File Note: It is intimated that earlier the industry was granted consent to operate under Water (Prevention & Control of Pollution) Act, 1974 & Air (Prevention & Control of Pollution) Act, 1981 vide no. ZO-J/SC/CTO/WPC/2007/F-129 & ZO-J/SC/APC/2007/F-140 dated 23.07.2007, respectively. Both consents have been expired on 22.07.2008. The industry was issued number of notices to apply for extension in validity of consents vide this office letter no. 2011 dated 11.03.2011, 5258 dated 24.06.2011 & 1896 dated 23.03.2012. Accordingly the matter was reported to Zonal office and industry was given personal hearing before Senior Environmental Engineer of the Board on 15.12.2011 where in it was decided that:- 1. The industry shall submit Bank Guarantee of Rs. 1.00 lac within 07 days. 2. The industry shall apply for consent to operate under Water (Prevention & Control of Pollution) Act, 1974 & Air (Prevention & Control of Pollution) Act, 1981 within 07 days. 3. The industry shall comply complete compliance of code of practice within 07 days. 4. Environmental Engineer Regional office to visit after 07 days and send his recommendations after industry comes in operation. In compliance to the decisions of the hearing the industry has submitted bank guarantee bearing no. 4149ILG000112 dated 09.05.2012 & valid for the period upto 08.05.2013 and sent to DCFA, Patiala vide this office letter no. 3763 dated 15.05.2012 for safe custody. The industry applied for consent to operate under Water (Prevention & Control of Pollution) Act, 1974 & Air (Prevention & Control of Pollution) Act, 1981 along with requisite documents & consent fee, but the same was refused vide ZO Letter Endst. No. 6370 dated 28.08.2012 as the industry failed to submit NOC/Approval from Department of Industries and Commerce, Govt. of Punjab regarding mining. The industry applied for consent to operate under Air (Prevention & Control of Pollution) Act, 1981 & Water (Prevention & Control of Pollution) Act, 1974, but the same were refused vide Zonal Office, Amritsar letter No. 1247 Dated 04.03.2013. The ambient air sampling of the industry was carried out by the officers of the Board on 15.10.2012 & as per the analysis report received vide Zonal Office, Jalandhar letter No. 6510-11 Dated 30.10.2012, the parameters were within the prescribed limits of the Board. The industry was issued notice of violation of various provisions of section 21 of Air (Prevention & Control of Pollution) Act, 1981 & 25/26 of Water (Prevention & Control of Pollution) Act, 1974 vide this office letter No. 3262 & 3298 Dated 02.07.2013 respectively. The industry was issued notice of violation of various provisions of Air (Prevention & Control of Pollution) Act, 1981 & Water (Prevention & Control of Pollution) Act, 1974 alongwith an opportunity of personal hearing before the Environmental Engineer of the Board on 18.07.2013 vide this office letter No. 3821 Dated 12.07.2013. Now the industry has applied for consent to operate under Water (Prevention & Control of Pollution) Act, 1974 & Air (Prevention & Control of Pollution) Act, 1981 for the operation of stone crusher through OCMMS in a totally paperless manner by uploading necessary documents as PDF. The industry has already deposited Rs. 15000/- vide receipt no. 28/3210 dt. 12.06.2012 under Water Act & Rs. 15000/- vide receipt no. 27/3210 dt. 12.06.2012 under Air Act and Now Deposited Rs. 1500/- vide receipt No. 69/3039 dated 19.11.2012 under Air Act and Rs. 1500/- vide receipt No. 70/3039 dated 19.11.2012 and Rs. 500/- vide receipt no. 68/3039 dt. 19.11.2012 as form fee. Now deposited Rs. 6000/- through NEFT under water act, 1974, Rs. 500/- through NEFT as Application fee & Rs. 6000/- under Air Act, 1981. The industry has submitted ambient air sampling carried out by M/s Haryana Test House on 13.06.2013 as per the analysis report received parameters were within the prescribed limits of the Board. The industry has not submitted extended bank guarantee of Rs. 1.00 lac till date. The industry was asked vide this office letter No. 2817 Dated 10.05.2013 to submit the same. The industry was visited by Er. Rantej Sharma, AEE on 10.08.2013 & compliance of code of practice has been noted as follows:- 1. The stone crusher was in operation during the visit. 2. The stone crusher has covered the dust emitting points like Jaws/rotopactor. 3. The stone crusher has provided conveyor belts of good quality and are durable. 4. The stone crusher has provided conventional chutes to the end of the conveyor belts. 5. Regular water spray at dust emitting points/transfer points has been provided through flexible pipe. 6. The stone crusher has provided 04 no. water sprinklers at the boundary of the industry. 7. The stone crusher has stabilized the approach road with river bed material within the premises and on the ramp. 8. The industry is cleaning approach roads leading to its crusher from time to time. 9. The stone crusher has provided sufficient green belt and same is adequate. 10. Annual health survey of the workers is being done regularly as verified from the labourers working on the crusher. 11. The process waste i.e. file material is being used for filling up of low-lying areas. 12. The openings of the housing for the movement of mechanical drives, conveyor belts etc. has been properly sealed with flexible rubber flaps. 13. The water spray system has been interlocked with the main crushing operation. 14. The stone crusher has provided sedimentation/settling tanks of size 45’x15’x12’.5” with motor & pump for re-circulation of wash water and entire washed water was being re-circulated during the visit. 15. The stone crusher has provided water meter at the tubewell for fresh water. In view of above, it is recommended that consent to operate under Water (Prevention & Control of Pollution) Act, 1974 & Air (Prevention & Control of Pollution) Act, 1981 may be granted upto 30.06.2015 only after the industry submits the extended bank guarantee of Rs. 1.00 lac and in view of the Head Office order No. 291 Dated 01.07.2013 with the special condition that the industry must get itself registered regularly with Department of Industries/ concerned General Manager Cum Mining Office and a copy of the consent be endorsed to the General Manager Cum Mining Officer, Pathankot.
