File Note: Brief history of the case is as under:- • Earlier, the industry was also issued show cause notice for violations of the provisions of the Water (Prevention & Control of Pollution) Act, 1974 & Air (Prevention & Control of Pollution) Act, 1981 along with an opportunity of personal hearing before the Senior Environmental Engineer, Zonal office, Jalandhar on 17.02.2016, wherein it was decided as under:- 1. The industry shall apply for consent to operate under Water (Prevention & Control of Pollution) Act, 1974 & Air (Prevention & Control of Pollution) Act, 1981 as amended in 1987 within 10 days. 2. The industry shall submit bank guarantee of Rs. 1.00 lac with validity for one year within 07 days as an assurance to comply with the provision of Water Act, 1974 &the Air Act, 1981. • The industry failed to submit any bank guarantee as per the decisions of the personal hearing held on 17.02.2016 in this office, so far and report in this regard was sent vide this office letter no. 3107 dated 26.04.2016. • After that the industry applied consent to operate under Water (Prevention & Control of Pollution) Act, 1974 & Air (Prevention & Control of Pollution) Act, 1981 and same was granted under Water (Prevention & Control of Pollution) Act, 1974 upto 30.09.2016 & under Air (Prevention & Control of Pollution) Act, 1981 upto 09.03.2017. The Zonal Office vide its letter Endst. No. 8162 dated 12.09.2016 requested this office pursue the industry for submission of bank guarantee of Rs. 1.00 lac and the same was also conveyed to the industry vide this office letter No. 5457 dated 20.09.2016, but, the industry has not submitted the bank guarantee of Rs. 1.00 lac in this office, till now. • Now, the industry has applied for renewal of consent to operate under Water (Prevention & Control of Pollution) Act, 1974 & Air (Prevention & Control of Pollution) Act, 1981 via OCMMS. The industry has submitted CA Certificate, earlier granted consents along with application form. The industry has deposited Rs. 49500/- vide receipt No. 43/4225 dated 24.08.2015 as air consent fee, Rs. 49500/- vide receipt No. 44/4225 dated 24.08.2015 as water consent fee, Rs. 4500/- vide receipt no. 45/4225 dated 24.08.2015 as NOC regularization fee, Rs. 500/- vide receipt no. 46/4225 dated 24.08.2015 as form fee and now deposited Rs. 3000/- vide receipt No. 05/4601 dated 22.06.2017 under Air Act, 1981, Rs. 3000/- vide receipt No. 06/4601 dated 22.06.2017 and Rs. 500/- vide receipt No. 07/4601 dated 22.06.2017 as an application form fee. The fee deposited by the industry is adequate upto 30.09.2022. • As per the previous air emissions sample analysis report dated 16.06.2016, the concentration of SPM is 316 mg/Nm3 , which is within the prescribed limits of the Board. • The industry was now visited by the AEE of this office on 27.06.2017 and it was observed as under:- 1. During visit, Sh. Babu Ram (supervisor) was available at site and the industry was in operation during the visit. 2. The industry has installed 01 peeling machine, 01 dryer, 01 grinding machine and 01 compressing machine. The industry has also provided 03 bandsaw machine and 01 drying chamber. 3. The industry uses poplar wood and resin as raw material for the manufacturing of plywood and plyboard @ 3200 Sq.mtr./day. 4. The industry has installed 01 thermax boiler of capacity 4 TPH with dust collector as APCD. During visit, the boiler was not in operation due to rainy weather and air emission samples could not be collected. 5. The fuel used for boiler is fire wood and wood scrap @ 2 TPD. 6. The industry has provided one DG Set of capacity 250 KVA, which is with canopy. 7. The industry uses readymade glue / resin for the manufacturing of plywood and no trade effluent generated. The industry has provided one septic tank at backside of the industry for the disposal of domestic effluent. 8. During visit, the effluent was overflowing from the septic tank and the same was discharged onto land for stagnation. 9. During visit, it was also observed that the industry has made arrangements for the bathing of the labour in the nearby motor and sullage water from here is diverted to the plantation area through open katcha channel. In view of above, it is recommended that consent to operate under Air (Prevention & Control of Pollution) Act, 1981 may be refused as the industry has not submitted the bank guarantee of Rs. 1.0 lac.
