Clarification Note: Subject: Show Cause Notice for refusal of consent under the Water (Prevention & Control of Pollution) Act 1974. Whereas, it is mandatory on the part of industry to obtain the 'consent to operate' under Water (Prevention & Control of Pollution) Act 1974 for discharge of effluent from its premises and to operate industry. And whereas it is also mandatory on the part of industry to install proper and adequate Water pollution control devices so that the concentration of various pollutants conforms to the effluent standards prescribed by the Board. And whereas, the industry was granted consent to operate both under Water (Prevention & Control of Pollution) Act 1974 and Air (Prevention and Control of Pollution) Act, 1981 valid upto 12.12.2016. Now, the industry has applied for renewal of consent to operate under Water (Prevention & Control of Pollution) Act 1974 and Air (Prevention and Control of Pollution) Act, 1981 through OCMMS. And whereas, industry was granted consent to operate Vide no.4172784 dated 22.09.2016 valid upto 21.03.2017 under Water (Prevention & Control of Pollution) Act 1974 & Vide Vide No. 4172775 dated 22.09.2016 valid upto 21.03.2017 under Air (Prevention and Control of Pollution)Act, 1981 for manufacturing of Bathroom faucets items @ 3000 numbers/day Now, the industry has applied renewal for consent to operate under Water (Prevention &Control of Pollution) Act 1974 and Air (Prevention and Control of Pollution) Act, 1981 through OCMMS. And whereas, It is submitted that the project proponent was surprisingly by the team headed by Senior Environmental Engineer on 21/8/2017 and observed during the visit that the STP was in the operation. The entire domestic effluent from toilet and canteen is collected in equalisation tank underneath the STP from where it is treated in STP and disposed off to adjoining land for stagnation and into the few pots lying along the boundary of complex in one side. During the visit, the effluent was being discharged into the adjoining land for stagnation. The industry has maintained a pucca drain covered with slab near the STP leading to rain water harvesting system and the effluent in blackish colour containing oil & grease was found being carried to rain water harvesting pit for recharging into ground water. The effluent sample from the rain water harvesting pits collected and the result of the sample collected from first rain harvesting tank and 3rd rain harvesting tank reveals that pH- 7.3, 6-9. COD -148, 768. BOD- 32, 180. TSS- 108, 750 & O&G- 22.0, 28.0 etc. The various parameters are beyond the limit. There was no plantation within the premises of the store complex except few pots lying along the boundary of the complex. And whereas, show cause notice for refusal of consent was issued for reply within 15-days. The project proponent has submitted the reply of the show cause notice that after treatment treated effluent is being used for irrigation to the plantation in pots inside our premises lying with our walls and water disposal to adjoining irrigation area which is owned by our landlord Mr. Kirpal Singh. It is further mentioned that the industry has not submitted any permission along with its reply regarding disposal of effluent adjoining land for irrigation.
