It is submitted that the industry was granted consent to establish (NOC) from the pollution angle vide no. G15SGRCTE3373063 dated 30/11/2015, for the establishment of industry unit for the manufacturing of PVC pipes @ 4.0 MTD by using PVC resin @ 2.0 MTD & Calcium carbonate @ 2.0 MTD as raw materials, with certain condition mentioned therein and special condition that the industry will not abstract any ground water through energized means without permission from the CGWA.
Now, the industry was applied for obtaining consents to operate under the Water Act, 1974 & the Air Act, 1981 through OCMMS on 19/10/2016. The industry has submitted CA certificate dated 12/09/2016, which shows amount of gross fixed assets of the industry as Rs. 119.97 lacs. Accordingly, the industry has deposited consent fee of Rs. 5,3000/- each vide R. No. 12/4415& R. No. 13/4415 dated 20/10/2016, under Water Act, 1974 & Air Act, 1981, which is adequate upto 31/12/2025. The industry has submitted letter no. nil dated 07/10/2016 from the President of MC, Dhuri, District Sangrur regarding to supply excess ground water @ 2000 ltr/month from MC, Dhuri to the industry, which is not valid document as the same is not verified by EO, MC, Dhuri. The industry has not submitted approved building plan from the Director of Factories, Punjab (Competent Authority) of the industrial department. The industry has not submitted lease deed of the land.
The industry was visited by AEE of this office on 24/10/2016 and it was observed as under:-
1. The industry was in operation, for the manufacturing of plastic pipes from the PVC resin & Calcium carbonate as raw material.
2. The industry has installed submersible pump in its premises for cooling purpose.
3. The industry has not adequate plantation along the boundary.
As such the industry is not complying with the NOC conditions as well as provisions of under the Water Act, 1974 & the Air Act, 1981.
Keeping in view of above, if approved, show cause notice for refusal of consents to operate under the Water Act, 1974 & the Air Act, 1981 may be issued to the industry within an opportunity of show cause in writing within 15 days from the date of issue of this notice to explain your position as to why further action under the provisions of the Water (Prevention & Control of Pollution) Act 1974 & the Air (Prevention & Control of Pollution) Act, 1981 may not be taken against the industry, failing which, it will be presumed that the industry has nothing to say and further action under the provisions of aforesaid Acts will be taken without any further notice/ opportunity.
