It is submitted that earlier the Regional Office was reported that the validity of consent granted to the industry under the Water Act, 1974 may be extended upto 31/03/2018 subject to the suitable conditions and following additional conditions: a) The industry shall develop adequate land area as per Karnal Technology within three months for scientific disposal of treated wastewater. b) The industry shall connect its sewerage system with the sewerage system of MC, Nangal for treatment of its domestic effluent in the STP of 8 MLD capacity or shall install its own STP of adequate capacity to treat its domestic effluent within 06 months. c) The industry shall connect the on-line continuous effluent monitoring system with the servers of CPCB & Punjab Pollution Control Board, within 07 days. d) The industry shall obtain authorisation under Hazardous and Other Wastes (Management and Transboundary Movement) Rules, 2016 and shall take steps to store the brine sludge of category 16.3 in an environmentally sound manner and shall submit time targeted action plan for shifting of same to the common TSDF, within 3 months. e) The industry is required to take proper precautionary/scientific measures to further stop the deterioration of quality groundwater, as there are lots of complaints from the residents of nearby villages regarding deterioration of the quality of groundwater in the vicinity of the industry. Also, the industry is required to prepare remediation action plan for improving the quality of groundwater within 03 months. It is pertinent to mention here that the CPCB, New Delhi vide its letter no. 24859 dated 17/03/2017 had issued directions u/s 5 of Environmental (Protection) Act, 1986 to the unit to close down operation of unit with immediate effect till online effluent and emission monitoring system are installed in notified process units / area and the same are uplinked with the CPCB websites. Also, the PSPCL authorities have been directed to disconnect industrial electricity supply of the unit, allowing supply only for domestic and security purpose. Accordingly Regional Office was asked to submit latest status report as above. Now, Regional Office has clarified that they have asked Chief Engineer, PSPCL to submit compliance of directions issued by CPCB vide its letter dated 17/03/2017. However, meanwhile the industry has submitted a copy of letter dated 27/07/2017 issued by CPCB, wherein, it has been mentioned as under: "In exercise, of powers vested to Chairman CPCB under Section 5 of the Environment (Protection) Act, 1986 and in view of compliance with relevant direction under reference, the direction issued under the Section 5 of the Environment (Protection) Act, 1986 to the unit (M/s Punjab Alaklies & Chemicals Limited) vide letter dated March 17, 2017, is hereby revoked with a condition that the unit shall obtain valid CTO from Punjab Pollution Control Board. The unit will ensure compliance with the norms. In case of non-compliance by the Unit, action as deemed fit under the provisions of Environment (Protection) Act, 1986 shall be taken. The copy of said directions has also been received in the Board. Since, M/s PACL & M/s JBR Technology Pvt. Ltd., Naya Nangal has already been afforded joint hearing before the Worthy Chairman of the Board on 06/09/2017 vide letter no. 4930 dated 09/08/2017. In view of above, the consent cases of the industry may please be decided during hearing, please. |
