Although the results quoted above as beyond limits but in this case, the industry is a hotel industry & situated within the MC limits with discharge into MC sewer. For the hotel industry with discharge into MC sewer and the MC having its terminal STP, the standards prescribed are different. However, in the case of Curo India Limited, the standards with terminal STP were not applied and only general standards were considered. However, the Board vide its notification no. 4995 dated 10.10.2011 has decided that in case of discharge into sewer within MC limits having terminal STP, only general standards as per schedule 6 of EP Rules 1986 will be applicable. Hence in this case the applicability of standards needs deliberation.
Further, the industry has failed to submit the area classification certificate from the competent authority.
As per other details, incorporated by the visiting officer, it is recommended that application for consent to operate under Water (Prevention & Control of Pollution) Act, 1974 may be refused to the hotel please.
