The agenda note and report / recommendations of EE, RO, SAS Nagar may kindly be perused.
The brick kiln was afforded an opportunity of personal hearing by the CEE (P) u/s 31-A of the Air Act, 1981 on 13/10/2016. The proceedings of the hearing are uploaded herewith for kind perusal. During hearing, the Partner of the brick kiln agreed to obtain permission u/s 79 of Punjab Regional & Town Planning and Development Act, 1995 from the Competent Authority and requested for one month time to complete the job. After hearing, amongst other decisions, it was decided that the industry shall obtain permission u/s 79 of Punjab Regional & Town Planning and Development Act, 1995 from the Competent Authority for continuation of the brick kiln at the existing site and submit a copy to the Regional Office of the Board within 21 days.
Now, the brick kiln has applied for obtaining 'consents to operate' under the Water Act, 1974 & the Air Act, 1981.
From the perusal of consent agenda note, it has been observed that the industry has not submitted certificate from GMADA, however, on raising clarification by RO, the industry has replied that they will apply for obtaining requisite certificate from GMADA shortly.
EE, RO, SAS Nagar has recommended to grant 'consents to operate' to the industry by giving reference of another brick kiln M/s Dilbag Singh & Co. However, from the perusal of record file of M/s Dilbag Singh & Co. it has been observed that M/s Dilbag Singh & Co. has obtained EC as well as applied to GMADA for obtaining requisite certificate. In the brick kiln in question, the brick kiln has neither obtained EC nor applied to GMADA as per decision of the hearing dated 13/10/2016.
As such, the recommendations given by EE, RO, SAS Nagar for grant of consents to the brick kiln are not appropriate.
If approved, the industry may be issued show cause notice before refusal of 'consents to operate' under the Water Act, 1974 & the Air Act, 1981 with an opportunity of personal hearing please. |
