Subject: Application for obtaining ‘Consent to operate’ under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 & Air (Prevention & Control of Pollution) Act, 1981 by M/s M/s R.S. Trading Company located in the revenue estate of village Harnampura (H.B. No. 320), Tehsil Kharar, Distt. S.A.S. Nagar..
It is submitted that the industry has applied for obtaining consent to operate for screening cum washing plant of capacity 5000 cft/day in the revenue estate of village Harnampura, Tehsil Kharar, Distt. SAS Nagar. The total land area of the unit is 1.102 Acre. The industry was granted Consent to Establish (NOC) of the Board vide no. CTE/Fresh/SAS/2016/4374506 dated 30.09.2016, for crushing, screening-cum-washing of aggregates @ 5000 cft/fay, which is valid till 29.09.2017.
Now, the industry applied for obtaining Consent to operate of the Board under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 along with requisite documents like C.A. certificate, compliance report of the NOC granted to the industry, site plan etc. along with the requisite consent fee under said Acts. The industry has deposited Rs. 12000 as consent fee, under each Act, which is adequate for 05 years.
Earlier, while applying for Consent to Establish (NOC) of the Board, the industry had mentioned the total cost of the unit as 36.31 lacs, however, the industry has now submitted the CA certificate mentioning the total cost of the project as 27.90 lacs, as such, a clarifications was raised in this regard, to which, the industry has replied that the decrease in the cost is due to the fact that the industry has installed only screening-cum-washing plant and has not installed the crushing unit.
Accordingly, the site of the industry was visited by the undersigned on 30.12.2016 and Sh. Ravinder Singh, proprietor of the industry was contacted. During visit it was observed as under:
1. The industry has installed machinery of screening cum washing plant only.
2. The conveyor belts have been provided of good quality.
3. The industry has provided chutes 5’ high, at the end of the conveyor belts.
4. The industry has provided road to the ramp stabilized with river bed material.
5. The industry has provided settling tanks of size about 30' x 12’ x 12' at one place and another tank of size about 15’ X 12’ X 10’ at about 20m away from the said tanks for wash water and recirculation system for the same has been provided. The industry has constructed the bigger tank and its partition wall with thick MS sheet and not with concrete. The representative of the industry informed that this is due to the fact that the land area is marshy, as such, the concrete walls would not be stable and would collapse, as such, the industry has constructed the same with MS sheet. The industry has also provided some katcha area prior to the pucca tanks, for settling of the silt and thereafter, the wastewater is being sent to the puuca tanks for recirculation of the same.
6. The industry has provided some plantation along the boundary of the site and the representative of the industry was asked to provide more plantation in the upcoming season.
7. The industry has not yet constructed any toilet in its premises.
8. The industry has installed D.G. set of capacity 125 KVA, which is provided with canopy and stack of adequate height.
9. The industry has provided sprinklers at the main entry towards the ramp for suppression of dust particles.
In the NOC issued to the industry, as per the special condition no. 4, it was mentioned that the industry shall obtain permission from the CGWA for abstraction of the groundwater to the tune of 36 KLD. Now, industry has submitted a copy of letter of CGWB, bearing no. 3283 dated 02.12.2016, addressed to The Member Secretary, CGWA, New Delhi, vide which the case for withdrawal of ground water @ 30 KLD has been recommended.
The industry has deposited Rs. 24,500 vide R. No. 100/4350 dated 06.12.2016, against the total investment of Rs. 27.9 lacs, as such, the fee deposited by the industry on account of the Consent fee under the Water(Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 is adequate upto five year, i.e 30/09/2021.
In view of above, if approved the industry may be granted consent to operate of the board under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 for operation of screening-cum-washing plant only, upto 30.09.2021 along with suitable conditions and following additional conditions:
1. The industry will not install machinery of stone crusher without the prior written permission of the Board.
2. The industry shall construct a septic tank as and when the industry provides the facility a toilet in its premises, for treatment of the domestic effluent.
3. The industry shall not abstract ground water more than 30 KLD.
