It is intimated that the industry was earlier granted consent to operate under Water (Prevention & Control of Pollution) Act, 1974 & Air (Prevention & Control of Pollution) Act, 1981 vide no. R15LDH3CTOW3440468 & R15LDH3CTOA3440458 dated 21.12.2015 valid upto 31.03.2016 with special condition that, "The industry shall submit continuance certificate from the Competent Authority, within two months."
Now the industry has applied for renewal of consent to operate under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 alongwith requisite documents. The industry has already deposited consent fee of Rs. 18000/- each under under Water and Air Acts, which is adequate upto 31.12.2020.
The industry was visited on 17.05.2017 by officer of this office and observed as under the industry is engaged in the manufacturing of ice cream which was in operation. The industry has installed ETP. The physical appearance of the ETP shows that, it was lying defunct and no effluent was observed in the ETP section and all the untreated effluent is being directly discharged into sewer. The industry has submitted analysis report of effluent samples collected on 17.04.2017 from M/s SIMA Lab Pvt. Ltd., and as per the analysis report, the all the parameters are within the prescribed limits of the Board. As per the photographs enclosed with the analysis report, which does not shows that point of outlet, from where the effluent sample was collected by the lab. The industry has not installed any DG set and other boiler furnace at site (photographs enclosed). The industry has submitted the DTP letter vide no. 2407 dated 03.06.2010, in which mentioned that the site is located in residential zone as per Master Plan of Ludhiana. However, the industry has submitted continuity certificate from the ATP vide no. 934/ATP-D dated 20.03.2017 to operate its unit at the existing site upto Aug, 2018.
Keeping in view of the above, it is, therefore, recommended that consent to operate under Water (Prevention & Control of Pollution) Act, 1974 may be refused and show cause notice may be issued to the industry.
