File Note: Earlier, the industry was granted consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 vide no. ZO-I/SAS Nagar/WPC/2012-2013/V-759 dated 07/10/2012, which was valid upto 16/04/2013 and under the Air (Prevention & Control of Pollution) Act, 1981 vide no. ZO-I/SAS Nagar/APC/2012-2013/V-803 dated 17/10/2012, which was valid upto 16/04/2013 for manufacturing of C.R. Precision Pipe @ 8 MTD and C.R. Coils @ 25 MTD subject to the suitable conditions mentioned therein. The industry was visited by the officers of the Board on 05/09/2015 and observed that the industry was operating its unit in violation of the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981. The industry was served with notice u/s 33-A of the Water (Prevention & Control of Pollution) Act, 1974 and 31-A of the Air (Prevention & Control of Pollution) Act, 1981 alongwith an opportunity of personal hearing before the Worthy Chief Environmental Engineer on 05/10/2015, wherein, it was decided as under: 1. The industry shall comply with the incompletions, if any, within 5 days and apply for consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 within next 10 days. 2. Environmental Engineer, Regional Office, SAS Nagar shall process the applications of the industry on merits. Thereafter, the industry had applied for renewal of consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 with requisite documents and consent fee and the same were returned to the industry as the industry was not complying with the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981. The industry was visited by the Environmental Engineer along with AEE of this office on 19/07/2016 in compliance to the decision of the personal hearing held on 19/07/2016 before the Chief Environmental Engineer. During this visit, the industry was again operating its unit in violations of the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981. The industry was served with show cause notice u/s 33-A of the Water (Prevention & Control of Pollution) Act, 1974 and 31-A of the Air (Prevention & Control of Pollution) Act, 1981 alongwith an opportunity of personal hearing on 04/10/2016 before the Chief Environmental Engineer, wherein, it was decided as under: 1. The industry shall treat its trade effluent including spent acid till the operator of CETP start lifting its spent acid or any other authorized arrangements made by the industry. 2. The industry shall apply for obtaining consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 and authorization under the Hazardous and Other Wastes (Management and Transboundary Movement), Rules, 2016 within 7 days. 3. Environmental Engineer, Regional Office, SAS Nagar shall visit the industry immediately after 7 days to verify the compliances made by it and thereafter, process the consent & authorization applications to be submitted by the industry on merits. 4. Bank guarantee submitted by the industry be sent to RO in original for further necessary action. Now, the industry has again applied for renewal of consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 with requisite documents and consent fee. The industry had already deposited consent fee of Rs. Rs. 96,000 (Rs. 48,000/- on account of water consent and Rs. 48,000/- on account of air consent) vide C.R. No. 9/4168 dated 13/05/2016, which is adequate upto 30/06/2019 for both the consents against the fixed assets of Rs. 300.00 lacs. The industry has informed that the increase in the value of fixed assets amounting to Rs. 80 lacs is due to purchase of new vehicles, purchase of pollution control devices and there is no increase in the production as well as pollution load of the industry. Accordingly, the industry was visited by AEE of this office on 16/11/2016 and it was observed as under: 1. The industry was not in operation due to some internal problems. 2. The industry is having business of manufacturing of Electrical Resistance welding (ERW) pipes by using HR strips as raw material. 3. The manufacturing process of the industry is as: Raw material pickling with HClrinsingcuttingannealingtubingslitting. 4. The industry has installed one number HSD fired annealing furnace of capacity 12 Ton, which is attached with a stack alongwith sampling arrangement to facilitate sampling of stack emissions. 5. The industry has installed one DG set of capacity 66 KVA, which is now equipped with canopy and stack of adequate height. 6. The industry has now installed alkali scrubber to control the acid fumes generated from pickling process. 7. The industry has now executed an agreement with M/s JBR Technologies Pvt. Ltd., Ludhiana for lifting and spent acid for recovery in its unit installed at village Kohara, Distt Ludhiana. The industry is using cutting oil as coolant and claimed that the entire quantity of coolant of cutting oil is being reused in the cutting process, which is not acceptable. The industry was advised to store the spent cutting oil in the hazardous waste room and obtained authorization for this category also under the Hazardous & Other Wastes (Management & Transboundary) Rules, 2016. 8. The industry has provided septic tank for treatment of domestic effluent and the treated trade effluent is now being utilized onto land for plantation developed inside the industrial premises. 9. The sample of stack emissions of annealing furnace was carried out by M/s Chandigarh Pollution Testing Laboratories on 18/03/2016 and as per analysis report, the concentration of particulate matter is 66 mg/Nm3 against the prescribed standards of 150 mg/Nm3. The sample of acid fumes was collected from the stack of APCD of pickling section by the said lab and as per analysis report, the concentration of acid mist is 6 mg/Nm3 against the prescribed standards of 35 mg/Nm3. 10. The industry is operating its industrial plant without valid authorization under the Hazardous & Other Wastes (Management & Transboundary) Rules, 2016. The industry was advised to apply for authorization under the Hazardous & Other Wastes (Management & Transboundary) Rules, 2016. It is also submitted that the industry is located in industries general zone, in which only green/orange category of industries can be established as per the notified Master Plan of Dera Bassi dated 27/07/2010. However, it also falls in FEZ area declared vide notification no. 3/4/87-3IB1/311 dated 09/01/1990 by the Deptt. of Industries, Govt. of Punjab. Therefore, there is a need to take up the matter with GMADA to the effect as to whether the provisions of section 79 of the Punjab Regional & Town Planning & Development Act, 1995 are applicable to this project or not. In view of above, it is recommended that the consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 may be renewed upto 30/06/2017 subject to suitable conditions and additional condition that the industry shall apply authorization under the Hazardous & Other Wastes (Management & Transboundary) Rules, 2016 within one month and the industry shall submit certificate from GMADA as to whether the provisions of section 79 of the Punjab Regional & Town Planning & Development Act, 1995 are applicable to this industry or not. If applicable, as to how much time the industry can continue its operation at this site.
