It is submitted that industry was granted consent to operate under Water (Prevention & Control of Pollution) Act, 1974 vide No. ZO-ASR/ASR/Plastic/CTO/WPC/2012/F-340 dated 24/4/2012 & Air (Prevention & Control of Pollution) Act, 1981 vide No. ZO-ASR/ASR/Plastic/CTO/APC/2012/F-338 dated 24/4/2012 for manufacturing of Polythene Bags @ 400 Kg/day by using Fresh & Recycled Plastic Dana @ 400 Kg/day as a raw material, which was valid up to 31/3/2016.
Considering, the Punjab Govt. notification no. 5/18/2016-4lg4/692717/1 dated 18/2/2016 issued by Local Govt., and notification no. S.O.438/P.A.9/1994/S30/2016 dated 29/3/2016 issued by Dept. of Rural Development and Panchayats has completely prohibit the manufacture, stock, distribute, re-cycle, sell or use of Plastic Carry Bags in the State of Punjab w.e.f. 1/4/2016 under sub-section (2) of section 7 of Punjab Plastic Carry Bags (Manufacture, Usage & Disposal) Control Act, 2005, the directions u/s 31-A of Air (Prevention & Control of Pollution) Act, 1981 & u/s 33-A of Water (Prevention & Control of Pollution) Act, 1974 were issued to the industry vide ZO letter endst. No. 2530 & 2528 dated 13/6/2016 respectively to stop manufacturing of Plastic Carry Bags immediately and shall not manufacture, stock, distribute, re-cycle, sell or use of plastic carry bags as per the notification of Govt. of Punjab.
Now, the industry has applied for obtaining consent to operate under Water (Prevention & Control of Pollution) Act, 1974 & Air (Prevention & Control of Pollution) Act, 1981 through OCMMS. The industry has deposited Rs. 16,800/- vide R.No. 86/4522 dtd 9/9/2016 as consent fee under Water Act, 1974 & Rs. 16,800/- vide R.No. 85/4522 dtd 9/9/2016 as consent fee under Air Act, 1981, which is adequate up to 31/3/2023 under both Acts. The industry has also deposited Rs. 2400/- vide R.No. 84/4522 dtd 9/9/2016 as NOC regularization fee & Rs. 500/- vide R.No. 72/4523 dtd 20/9/2016 as an application form fee.
To process the consent applications, the industry was visited by officer of this office on 21/12/2016 and observed as under:-
1. The industry was engaged in the process of manufacturing of plastic packaging material & garbage bags by using virgin & next to virgin plastic granules as a raw material as observed at the time of visit.
2. The industry has installed H.M. machines for the extruding of plastic granules.
3. No D.G. set exists in the premises of the industry.
4. Domestic effluent is into the sewer.
The industry has also submitted an undertaking that industry is using virgin and next to virgin plastic granules for the manufacturing of the final product w.e.f. 10/11/2016 and prior to dated 10/11/2016 the industry was using virgin, non-virgin/next to virgin plastic granules for the manufacturing of the final product.
In view of the above, if approved, the application may be send to Zonal Office, Amritsar with recommendations that the consent to operate under Water (Prevention & Control of Pollution) Act, 1974 & Air (Prevention & Control of Pollution) Act, 1981 may be granted to the industry up to 30/9/2021 with the conditions as under:-
a) The industry will not manufacture, stock, distribute, re-cycle, sell or use the Plastic Carry Bags as per the notification of Govt. of Punjab. (Agenda note is attached for kind peruse) |
