
3. Crushed coal was lying at site to be used as the fuel in the kiln and no other unauthorized fuel was found within the premises of the brick kiln.
4. The BKO has planted trees along its boundary wall.
5. The BKO has stabilized its kacha road with keri.
6. The industry is complying with the consent conditions earlier granted to it.
The competency for grant of consent to BKO lies with the Environmental Engineer of Regional office, as per Board policy no. EE (Mega) 2013/19650-19761 dated 30/04/2013. According to Head office order no. 346 dated 01/08/2016:-
1. Environmental Clearance for mining of brick earth will not be a pre-requisite for the grant of consent to operate to the brick kilns. The "consent to operate" shall be issued to the brick kilns subject to the condition that the BKO will obtain Environmental Clearance under EIA notification for mining of brick clay to be used as raw material for the manufacturing of Bricks.
2. The validity period of "Consent to operate" shall be for 10 years or for the period for which consent fee has been deposited, whichever is earlier, as the brick Kiln industries falls under "Orange Category" as per the latest categorization of industries by CPCB.
As the BKO is now covered under orange category of industries and has deposited Rs. 6300/- vide R. No. 67/4528 dated 07/09/2016 against the fixed assets of Rs. 1.68 lacs, as Air consent fee, which is adequate upto 30/09/2026.
In view of the above, it is recommended that the renewal of consent to operate under Air Act, 1981 under orange category may be granted to the industry upto 30/09/2026 with suitable conditions and special condition that the BKO will obtain Environmental Clearance under EIA notification for mining of brick clay to be used as raw material for the manufacturing of Bricks. |
