Subject: Show cause notice for refusal of consent under the Air (Prevention & Control of Pollution) Act, 1981 & Water (Prevention & Control of Pollution) Act, 1974.
Whereas, it is mandatory on the part of hotel to obtain the 'consent to operate' under Water (Prevention & Control of Pollution) Act 1974 and Air (Prevention & Control of Pollution) Act, 1981 for discharge of effluent/emissions from its industrial premises and to operate an industrial plant.
And whereas it is also mandatory on the part of hotel to install proper and adequate effluent /air pollution control devices so that the concentration of various pollutants conforms to the effluent/ emission standards prescribed by the Board.
And whereas, the hotel was granted consent to operate under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 which was valid upto 30.04.2011 under green category.
And whereas, the hotel has applied for fresh consent to operate under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act 1981 through OCMMS.
And whereas, the hotel was earlier issued show cause notice for violation of provisions of Water (Prevention & Control of Pollution) Act 1974 and Air (Prevention and Control of Pollution) Act, 1981 with personal hearing before Senior Environmental Engineer on 18.01.2016 in which it was decided that :-
1) The industry shall install O & G traps within 15 days.
2) The industry shall apply for consent to operate under Water (Prevention & Control of Pollution) Act 1974 and Air (Prevention and Control of Pollution) Act, 1981. 3. The Regional Office, Jalandhar shall verify the facts at site after 15 days and submit report with recommendation for further action accordingly.
3) The marriage palace has applied for fresh consent to operate under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act 1981.
And whereas, the hotel was visited by AEE of Regional Office on 03.01.2018 and observed that the unit is a hotel with 3 no rooms, 1no hall and restaurant. The hotel is not generating any trade effluent and only domestic effluent is discharged into M.C. sewer after Oil & grease traps, thereafter leading to STP installed at Sultanpur Lodhi. The hotel has installed 1 no. D.G. set of capacity 20 KVA with canopy. The hotel has submitted NOC from M.C Sultanpur Lodhi vide letter no. 1195/17 dated 26.12.2017 stating that sewerage of the palace is being discharged in sewerage provided by Nagar Council Sultanpur Lodhi and also the Municipal solid Waste of the palace is being lifted by Nagar Council Sultanpur Lodhi. The hotel has not submitted approved building plan from the C.A as well as change of land use (CLU).
And whereas, the hotel is violating various provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981.
And whereas, the matter has been considered by the Competent Authority and it has been decided to issue show cause notice for refuse the consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981, with an opportunity of show cause notice.
As such, the hotel is hereby given an opportunity, to file objections, if any, within 15 days, as to why the proposed action be taken, failing which it will be presumed that the hotel has nothing to say and the Board shall go ahead, to take proposed action for refuse the consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 without giving any further notice / opportunity.
