File Note: No. R.O-II/LDH/CON/IND/928 Recommendations:- It is intimated that the industry is a small scale orange category unit. The BKO was granted consent to operate under Air (Prevention & Control of Pollution) Act, 1981 vide no. LDH/APC/2002-2015/F-94 dated 09.04.2003 valid upto 30.09.2015 and which was revoked vide T.O. letter 8906 dated 21.10.2004. The Board again vide its common letter no.5225 dated 14.04.2005 written to the Director, Food Civil Supplies and Consumers Affairs Department, Punjab, Chandigarh to revive all the consents till the final decision of Punjab & Haryana High Court which were earlier cancelled due to refused to utilization of fly ash in bricks & letter endst. No. 5352-66 dated 15.04.2005 to all the Zonal Offices & ROs of Board. Now, the BKO has applied for fresh consent to operate under Water (Prevention & Control of Pollution) Act, 1974 & renewal of Air (Prevention & Control of Pollution) Act, 1981 alongwith documents through OCMMS under orange category. The BKO has deposited Rs. 9500/- vide R. No. 94/4253 dated 17.08.2016 under Air Act, 1981 and Rs. 9500/- vide R. No. 93/4253 dated 17.08.2016 under Water Act, 1974, which is adequate upto 30.09.2025. The BKO has installed a brick kiln with adequate stack height and gravity settling chamber to entrap the particulate matter. The BKO has modified its design as per the PSCST norms for air pollution control and the industry has submitted a certificate in this regard issued by Punjab State Council for Science and Technology dated 05.01.2001. The BKO has provided plantation along the boundary wall and stabilized its road with Keri. Board vide its office order dated 01.08.2016 has decided that:- 1. Environmental Clearance for mining of brick earth will not be a pre-requisite for the grant of consent to operate to the Brick Kilns. The “Consent to Operate” shall be issued to the brick kilns subject to the condition that the BKO will obtain Environmental Clearance under EIA notification for mining of brick clay to be used as raw material for the manufacture of Bricks. 2. The validity of period of “Consent to Operate” shall be for 10 years or for the period for which consent fee has been deposited, whichever is earlier, as the Brick Kiln industries falls under “Orange Category” as per the latest categorization of industries by CPCB. In view of above, may if approved, consent under Air (Prevention & Control of Pollution) Act, 1981 may be granted to the brick kiln upto 30.09.2025 with the special condition that BKO will obtain Environmental Clearance under EIA notification for mining of brick clay to be used as raw material for the manufacture of Bricks.
