It is submitted that the subject cited project proponent was granted 'consent to establish' (NOC) by the Board vide no. R13SAS462551 dated 14/08/2013 for construction of a 5 star hotel in the revenue estate of Village Bharonjia, Mullanpur, Tehsil Kharar, Distt. SAS Nagar and the validity of the same was further extended upto 12/08/2015 by the Board, vide no. R14SASCTE1657116 dated 13/08/2014. Lastly, the validity of the said NOC was extended upto 12.08.2017, subject to suitable conditions.
Now, the promoter company has submitted an application for obtaining extension in the validity of NOC. The project proponent has submitted the documents along with its application such as compliance of conditions of EC, compliance of conditions of NOC etc.
Accordingly, the site of the project was visited by the AEE of this office on 28.12.2017, and Sh. Mukesh Bhati, AGM, was contacted. During the visit it was observed that:
1. The promoter company has completed laying of slabs upto 3rd floor and laying of slab of 4th floor was in progress.
2. The promoter company has yet not started construction work of the STP. The representative of the promoter company informed that the construction work of STP shall be started soon.
The promoter company had earlier deposited of Rs 1,80,000 online through UTR no AXISF16217061269 dated 04.08.2016, on account of NOC fee, which was adequate upto 12.08.2018. And now, the promoter company has deposited additional Rs. 35,500 through UTR No. AXSK173350024864 dated 01.12.2017.
Further, the promoter company has already obtained Environmental Clearance under EIA notification dated 14/09/2006 for construction of Commercial Project namely 5 star hotel complex, vide no. 1242 dated 06/02/2014
It is added here that in the last extension in the validity of the NOC granted to the promoter company, a condition was imposed to the effect that the promoter company shall get the necessary amendments in the Environmental Clearance granted to it from SEIAA, Punjab and submit the same to the Board, within 03 months. However, the promoter company has not yet submitted the same, as such, a clarification in this regard was raised through online system, to which, the promoter company has replied as under:
“Since our project is under construction and it will take aprox 03 more years to complete. We will take necessary amendments in the EC before getting consent to operate from the PPCB.”
In view of above, if approved, the validity of consent to establish (NOC) granted under the Water Act, 1974 and Air Act, 1981 may further be extended upto 12.8.2018 subject to same conditions mentioned therein and in its subsequent extensions.
