It is submitted that earlier, the Auto Service Station has applied for obtaining extension in validity of consent to operate under Water (Prevention & Control of Pollution) Act, 1974 & Air (Prevention & Control of Pollution) Act, 1981 through OCMMS. The Auto Service Station has deposited Rs. 9,000/- vide R.No. 40/4521 dtd 16/8/2016 under Water Act, 1974 and Rs. 9,000/- vide R.No. 39/4521 dtd 16/8/2016 Air Act, 1981, which is adequate up to 31/3/2020 under both Acts. The Auto Service Station has also deposited Rs. 900/- vide R.No. 95/4521 dtd 24/8/2016 as NOC regularization fee & Rs. 500/- vide R.No. 41/4521 dtd 16/8/2016 as an application form fee. The Auto Service Station has also got analyzed its trade effluent sample from M/s SIMA Labs (P) Ltd, New Delhi on 8/8/2016 & the report reveals that the analyzed parameters were within limits as prescribed by the Board. The consent to operate under Water (Prevention & Control of Pollution) Act, 1974 & Air (Prevention & Control of Pollution) Act, 1981 was granted which was valid up to 28/2/2017 along with the Directions u/s 33-A of Water (Prevention & Control of Pollution) Act, 1974 to de-seal the wet section of the Auto Service Station for further 06 months vide ZO letter no. 5203 dtd 30/8/2016. The washing effluent sample was collected by this office on 29/11/2016 & the analysis report issued by ZO Lab, Jalandhar reveals that the analyzed parameter of BOD=46 mg/l & O&G=12 mg/l are beyond the permissible limit as prescribed by the Board. Consequently it was recommended to Zonal Office, Sri Amritsar and Show Cause Notice for the violation under the provisions of Water (Prevention & Control of Pollution) Act, 1974 was issued with an opportunity of personal hearing before SEE on 28/2/2017 vide ZO letter endst. No. 157 dtd 16/2/2017. The decision of the personal hearing are as under:-
1. The industry shall apply for consent under Water (Prevention & Control of Pollution) Act, 1974 as amended in 1988 & Air (Prevention & Control of Pollution) Act, 1981 as amended in 1987 as well as for authorization under Hazardous and Other Wastes (Management and Transboundary Movement) Rules, 2016 immediately and the Regional Office shall process the same on merits.
2. The Regional Office shall carry out sampling of effluent as per policy of the Board to decide the fate of BG submitted by the industry, immediately.
In compliance to the decision of personal hearing, the Auto Service Station has again applied for obtaining extension in validity of consent to operate under Water (Prevention & Control of Pollution) Act, 1974 & Air (Prevention & Control of Pollution) Act, 1981 through OCMMS. The Auto Service Station was visited by officer of this office on 6/3/2017 and observed as under:-
1. The Auto Service Station is engaged in the sale & service of two wheelers.
2. The Auto Service Station has installed an ETP for treatment of effluent generated from the washing process whose outlet is into sewer.
3. The Auto Service Station has installed a D.G. set of 25 KVA which is fitted with canopy.
The Auto Service Station has already submitted a Bank Guarantee of Rs. 2.00 lacs which is valid up to 22/8/2017.
In view of the above, it is recommended that:-
1. The validity of consent to operate under Water (Prevention & Control of Pollution) Act, 1974 may be extended for six months period so that sampling may be collected as per policy of the Board.
2. The validity of consent to operate under Air (Prevention & Control of Pollution) Act, 1981 may be extended up to 30/9/2019.
3. The directions u/s 33-A of Water (Prevention & Control of Pollution) Act, 1974 may be issued for the de-sealing of wet section for further six months period. (Agenda note is attached for kind peruse) |
