The industry was earlier granted consent to operate under Water Act, 1974 and Air Act, 1981 both valid upto 21.10.2016 with special conditions that:-
1) The industry will submit the approved building plan duly authenticated by the Director of Factories or Chartered Architect/Chartered Engineer authorized by the Director of Factories, Punjab (OR) shall obtain the exemption certificate from the concerned department w.r.t its claim that approved plan not required as the no. of person are less than 10 and the certificate regarding land use pattern of the industry from the competent authority.
2) The industry will shift its process from present site to designated area as and when asked by the State Govt./Punjab Pollution Control Board/ As per policy of the state Govt.
3) The industry shall not manufacture DG set and are not allowed to be manufacture without inbuilt acoustic enclosure and CPCB certification.
The industry has now applied for renewal of consent to operate under Water Act, 1974 and Air Act, 1981, the industry was visited on 01.03.2017 and the observations are as under:-
(1) The industry is a small scale unit and engaged in assembling of Diesel Engines and DG sets.
(2) The manufacturing process of the industry is: Raw Material (Various parts of diesel engine including castings) Machining Assembling Testing Spray Paint Ready.
(3) The industry has provided the spray painting booth with water curtain
(4) It has a D.G. set of 10 KVA to which canopy has been provided with adequate stack height. The cooling water used for testing of engine is being reused.
(5) The domestic effluent is being discharged into sewer.
(6) The industry has not submitted any approved building plan duly authenticated by the Director of Factories or Chartered Architect/Chartered Engineer authorized by the Director of Factories, Punjab nor has obtained any exemption certificate from the concerned department w.r.t its claim that approved plan is not required as the no. of person are less than 10.
(7) The industry has also not submitted any document clarifying the land use pattern of the industry. However, the industry is an old unit operating since Dec/1979. Hence, land use pattern is not required being existing unit operating well before the date of notification of the Master Plan, Ludhiana.
(8) As per Head Office letter no. SEE(HQ-2)/2016/16473-80 dated 08.03.2016 intimated that the Ministry of Environment & Forests, Govt. of India vide its notification no. GSR. 371(E) dtd. 17.05.2002 has notified the Environment (Protection) second amendment Rules, 2002 for the control of noise pollution from stationary DG sets. As per the clause 3 (ii) of this notification, every manufacturer or importer (referred to as supplier) of D.G. sets must have valid certificates of conformity of production for each year, for all the product models being manufactured or imported from July, 2003. Also, as per the clause 3(iii) of this notification, no person shall sell, import or-use of a product model, which is not having a valid approval certificate and conformity of production certificate. The industry is currently manufacturing DG sets without acoustic enclosures or CPCB certification.
Keeping in view of the above, it is recommended that consents under Water (Prevention & Control of Pollution) Act, 1974 and under Air (Prevention & Control of Pollution) Act, 1981 may be refused, please.
