File Note: It is submitted that the subject cited industry is sweets manufacturing workshop and engaged in manufacturing different type of Sweets at the name & style of M/s Aneja Sweets & Bakers (P) Ltd., Plot No. C- 197, Focal Point, Patiala. The industry was issued show cause notice for violation of the provisions of Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 vide this office letter no. 4501 dated 10.12.2015. Thereafter, the industry was given personal hearing before the Senior Environmental Engineer, Zonal Office-I, Patiala on 17.03.2016, wherein, it was decided as under: 1. Last opportunity of personal hearing on 29.03.2016 at 11.00 a.m. be given to the industry and the industry should attend the hearing alongwith proposal of treatment facility to be provided and PERT chart to attend all the observations. 2. It was made clear to the industry, if the industry fails to submit the proposal as per (i) above, strict action will be initiated against the industry under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 & Air (Prevention & Control of Pollution) Act, 1981. Thereafter, representative of the industry attended the hearing on 29.03.2016 and after the hearing, it was decided as under: 1. The industry shall install & commission the effluent treatment plant as per proposal submitted by the industry within 2 month and also apply for consents to operate under the Water (Prevention & Control of Pollution) Act, 1974, Air (Prevention & Control of Pollution) Act, 1981 & authorization under the provisions of the Hazardous Waste (Management, Handling & Transboundary Movement) Rules, 2008 alongwith requisite documents and fee. 2. EE, RO, Patiala shall visit the industry after month to verify the compliance of the hearing decision and process the cases on merits. The proceedings of the personal hearing was conveyed to the industry vide letter no. 1954 dated 01.04.2016. The industry was visited by this office on 20.07.2016 to verify the compliance of the decisions of personal hearing given to it and observed as under: 1. During visit, the workshop was in operation. 2. The workshop has thermic fluid heater in which wood is being used as fuel. No APCD is provided with the heater furnace and the stack provided is only 5' from the roof level. 3. There was inbuilt structure of ETP placed in the workshop but no connection of any pipeline has yet been made and workshop was discharging its waste water generating from washing of utensils and floor washing directly into Focal point, sewer without any treatment. 4. The workshop has yet not made any arrangement for proper storage/disposal of its Municipal solid waste as well as kitchen waste. Accordingly, the report has been sent to Senior Environmental Engineer, Zonal Office-I, Patiala vide this office letter no. 4079 dated 22.07.2016. Thereafter, the industry was again given opportunity of personal hearing before Senior Environmental Engineer, Zonal Office-I, Patiala on 29.08.2016 wherein, it was decided as under: 1. The industry shall provide adequate stack with the thermic fluid heater above roof level, submit copy of agreement made with the piggery farm owner and to submit the consent applications under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 alongwith requisite documents and fee within a week. 2. EE, RO, Patiala shall visit the industry after 10 days to verify the submissions made by the industry and process the cases on merits. Now, the industry has applied for fresh consent to operate under Water (Prevention & Control of Pollution) Act, 1974 & Air (Prevention & Control of Pollution) Act, 1981 for manufacturing of Sweets@ 350 kg/day. The industry has deposited Rs. 26500/- vide R.No. 91/4400 dated 07/09/2016 under Water (Prevention & Control of Pollution) Act, 1974 and Rs. 26500/- vide R.No. 91/4400 dated 07/09/2016 under Air (Prevention & Control of Pollution) Act, 1981 as consent fee against gross fixed assets of Rs. 53.83 lac as per CA certificate submitted by it. The consent fee deposited by the industry is adequate upto 30/09/2021 under each act separately as the industry has commissioned its unit in December 2012 (attached electricity bill as commissioning proof). The industry has also submitted Rs. 3000/- vide R.No. 91/4400 dated 07/09/2016 as NOC Regularization fee. The industry has submitted feasibility report of the ETP along with completion certificate, Piggery Agreement, electricity bill/bill of the borewell equipments, M.C. Connection bill of sewer, building plan approved by the competent person under Director of Factories etc., MOA, Copy of registry along with the application. It is pertinent to mentioned here that the source of water supply of the industry is the existing borewell which was installed by the industry in July, 2012 i.e. before declaration of block Patiala as notified zone by Central Ground Water Authority. The industry has submitted the bill of the submersible pump/other equipment as well as electricity bill as proof of the installation time period of the borewell, which are enclosed herewith. The industry was visited by Asstt. Environmental Engineer of this office on 09.09.2016 and observed as under: 1. During visit, the industry was in operation. 2. The industry has installed thermic fluid heater in which wood is being used as fuel. It has now provided stack of height 10 ft. above roof level with the fluid heater. 3. The industry has installed ETP consists of bar screen followed by oil & grease trap, collection cum pumping sump, SAFF reactor, tube settler, pressure filter & sludge drying beds to treat the waste water generated from the process. The ETP installed by the industry is as per the feasibility report and completion certificate submitted from CPTL consultants, Mohali. 4. During visit, the ETP installed by the industry was in operation but, no discharge was found at the outlet of the ETP, therefore, samples could not be collected. 5. The treated trade effluent & domestic effluent of the industry is being discharged into focal point sewer which is further leading to STP Ablowal of 10 MLD for further treatment. 6. The industry has not provided water meter at the outlet of the ETP as well as the tubewell installed as source of water supply. 7. The industry has one D.G. set of capacity 82 KVA equipped with canopy and adequate stack height. 8. The industry has earmarked the space for storage of MSW and kitchen waste near the ETP area and has made agreement with Sh. Vicky, Street no. 1, Mehar Singh Colony, Patiala (piggery farm owner) for disposal of its waste material. 9. The industry is complying with the provisions of the Water (Prevention & Control of Pollution) Act, 1974 & Air (Prevention & Control of Pollution) Act, 1981 and the decisions of the personal hearing given to it. In view of above, if approved, Senior Environmental Engineer, Zonal Office-I, Patiala may be recommended that the consent to operate under Water (Prevention & Control of Pollution) Act, 1974 & Air (Prevention & Control of Pollution) Act, 1981 for manufacturing of Sweets @ 350 kg/day may be granted to the industry upto 30/09/2021 with usual conditions and special conditions as under:- a) The industry shall provide water meter at the outlet of ETP and the borewell installed as source of water supply within one month and maintain the records regarding consumption of fresh water as well as discharge of its treated effluent. b) The industry shall get its ETP monitored from Board's lab/Board's approved lab within one month and submit the report to this office. c) The industry shall apply to obtain authorization under the provisions of Hazardous & Other Wastes (Management & Transboundary Movement) Rules, 2016.
