he promoter company was granted Consent to Establish (NOC) by the Board under the Water (Prevention and Control of Pollution) Act, 1974 and the Air (Prevention and Control of Pollution) Act, 1981 for construction of a group housing project having 236 flats and built up area of 33,915.47 sqm., vide no. ZP-I/SAS Nagar/NOC/2013/F-343 dated 17.05.2013 upto 17.05.2014, and the validity of which was lastly extended upto 30.09.2016. the promoter company has also applied for obtaining extension on the validity of the said NOC and the said application is being processed separately through online system.
The promoter company was granted environmental clearance under the EIA notification dated 14.09.2006, vide no. SEIAA/2014/6105 dated 24.01.2014 under EIA notification dated 14/09/2006, for a project area of 33993.624 sqm. (i.e. about 8.4 acres) and having a built-up area of 33915.47 sqm. However, as per approved layout plan of the project, total area of the project is 4.218 acres (17033 sqm.), as such, a clarification was raised through online system, to which, the promoter company has submitted a written reply that actual land of the project is 17033 sqm. and not 33993 sqm., as mentioned in the Environmental, as such, the promoter company is required to get the necessary amendments done in the Environmental clearance from SEIAA, Punjab.
The promoter company has submitted a copy of the letter dated 24.09.2013 vide which CGWB, Chandigarh has recommended the case to the Member Secretary, CGWA, New Delhi for their project. However, quantity of fresh water to be abstracted by the promoter company has not been mentioned in the said letter. The promoter company has not submitted the final approval of the CGWA for abstraction of ground water.
Now, the promoter company has applied for obtaining partial Consent to Operate for operation of outlet of 72 no. of flats.
Accordingly, the site of the project was visited by AEE of this office on 15.06.2017 and Sh. Gaurav, representative of the promoter company was contacted. During the visit, it was observed as under:
i. The promoter company has completed the construction work of 03 blocks having 72 no. of flats. There are total of 10 no. of blocks to be constructed in the project, which shall have total of 236 no. of flats. Construction of rest of the blocks is yet to be started at the site of the project.
ii. The representative of the promoter company informed that only about 10 families have started residing within the premises of the project.
iii. The promoter company has installed one tubewell in its premises for abstraction of ground water. The promoter company has installed flow meter with the same, however, the promoter company is yet to start maintaining record of the readings of the said meter.
iv. The promoter company has installed an STP of capacity 150 KLD for treatment of domestic effluent being generated from the project. The promoter company has installed an EMF meter at the outlet of the said STP, however, the promoter company is yet to start maintaining record of the readings of the same.
v. The promoter company has laid pipeline for usage of treated wastewater for irrigation of green area developed within the premises and flexible pipes are used for irrigation of plantation developed along the boundary wall of the project.
vi. The promoter company has not provided dual plumbing system in 03 towers, for which it has applied for obtaining partial Consent to Operate of the Board.
vii. The promoter company has joined outlet of the main sewer line of the project with the sewer line carrying wastewater of “Shivalik City”. The representative of the promoter company informed that sewer line of Shivalik City has now been connected with the sewerage system of MC, Kharar, however, he could not produce any documentary evidence in this regard. Also, during visit to the site, the same could not be verified. Further, Er. Deepak, SDE, PWSSB was contacted telephonically (#9988753149) and he informed that the sewerage system of “Shivalik City” has not yet been connected with the sewerage system of Kharar City.
viii. The representative of the promoter company informed that the solid waste is being sent to MC dumping ground.
ix. The representative of the promoter company informed that rain water harvesting pits are yet to constructed in the project.
x. The promoter company has installed one D.G. set of capacity 125 KVA, which has been provided with canopy, however, stack of adequate height is yet to be provided with the same.
It is added here that the promoter company was granted Environmental Clearance under EIA notification dated 14.09.2006 for the following proposals as regards to disposal of treated wastewater
“Total water consumption shall be 160 KLD, out of which, 118 KLD will be met from ground water with the help of tubewell and remaining 42 KLD will be met from treated wastewater. About 128 KLD of wastewater will be generated, which will be treated in a STP of capacity 150 KLD. At the outlet of the STP, about 126 KLD of treated wastewater will be available, out of which, 9 KLd will be used for irrigation of green area, 42 KLD will be used for flushing and remaining 75 KLd will be discharged into MC sewer during summer season. In winter season, 42 KLD of treated wastewater will be used for flushing purpose, 6 KLD for irrigation of green area and remaining 81 will be discharged to MC sewer. In rainy season, 42 KLD of treated wastewater will be used for flushing purpose and remaining 83.2 KLD will be discharged to MC sewer.”
Further, in the Environment Clearance granted to the promoter company, total expected population of the project has been mentioned as 1180 persons. As such, taking into account of usage of treated wastewater @ 35 lt/p/day for 1180 persons, the consumption of treated wastewater for flushing purpose comes out to be 41.3 KLD. As such, it is evident that the promoter company had initially proposed to use treated for flushing purpose in all the flats. However, the promoter company has not provided dual plumbing system with 03 towers, for which it has applied for obtaining partial Consent to Operate of the Board, as such, the promoter company is violating the condition of the Environmental clearance granted to it by SEIAA, Punjab.
In view of above, it is recommended that the promoter company may be issued show cause notice for refusal of partial Consent to Operate under the Water (Prevention and Control of Pollution) Act, 1974 and the Air (Prevention and Control of Pollution) Act, 1981, along with an opportunity of personal hearing, due to following observations:
1. The promoter company is violating the conditions of the Environmental clearance granted to it w.r.t. the quantity of treated wastewater to be used for flushing, as the promoter company has not provided dual plumbing system with 03 towers, for which it has applied for obtaining partial Consent to Operate of the Board, whereas, the said Environmental clearance was granted on the basis of proposal that the promoter company shall use treated wastewater for flushing purpose in all the flats.
2. The promoter company has not started maintaining the record of the readings of the flow meters provided with the tubewell and the outlet of the STP.
3. The promoter company has not provided stack of adequate height with the D.G. set of capacity 125 KVA installed within the premises of the project.
4. The promoter company has connected its sewer line with the sewerage system of “Shivalik City”, however, the promoter company has not submitted any documentary evidence as to whether the sewerage system of “Shivalik City” has been connected with sewerage system, of MC Kharar or not, but Er. Deepak, SDE, PWSSB was contacted telephonically (#9988753149) and he informed that the sewerage system of “Shivalik City” has not yet been connected with the sewerage system of Kharar City.
