It is intimated that the subject cited industry was granted consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 vide no. vide no. PTA/WPC/2008/F-351 dated 12.03.2008 for discharged of domestic effluent @ 500 ltrs/day onto land for plantation through septic tank and under the Air (Prevention & Control of Pollution) Act, 1981 vide no. PTA/APC/2008/F-793 dated 12.03.2008, both having validity upto31.03.2010 for manufacturing of Paper Board@ 4 MT/day under red category subject to suitable conditions mentioned therein.
The industry was issued show cause notice u/s 33-A of Water (Prevention & Control of Pollution) Act, 1974 as amended in 1988 and u/s 31-A of the Air (Prevention & Control of Pollution) Act, 1981along with an opportunity of personal hearing on 31.05.2017 before Chief Environmental Engineer. After hearing, it was decided as under: -
1. The industry will submit within a week the point wise compliance/reply of the violations observed during visit dated 22.03.2017 by the Officer of the Board.
2. Further action in the matter will be taken after considering the reply to be submitted by the industry.
The proceedings of the personal hearing were conveyed to the industry vide Board's letter no. 3394 dated 05.06.2017.
Now, the industry has applied for varied consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and under the Air (Prevention & Control of Pollution) Act, 1981 under green along with requisite documents i.e. application form, CA certificate, request letter, compliance report of consent conditions earlier granted to it, undertakings, land documents, building plan, manufacturing process etc. The industry has deposited Rs. 47000/- vide R. No. 93/5040 dated 13.09.2017as water consent fee under Water (Prevention & Control of Pollution) Act, 1974 and Rs. 47000/- vide R. No. 93/5040 dated 13.09.2017as air consent fee under Air (Prevention & Control of Pollution) Act, 1981. The consent fee deposited by the industry is adequate upto 31.12.2024 against the fixed assets of Rs. 81.0 Lac as on 14.08.2017 as per C.A. certificate dated 06.09.2017 submitted by the it. The industry has also deposited Rs. 2400/- vide R. No. 93/5040 dated 13.09.2017asNOC regularization fee for the increase in the fixed assets.
The industry has got its building plan approved by Er. Rishi Garg, competent person approved under Factories Act, 1948 on 25.07.2017.
In compliance to the decision of the hearing the industry has submitted a reply, addressed to the Chief Environmental Engineer of the Board, of the violations observed during visit dated 22.03.2017 by the officers of the Board. Your good office vide letter no. 3975 dated 29.06.2017 had send the copy of the above said reply and directed this office to make a fresh visit to the industry and submit report with recommendations.
Accordingly, the industry was visited by Asstt. Environmental Engineer and JEE of this office on14.09.2017. The observations viz –a-viz the point wise reply submitted by the industry is as under: -

1. That my unit is engaged the manufacturing of paper board @ 4.0 MT/day since 2008 by using Raw material in the shape of Waste Paper, Gunny Bags, Patali, Sheet Cuttings, Egg Trays etc. for which i have been granted consents by Punjab Pollution Control Board under Water/Air (Prevention & Control of Pollution) Act, 1981 Acts, which have already been expired on 31.03.2010 and by some reason i failed to renew any consents till date. During visit it was observed, that the industry was in operation and was using gunny bags, egg trays and parali etc as raw material for manufacturing of card Board. No pulp and paper mill sludge was found lying in the premises and the industry was not using the same for manufacturing of card Board.
2. That during the year 2015-2016, i started off-set printing by installing of off-set printing machine in a separate shed within the existing unit and there was not addition in the land. The industry has installed off –set printing in a separate shed at the back side of the card board mill. As per the CA certificate submitted there is no addition in the cost of land which indicates that no addition of land has been done.
3. That off-set printing falls in the exempted category, so we request your kind honour to exempt the off-set printing section from obtaining consents from your office and allow me to apply for renewal of consents in relation to manufacturing of paper board @ 4.0 MT/day. The operation of off-set printing falls into white category. The industry has applied for obtaining varied consent to operate for manufacturing of paper board and manufacturing of Paper Board Boxes/Sweet Boxes Cover @ 20000 Numbers/day.
4. That at the time of starting my unit, the same was outside the M.C limits of samana. However, during the provisions years the M.C samana has been revised due to which my unit come in the M.C limit of samana certificate from the M.C Samana is enclosed herewith. E.O. M.C. 5 That at present Samana falls under LPA (Local Planning area), the master plan of which is yet to be prepared by the concerned authorities & in further when the master plan will be ready and if according to that, my industry does not fall in the category of industrial zone, then I will shift my unit as per the directions made by the concerned authorities. The area falls under M.C limits and is located under local planning area. The master plan of samana is yet to be notified.
6. That i am improving the housekeeping area surrounding the re-circulation tank by cleaning the area and maintaining the feeding of raw material in the Bitter and Pulper in a proper manner. The industry has improved the house keeping near the recirculation tanks. But it needs to earmark an area for storage of raw material.
7. That regarding domestic effluent discharge, there are two tanks in the unit, one is septic tank near the toilets and the other is collection tank near the taps and i am modifying the existing collection tank into Septic tank so that the domestic effluent from the washing area/ traps be treated in that & after treatment, the same be discharged into land for plantation. Plantation area is also being developed by me which will be completed within a few days. The industry has provided 2 no. septic tanks for treatment of domestic effluent generated from the unit and same is being discharged onto for plantation along the boundary wall.
8. That water flow meter has already been installed on the submersible pump. The industry has provided new flow meter on its submersible pump.
9. The industry is manufacturing pasting gum & corrugation gum in two separate drums installed by the industry inside its premises. One drum is used to manufacture pasting gum and the other one is used to manufacture corrugation gum. Further, to manufacture these gums, firstly approx. 180 ltrs. Water is filled in each of these drums and then pasting/ Corrugation gum is injected in the drums and rotation is done with the help of motor of 1 HP for about half an hour and the Gum is prepared. Pasting Gum is used for pasting of papers and Corrugation Gum is used for pasting two papers to make Nalidar Paper in Corrugation Machine. The industry has provided two no. drums for manufacturing of gum outside the shed, where offset printing machine is kept.
10 That there is no washing of drums is done in which the gum is prepared. No washing of drums was being carried out during visit.
11 That there will be no extra water near the gum's manufacturing drums and the water will be used at a time when the gum will be prepared. No waste water was observed lying near the gum manufacturing area.
12 That the well in the unit is built-up for the purpose of Rain Water (Prevention & Control of Pollution) Act, 1974 harvesting system. At present the structure of well is open and the pipes show in the well are rain water pipes adjoining to our shed area and ground area through which the entire rain water is injected to the well. Further, we are improving the same by installing filterization system in the well so that it can be effectively used for rain water harvesting. Further, I assure you that there will be no discharge of any type of water in the well except rain water. The industry has provided an open well in which PVC pipes could be seen. These pipes are connected with the shed and the ground area for collection of rain water. The well was empty.

That i do not know how to use/ dispose-off the paint soaked cloths generated from off-set printing section. This is the reason that we are collecting and keeping the same in our unit. It is requested to your kind honour to till me what should be done to these type of cloths and it assure you that it will do the same. The industry has provided one no. off set printing machine having 4 sections in which different colours are used. As per requirement of the market, the colours are fed in the machine and after finishing the job, which is generally after 4-5 days, the colours left on the roller is scraped and then cleaned with the cloth. The industry has stored the paint soaked cloths and empty paint drums in a separate room. The industry has been advised to apply for authorization for generation, collection, storage and disposal of category 5.1 (used oil), category 21.1 (process waste, residues and sludges) and category of 33.1 (Empty barrels contaminated with hazardous chemicals); under Hazardous & Other Wastes(Management & Transboundary Movement) Rules, 2016.
14 That the adequate stack height is provided to silent DG set of 125 KVA installed in the unit. The industry has installed one no. silent DG set of 125 KVA capacity having inadequate stack height.
The industry is complying with the decisions of the hearing and with the provisions of Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981.
In view of the above mentioned facts, SEE, Zonal office-1 may be recommended that:
A. Approval may be accorded to this office for grant of varied consent to operate under Water (Prevention & Control of Pollution) Act, 1974 and under Air (Prevention & Control of Pollution) Act, 1984 to the industry up to 31.12.2024 under green category with usual conditions and special conditions that: -
1. The industry shall shift its unit, if the site of the industry comes under non-conforming zone of master plan to be prepared by the authority concerned.
2. The industry shall apply for obtaining authorization for generation, collection, storage and disposal of category 5.1 (used oil), category 21.1 (process waste, residues and sludges) and category of 33.1 (Empty barrels contaminated with hazardous chemicals); under Hazardous & Other Wastes (Management & Transboundary Movement) Rules, 2016.
3. The industry will not use pulp & paper mill sludge as raw material in its process.
4. The industry shall provide filtration system in the rain water harvesting well within one month.
5. The industry, as per its submission, shall not undertake washing of drums in which gum is prepared and shall not generate & discharge any trade effluent from its premises.
B. Notice issued to the industry u/s 33-A of the Water (Prevention & Control of Pollution) Act, 1974 and u/s 31-A of the Air (Prevention & Control of Pollution) Act, 1981 may be dropped.
