It is intimated that the project proponent was given an opportunity of personal hearing before the Senior Environmental Engineer of the Board on 03/10/2017, wherein, it was decided that:
(i) The reply submitted by the industry be sent to Environmental Engineer, Regional Office, SAS Nagar with request to verify the contentions of the industry and process the renewal of water consent application on merits.
(ii) The renewal of 'consent to operate' applied by the industry under Air (Prevention & Control of Pollution) Act, 1981 be granted upto the adequacy of consent fee.
(iii) The industry shall submit bank guarantee amounting to Rs. 50,000/- within one week, as an assurance to comply with the provisions of Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 and Hazardous and Other Wastes (Management and Transboundary Movement) Rules, 2016.
In compliance to the hearing decisions the service station has submitted a bank guarantee of Rs. 50,000 bearing no 0506217BG0000483 dated 13/10/2017 valid upto 12/10/2018 as an assurance to comply with the provisions under the Water (Prevention & Control of Pollution) Act, 1974, Air (Prevention & Control of Pollution) Act, 1981 and Hazardous and Other Wastes (Management and Transboundary Movement) Rules, 2016. The industry has deposited Rs. 15,000/- as NOC regularization fee for increase in the fixed assets from Rs. 86 lakhs as in 2004 to Rs. 7.86 crores as on 31.03.2016. The project proponent has submitted a CA certificate showing the value of fixed assets amounting to Rs. 7.86 Crores as on 31/03/2016. The project proponent has deposit Rs. 1,50,500/- (Rs. 75,000/- under the Water Act, 1974 and Rs. 75000/- under Air Act, 1981 & Rs. 500/- as form fee) vide R. no. 97/4043 dated 07/04/2017. As such, the fee deposited by the industry is adequate upto 31.03.2022.
The site of the industry was again visited by AEE of this office on 27.10.2017 and it was observed that:
1. The ETP provided by the service station was in operation. The service station has got the motor repaired which were earlier not in operation.
2. The service station has provided ETP based on phyisco – chemical treatment to treat the waste water generated from washing section. Also, the industry has started upgrading the existing ETP by providing clarifier and oil and grease separator. During visit, the process of installation of the same was being carried by the industry.
3. The industry is maintaining record of fresh water, however, no separate record is maintained for the water consumed for washing of cars and make up water added. The industry was advised to maintain record of the water used for washing of cars and for the quantity of waste water treated.
4. The industry has now maintained the hazardous waste area which was earlier in a shabby condition.
In view of above, it is recommended that the consent to operate under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 may be granted to the industry upto 31.03.2022 along with suitable conditions.
