• It is intimated that earlier the industry was granted consent to operate under Water Act, 1974 vide no. ZO-II/LDH/RO-IV/WPC/2012/F-539 dated 05.03.2012 and under Air Act, 1981 vide no. ZO-II/LDH/RO-IV/APC/2012/F-490 dated 05.03.2012, both were expired on 31.03.2016.
• Thereafter, a complaint was received from M/s Surindera Cycle Pvt Ltd., C-195-196-197, Phase-7, Focal Point, Ludhiana against the industry having jerks and vibrations due to the hammer installed.
• Accordignly, the industry was visited and issued notice for violations of the provisions of the Water Act, 1974 and Air Act, 1981 with an opportunity of personal hearing before the Senior Environmental Engineer, Zonal Office-II, Ludhiana on 03.1.2017, wherein it was decided as under:-
1. The industry to provide adequate stack height with 4th furnace also shall provide samping arrangements with at least two out of four stacks attached with the forging furnaces, within 15 days.
2. The industry will explore the rechno economic feasibility of providing induction heating in place of oil fired furnace. If feasible, then replace the oil fired furnaces with induction heating in phase manner, within 1 year.
3. The industry to take all necessary measures for control of noise pollution, within 15 days.
4. The industry to apply for obtaining consent to operate under Water Act, 1974 and Air Act, 1981 within 15 days.
5. Environmental Engineer, Regional Office-4, Ludhiana in person shall visit the industry along with AEE, Zonal Office-II, Ludhiana after 15 days, verify the compliance of the decisions of the hearing, carry out sampling of at-least one stack of oil fired furnace and monitor the noise levels (immediate outside the industry as well as in the premises of the complainant industry) and check arrangements made there too.
6. Environmental Engineer, Regional Office-4, Ludhiana to process the consent application, on the receipt of same from the industry, in light of the verifications/mentioned as detailed at Sr.No. 5 above.
• Therefore, in compliance of the Competent Authority decisions, the industry was visited by Er. Bachan Pal Singh AEE and Er. Atul Kaushal, AEE of this office on 03.10.2017 and observed that:-
1. The industry was in operation. The industry has installed 04 forging furnace, out of which one forgings furnace was lying outside the premise of the industry in dismantled condition and the industry has provided adequate hood/stack with the 03 no. forging furnaces along with sampling arrangements. Further, the industry has provided adequate stack with shot blast machine.
2. The representative of the industry told that the consent will be applied within 07 days positively. The representative of the industry told that due to implementation of GST, the industry is financial crisis and could not replace oil fired furnace with induction heaters. The representative also informed that after stabilization of the industry and market condition they will explore the possibility of replacing the oil fired heaters.
3. The noise monitoring was carried out in the presence of the representative and results are as under:-

• The report regarding the same is already send to Zonal Office-II, Ludhiana vide this office letter no. 3705 dated 10.10.2017.
• Thereafter, the request of the industry was considerd by the Competent Authority and this office was requested to verify the contention of the industry and proceed further in the matter accordingly.
Meanwhile, Now, the industry has applied for renewal of consent to operate under Water Act, 1974 and Air Act, 1981. To verify the facts, the industry was visited by the AEE of this office on 29.12.2018 and it was observed as under:-
1. The industry was in operation during the visit and engaged in manufacturing of engg. Goods by forging process.
2. As earlier reported The industry has installed 04 forging furnace, out of which one forgings furnace was lying outside the premise of the industry in dismantled condition and the industry has provided adequate hood/stack with the 03 no. forging furnaces along with sampling arrangements. Further, the industry has provided adequate stack with shot blast machine.
3. No DG set installed within the premises of the industry.
4. The industry generates no trade effluent. Domestic effluent discharged into sewer and the entire cooling water is re-circulated.
5. The industry has deposited consent fees for 03 years only. The representative of the industry told that due to uncertain market condition they can only plan to run the industry for next three years. If the market condition will be stabilized, they will apply for further extension for consent to operate under both acts.
In view of above, it is recommended that consent to operate under Water Act, 1974 and Air Act, 1981 may be granted upto 30.06.2019 with appropriate conditions, please.
