It is submitted that earlier the industry has applied for varied consent to operate under Water Act, 1974 & Air Act, 1981 for operation of industrial plant to produce refined oil @ 72 TPD in small scale. The case of the industry has been scrutinized and found incomplete in following respect :- 1. The industry has submitted C.A. certificate showing gross fixed assets of Rs. 9.80 crore including value of plant and machinery of Rs. 8.48 crores as such the industry falls in medium scale category, but the industry has applied for consent to operate in small scale category. 2. The industry has installed 1 no. new boiler of capacity 10 ton in the premises but the industry has not submitted the feasibility report / dimension drawing with completion certificate of APCD installed with new boiler for control the flue emissions. 3. The industry has not submitted the site plan of the industry with showing the position of new boiler. 4. The industry has not submitted the certificate from the competent authority regarding the suitability of site for regularization of new boiler installed in the premises. 5. The industry has not deposited the NOC fee for regularization of new boiler. 6. The show cause notice for revocation of consent granted to the industry under Water Act, 1974 and Air Act, 1981 was issued to the industry vide Zonal office letter no. 1063 dt. 12.04.2017. but the industry has failed to compliance of the observations mentioned in the show cause notice. As such, the case of the industry was found incomplete and returned to the industry through online on 27.10.2017 with request to resubmit the same.
The industry has again submitted applications for obtaining varied consents to operate under the Water Act, 1974 and Air Act, 1981 on 05.11.2017 along with reply to the observation conveyed to the industry at the time of returning the case as mentioned above. The case of the industry has been scrutinized and found incomplete in following respect-
1. The industry has submitted that they have purchased boiler of capacity 10 TPH from its sister concern unit namely M/s Evershine Solvex Pvt. Ltd. and feasibility report of APCD installed with boiler already submitted in case of M/s Evershine Solvex Pvt. Ltd.
As per record, the industry has already installed boiler of 6 TPH capacity and thermo pack of capacity 1 lac KCal with common stack. Now, the industry has installed boiler of capacity 10 TPH with common stack of existing boiler and thermo pack. As such, the industry is required to submit the feasibility report as well as dimensional drawing and completion certificate of APCD installed with boiler of 10 TPH capacity to achieve the standards as the total capacity more than 15 TPH.
2. The industry has not submitted the record of the additional land developed under the plantation for scientific discharge of both industries @ 45 KLD as the earlier area developed by the industry is only 4 Kanals, which is not adequate.
If approved, the case may be again returned to the industry with request to submit the compliance of above said observations with the case.
