File Note: It is submitted that Regional Office has forwarded the case for grant of consents to operate under the Water Act, 1974 & Air Act, 1981 to the marriage palace as per the details mentioned in the agenda note. The agenda note has been examined & observed as under:- 1. Directions under section 33-A of the Water Act,1974 were issued to the marriage palace vide Boards letter no. 663 dated 01/03/2017 for its closer. Directions were also issued to the PSPCL authorities to disconnect the power supply available with the marriage palace with immediate effect as the marriage palace failed to comply with the provisions of the Water Act,1974 and was operating without obtaining consents to operate from the Board as required under the provisions of the Water Act, 1974 & air Act, 1981. 2. The marriage palace has applied for obtaining the consents to operate of the Board under the provisions of the Water Act, 1974 and Air Act, 1981 vide its online application dated 15/06/2017. Further, the palace has deposited consent fee under both the Acts, which is adequate upto 30/09/2021. The palace has submitted following documents along with its application :- a) Letter from DTP, Ferozepur vide their no. 853 dated 30/05/2017 regarding its land classification of the palace that the site of the palace is suitable for establishment of palace. b) Excise Challan form no. M45-A, as commissioning proof of the palace in the year 2012. c) Receipt of JITF regarding the lifting of solid waste from the palace after the function. 6. The site of the marriage palace was visited on 24/06/2017 to verify the compliance of the provisions of the Water Act, 1974 and Air Act, 1981 and it was observed as under:- a) The palace has functional hall of capacity of 1000 persons, however no function was being carried out at the time of visit. b) The palace has installed STP for the treatment of waste water for the kitchen section and septic tank for the toilet section and both were in operationable condition. The treated waste water was discharged onto land for plantation. c) The marriage palace has developed 01 acre land as per Karnal Technology adjoining to its premises and is also green area, for disposal of its treated domestic waste water and the area available is adequate. d) The palace has made sufficient plantation along its boundary wall. e) The palace has provided arrangement for collection / scientific disposal of municipal solid waste generated from the palace and has signed agreement with the M/s JITF Urban Waste Ltd. for safe disposal of its municipal solid waste. f) The palace has installed 01 no. DG set of capacity 200 KVA with canopy and stack of adequate height. The palace has constructed acoustic room for the DG set of capacity 50 KVA. g) The marriage palace has made the functional hall acoustic by providing insulating material on the walls & roof of hall, so as to concentrate the noise level within the permissible limits. h) The palace is thus complying with the provisions of the Water Act, 1974 and Air Act, 1981 Regional Office has recommended that – a) Consent to operate under the Water Act, 1974 may be granted to the palace for a period upto 31/12/2017 for the operation of marriage palace @ 80 Function per year with discharge of domestic effluent @ 30 KLD onto land for plantation, subject to the suitable conditions. b) Consent to operate under the Air Act, 1981 may be granted to the palace for a period upto 31/12/2017 for the operation of marriage palace @ 80 Function per year, subject to the suitable conditions. c) Direction u/s 33-A of the Water Act, 1974 may be issued to the PSPCL authorities for the temporarily release of electric connection upto a period of 31/12/2017. If approved, following action may be taken please:- a) Consent to operate under the Water Act, 1974 may be granted to the palace for six months for the operation of marriage palace with discharge of domestic effluent @ 30 KLD onto land for plantation, subject to the suitable conditions. b) Consent to operate under the Air Act, 1981 may be granted to the palace for six months for the operation of marriage palace, subject to the suitable conditions. c) Directions may be issued to the PSPCL authorities for restoration of electric supply to the marriage palace temporary for six months.
