It is submitted that earlier, the industry was granted consent to operate under the Water Act, 1974 vide No. CTOW/fresh/SAS/2016/4456584 dated 19/09/2016, which is valid upto 30/06/2021 and the Air Act, 1981 vide no. CTOA/fresh/SAS/2016/4455827 dated 19/09/2016, which is valid upto 30/06/2021 subject to conditions mentioned there in.
Now, the industry has applied for obtaining NOC for carrying out expansion of the unit and addition of resin plant in the existing industrial premises with requisite documents and fee. The industry has deposited Rs. 1500/- vide R.no. 45/4169 dated 26/05/2016, which is adequate against the project cost of Rs. 23 lakh. The industry has already obtained permission vide Memo No. 4098-STP(S)/SS-11 (GI) dated 30/10/2014 from the STP, Department of Town & Country Planning for change of land use from agricultural to industrial for the land measuring 1.4048 acres, located in the revenue estate of village Sarsini, Tehsil Dera Bassi, Distt. SAS Nagar. The industry has submitted a certificate issued by STP, Department of Town & Country Planning, SAS Nagar issued vide no. 900 STP(S)/SS-11(GI) dated 31/03/2016 and the contents of, which are reproduced in the agenda note attached herewith.
The industry has submitted a letter issued vide no. 312 dated 08/03/2016 by SDM, Dera Bassi, the contents of which are given in the agenda note attached herewith.
The industry has been granted license to operate plywood industries vide no. 18/2014-2015 by the Divisional Forest Officer. As per license granted by DFO, SAS Nagar, the industry has been permitted to install the following machinery in the industrial premises, which is reproduced in the agenda note attached herewith.
As per the project report submitted by the industry, it has proposed to install one hot press and one number kettle having capacity 4 kl for manufacturing of resin/glue by mixing the formaldehyde, phenol and caustic soda. There will be generation of trade effluent from washing of kettle and the boiler blow down. The manufacturing process of the resin will be as under :
Mixing of formaldehyde with phenol adding of caustic to make the solution alkaline heating upto 55 0C -600C addition of water to control the viscosity of resin store in the tank.
The industry has proposed to install one evaporation tank having demissions 5’x5’x5’ which will be provided with steam line from the boiler to enhance the evaporation rate. The industry has provided septic tank for treatment of domestic effluent and the treated domestic effluent will be utilized on to land for plantation.
Present Status
The industry was visited by AEE of this office on 27/01/2017 and observed that :
1. The industry was not in operation. The representative of the industry informed that the unit has not yet been commissioned properly and still is on trial runs only.
2. The industry has installed following machinery in its industrial premises.
a. One no pillar.
b. Two nos. vertical band saw
c. Four nos. seasoning chamber.
d. One no. drier.
e. One no. press.
f. One no. sanding machine.
The above mentioned machinery is matching with machinery mentioned in the permission granted by the Divisional Forest Officer vide no. 18/2014-2015.
3. The industry has installed one wood fired boiler of capacity of 4 TPH, which is equipped with cyclone as APCD to contain the concentration of particulate matter within the standards prescribed by the Board.
4. The industry has provided cyclone as APCD in the sanding section to contain the concentration of particulate matter within the standards prescribed by the Board.
5. The industry has installed one DG set of capacity 250 KVA, which is equipped with canopy and stack of adequate height.
6. The industry has provided a evaporation tank having dimensions 5'x5'x5', which is provided with steam line of the boiler to enhance the evaporation rate of wastewater to be generated from washing of kettle and boiler blow down . The industry has provided septic tank for treatment of domestic effluent and provision has been made to utilize the same for irrigation of green lawn developed in the premises of the unit.
7. The industry has provided mechanical meter at the source of water supply.
8. The industry is complying with the conditions granted under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981.
Suitability of site for expansions and addition of resin Plant :- The master plan of Lalru has been notified and the village Sarsini falls in the industrial mix zone in which only green category industries are allowed as per the bye-laws of the master plan of Lalru. It is further intimated that as per bye-laws of the master plan Lalru :
“All existing industrial units which have been marked or spot zoned before the preparation of Land Use Plan will be allowed to expand within the existing premises. And the site on which various projects have been approved or whose change of land use has already been permitted by competent authority/Govt., such sites shall be deemed to be adjusted as sanctioned/ permitted.”
In this case, the industry has already obtained permission vide Memo No. 4098-STP(S)/SS-11 (GI) dated 30/10/2014 from the STP, Department of Town & Country Planning for change of land use from agricultural to industrial for the land measuring 1.4048 acres, located in the revenue estate of village Sarsini, Tehsil Dera Bassi, Distt. SAS Nagar. From above, it is clear that the site of the industry has been adjusted as sanctioned/permitted as per the bye-laws of the master plan of lalru.
It is intimated that as per the revised categorization of the industries, Ply-board manufacturing (including Veneer and laminate) with oil fired boiler/ thermic fluid heater (without resin plant) are covered under orange category having sr. no. 2056. Further, the manufacturing of synthetic resin is also covered under orange category at serial no. 75 (2075), therefore, the unit may be categorized as orange category unit.
Applicability of EIA notification dated 14/9/2006/ Press Note 17 (1984 series) First Schedule of Factories Act, 1948
The industry is neither covered under the First Schedule of Factory Act, 1948 nor Press Note-17 (1984 series). Also, the industry does not attract the provisions of EIA Notification dated 14/09/2006.
In view of above, it is recommended that :
1. Consent to establish for carrying out expansion of the unit and addition of resin plant in the premises of the existing unit may be granted to the mid subject to suitable conditions and additional conditions that :
a. The industry shall get the building plans prepared and get it authenticated from the Director of Factories, Punjab or chartered Engineer/ Chartered Architect authorized to do so under the provisions of section 3-A of Punjab Factory Rules, 1952.
b. The industry shall obtain permission from CGWA for abstraction of ground water.
c. The industry shall only install the machinery for which it has been granted permission by the DFO, SAS Nagar vide no. 18/2015-15 dated 08/03/2016.
2. A copy of the NOC to be granted to the industry may be sent to the Department of Town & Country Planning, SAS Nagar with the request to intimate the Board, within 15 days, if their department has any objection to the location of the unit at proposed site as per notified Master Plan. In case, no reply is received from their department within 15 days, then, it will be presumed that the proposed site is suitable for establishment of the industrial plant as per notified Master Plan of Lalru.
