Sub: Proceedings of the personal hearing taken by the Senior Environmental Engineer, Zonal Office-II, Ludhiana on 21-12-2016 for refusal of consent to operate under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981- M/s Shyam Pushp Engineers, Plot No. 11, R.P. Industrial Estate, Ishwar Colony, Dhandari Khurd, Gobindgarh, Sua Road, Ludhiana.

At the outset of the hearing, Environmental Engineer informed that the industry has applied for fresh consent to operate under Water Act, 1974 and Air Act, 1981 through OCMMS (Online System) with requisite documents.
The application of the industry was examined and observed that the industry has not submitted any proof regarding the date of installation of tube-well/submersible pump. Further, the industry has failed to provide its date of establishment.
Show cause notice for refusal of consent to operate under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 were issued to the industry with an opportunity of personal hearing before Senior Environmental Engineer, Zonal Office-II, Ludhiana on 14-12-2016 which was postponed to 21-12-2016.
Sh. Gagan Gupta, S/o Proprietor attended the hearing and submitted a copy of the bill regarding the date of installation of tube-well/submersible pump. He submitted that there is no municipal supply available and they are dependent for water supply from own sources, but the quantity of water consumption is very less i.e. 6500 Ltr/month (260 Ltr/day) in addition to 200 Ltr/day of domestic consumption. He further added that the municipal water supply is nearby available and the industry is trying to obtain the connection from municipal supply. He added that the water consumed for trade ultimately goes to CETP Operator from where it is being reused after treatment. Thus, practically there is no additional abstraction for trade purposes. He further assured to obtain permission from CGWA/District Advisory Committee for abstraction of ground water. He added that the industry has been commissioned in April, 2016 in this premises. He also informed that agreement has been made with the CETP Operator. He requested to grant consents.
After hearing the officer of the Board and the representative of the service industry, the Senior Environmental Engineer, Zonal Office-II, Ludhiana decided to grant the consents to operate for short term upto 31-03-2017 with special condition that the industry will either take water supply from municipal sources or shall obtain the permission from CGWA/ District Advisory Committee for abstraction of ground water by or shall obtain exemption from the CGWA from obtaining permission for abstraction of ground water for the reasons claimed during hearing by 31-03-2017.
The Proceedings of the hearing are added herewith for confirmation and approval by the Competent Authority so as to convey the same to all concerned for necessary compliance please.
